The Agenda Review Session of the Board of Public Works was convened at 10:31 a.m. on March 17, 2022. Board of Public Works Clerk, Theresa Heffner confirmed the presence of
Board President Elizabeth A. Maradik, Vice President Joseph Molnar, and Board Members Gary
Gilot (virtual), Jordan Gathers, Murray Miller, and Board Attorney Clara McDaniels. President Maradik presented the Board with a proposed agenda of items presented by the public and City Staff.
Board members discussed the following item(s) from the agenda.
Resolution No. 20-2022: Sewer Lateral Reimbursement Policy Public Works Deputy Director Jitin Kain came before the Board to speak about agenda item 9.A. regarding a Sewer Lateral Reimbursement Policy. Deputy Director Kain explained that the intent
of the policy is to provide an opportunity for developers and property owners to do more infill
housing in South Bend’s inner-city neighborhoods. He stated one of the barriers to development in inner-city neighborhoods is the cost of connecting to a lateral that is often in bad shape and needs to be completely replaced. He remarked that the lateral connection and digging up the sidewalk and street is a costly barrier, and the Policy, if put in place, would assist smaller
developers in building housing by subsidizing some of the development costs for multifamily
residential structures. He stated the reimbursement amount would be up to $20,000 of qualifying expenses with a cost share which the future program applications will outline what that cost share will be.
Deputy Director Kain went over a few of the property qualifications for the Policy. He stated that
the location guidelines are set up in such a way so that it focuses the program on certain zoning districts outlined in the resolution; the U1, U2, U3, and UF are inner-city zoning districts, not to subsidize housing in the suburbs or on the fringe of the City. He noted another qualification is the building type must be a residential development up to five (5) dwelling units. He added that
the planning office is looking at doing more to encourage the missing middle type of housing
(duplexes, triplexes, fourplexes) which is different than the single-family housing that we typically see. He said the third qualification that would be used which is a residential structure valuation. He stated that one of the commonly occurring issues is the cost of structures. He continued to add that certain structures in certain neighborhoods can be developed and be sold
without needing any subsidies, but certain areas will need some subsidies. He said the City
would look at the building permit for a new residential structure and try to cap it at a certain amount as this program would not be intended for homes in other parts where developers can build homes at a higher cost and sell them at a higher cost but rather this program would be for inner-city residential areas. Lastly, Deputy Director Kain discussed ineligible location as the last
qualification, and informed the Board that a greenfield site, an area that has not been previously
developed, would not qualify for this program. Mr. Miller asked if he would be eligible for the program if he were to build a house and Deputy Director Kain responded to say anyone that owns a property and wants to build would be eligible
if they meet the criteria. Mr. Miller followed up to ask where the money for the program would
be coming from. Deputy Director Kain responded that it would be coming from the City’s sewer operation fund because it’s for sewer lateral work so the City is using its sewer operations resources. Mr. Miller, seeking clarification, asked if the Combined Sewer Overflow (CSO) money was being used. Deputy Director Kain responded no and explained that the sewer
department is funded through sewer funds that come from residents paying their utility bill. Mr.
Murray restated that part of that money is used for CSO and Deputy Director Kain replied yes and explained that CSO money is funded by sewer rates established by the South Bend Common Council. Mr. Miller shared his concern for sewer rates increasing for homeowners that can’t afford the increase and then reimbursing developers. Deputy Director Kain stated that the CSO
project long-term control plan is a twenty (20) year plan that will cost the City over $200 million dollars, where this is appropriating $180,000 a year, so it’s a very small amount that goes into helping the City neighborhoods. Deputy Director Kain suggested that by increasing development in these inner-city areas, it helps everyone because those new homes will increase tax flow and the taxes help the City overall with other projects.
Mr. Miller restated his concern that residents cannot afford the rates going up and said that the City has not done any CSO work in six (6) or seven (7) years. Deputy Director Kain responded that the City is doing continuing CSO work, just not doing sewer separation because that was

part of the old consent decree; however, the new plan has a lot of other projects that include upgrades to the treatment plant, so those projects have been ongoing.
President Maradik noted that she was happy to see a program like this being offered that will be a benefit and encourage good infill development in South Bend’s urban neighborhoods. President Maradik wanted to assist in clarifying that part of this program is to focus on areas where there is a gap in what it costs to build a house compared to what it can be sold for, and
with this program, the City is trying to reduce that cost to encourage development in some of the
neighborhoods that might not otherwise see development. She gave the example that if it will cost a builder $20,000 more to build a house compared to what it will be valued at then it becomes an issue, and that cost would explain why there are no houses in some parts of South Bend. She continued to say that this program will help financially incentivize developers so the
City can get some more urban infill which in return, will bring more sewer users, more property
taxes, and other benefits that come with more houses in our urban neighborhoods. Vice President Joseph Molnar shared that he is a big proponent of the program simply because you can’t build a house in seventy-five percent (75%) of the neighborhoods in the City of South
Bend right now due to material costs going up. VP Molnar continued to say that with CSO and
funding our infrastructure long-term, it is unsustainable when there are neighborhoods with more vacant lots than houses. He argued that regardless of the number of homes on a street, the City still has to pave the roads and repair broken pipes, so if there are not any users paying into it through taxes, it’s unsustainable long term which only confirms the need to incentivize
development in these areas. He said that the City has to get houses back on some of the vacant
lots in any way possible to start paying for these long-term costs. Mr. Gilot commended the program and added that it is really needed in the area. He stated he served on the Board of Public Works for many years, and he has seen cost escalation on housing
and laterals where there’s pavement replacement. The standards for pavement replacement have
gone up for good reason, so that the City doesn’t interfere with the useful service life of the road due to all the cuts for utilities. Mr. Gilot continued to say that he loves the program and thinks it’s good public policy and asked if the program could be extended a little further by providing the funds upfront to cover the cash flow of the project rather than a reimbursement for
community development corporations that building affordable housing. Deputy Director Kain
explained that the program is set up as a reimbursement program, but the City could turn around the reimbursement pretty quickly if needed but would need to check to see if it’s something Mayor Mueller would like done. Mr. Gilot clarified that he is not talking about the private for-profit developers, but rather partners the City already works with on affordable housing in target
neighborhoods of need. You can build an affordable new house for a little over $200,000 and the
market value might be $120,000-$140,000, so there is a big loss and developers are struggling to cash flow the projects even with City assistance. Deputy Director Kain added that one of the issues of providing the money upfront is ensuring the money will be spent on the sewer lateral work. Mr. Gilot asked to consider the bank already providing the construction loan to act as an
escrow agent and provide evidence back that the bills paid out of the advancement from an
escrow account went only for the lateral. The Early Bird Eatery/Four Stones LLC: Wayne Street Parking Garage Mural Agreement
Angela Smith from the Department of Community Investment (DCI) noted The Early bird
Eatery was on the agenda for the upcoming meeting for an agreement and for an encroachment/revocable permit (item 10.C, item 11. F). She wanted to inform the Board there is a maintenance agreement being transferred as a purchase of property and it has come up that Early Bird wants to do a mural on the side of the Wayne Street parking garage which is a City
asset and therefore controlled by the Board of Public Works. She continued to say that Early Bird has already used their sign area for the awning that they are proposing, so the Board would be allowing them to use what the City is entitled to use for sign area in order for Early Bird to put the mural on the garage. She made the Board aware that Attorney McDaniels is drafting an agreement for the mural with the new owners of The Early Bird to do the final design and
installation. President Maradik clarified that the topic of the mural was not on the current agenda and asked if Attorney McDaniels could confirm. Ms. Smith said she was under the impression it would be covered under the encroachment/revocable permit section on the current agenda. Attorney McDaniels replied that the agreement will be on a future agenda as its own item and is not part of the agreement or encroachment/revocable permit on the current agenda.

Four Stones LLC: Assignment and Assumption of Wayne Garage Use, Maintenance and
Façade Agreement Amy Paul from the Department of Community Investment (DCI) was present to speak about 10. C. Transfer of ownership of shops from Michigan Street Shops LLC, 117 East Wayne to Four Stones, LLC noting that nothing on the agreement has changed except for the new owner.
Board Attorney Clara McDaniels advised that ownership has transferred over to Four Stones, LLC which is the broader organization and The Early Bird Eatery share the same corporate ownership. Attorney McDaniels noted the agreement being between the City and Four Stones, LLC which took the place of the Michigan Street Shops which includes all of the shops including
The Early Bird Eatery
Notice of Intent to Self-Perform: 2022 Annual Paving Program Mr. Miller raised a question about item 2.A. regarding the 2022 Annual Paving Program where the City will self-perform forty-six (46) projects with its own qualified workforce. Mr. Miller
questioned if there was going to be a third-party inspection done on the paving projects which he
stated was a requirement of the statute. Deputy Director Kain said that inspections are not required for internal projects but referred to Attorney McDaniels on the statute. Attorney McDaniels reviewed the statute and found that third-party inspections only apply to projects that are $150,000 and above when self-performing. Mr. Miller asked where that information was
found and Attorney McDaniels advised that it is under statute 36.1-12. Mr. Miller asked if IC5-3-
1, as written, applied. Director of Public Works Eric Horvath noted that they City inspects both internal and external asphalt paving projects. Deputy Director Kain explained that the City does inspections but does not use a third party. Mr. Murray, seeking clarification, asked if there are inspections, why are there no reports. Deputy Director Kain responded that there are no reports
produced for internal work because the ordinance doesn’t require it. Attorney McDaniels
clarified that inspection is a requirement, but the reports are not under the statute. Mr. Murray questioned how someone would know if a project was inspected if there is no report documenting the inspection. Deputy Director Kain stated that internal work is inspected by internal groups.
Mr. Murray shared that he interpreted the statute differently and feels that everyone should be treated the same whether it’s internal or external work being done. Mr. Murray explained that when the City gets an inspection report from a private contractor, they are making sure that the project has followed state specifications. Mr. Gilot explained that the intent of whether the work
is publicly or privately performed is to get a good value for the taxpayers’ money on paving
projects. Mr. Gilot continued to say there is a difference when you internally perform as the owner by virtue of your role as City government has the fiduciary responsibility to be a good steward of those roads, so there is a different mindset of an owner-performed job than a private, for-profit entity performing that job where the taxpayer needs an independent inspection to know
that it met all the specifications for workmanship and material. Mr. Gilot stated he would have
no problem with an even-handed inspection report but does see a difference when it's self-performed by local government as a fiduciary of the taxpayers that adherence to workmanship and materials standards of the industry is incumbent upon an owner who is self-performing. Mr. Gilot continued to say that someone might do projects with a different level of responsibility on
their own home out of a sense of fiduciary responsibility than they would on a disinterested
house that they have no connection to. Lastly, Mr. Gilot commented that it would be nice if everyone had integrity and did both to the same quality, but there's a slight difference with the owner-performed work by City government with the obligation of stewardship over those infrastructure assets.
Right-of-Way Encroachment License Agreement – KRG Eddy Street Land III VP Molnar asked about item 10. F. Right-of-Way Encroachment License Agreement - KRG Eddy Street Land III digital kiosks, noting a typo on page two (2) item number five (5) of the
license agreement, it referenced six (6) kiosks where it should be four (4). Attorney McDaniels advised that it was a typo and would be corrected. Mr. Gilot stated that fifty percent (50%) of net proceeds sounds like a good negotiation, but raised a concern about the unbalanced or inappropriate expenses assigned to the signs. He gave

the example if somebody who spent ninety-nine percent (99%) of their time maintaining the garage walked by the signs once a week and saw that they're still there and then
disproportionately allocated that expense, the net profits out of the revenues from the sign
advertising could be made to look like nothing. Mr. Gilot added that he was a little worried about the accounting of expenses to go from gross revenues down to net revenues that they split with the City and asked if the City has the right to audit all of the expenses that take the gross revenues down to the net revenues. Attorney McDaniels advised that the City does have the right
to audit and inspect the records, so that would be all-encompassing. Mr. Gilot added that if it is
all done straightforwardly, he feels this is a wonderful agreement, but would like to see a “trust, but verify” through an audit.
Traffic Control Devices: New Installation of Ride Share Signs
President Maradik asked about item 13.A. regarding the East Jefferson Blvd. Ride Share Zone sign that was on the agenda as being installed, but said she was under the impression East Jefferson Blvd. was not getting a ride share sign installed. Ms. Charlotte Brach, Engineering, stated that all of the listed locations were piloted, but the East Jefferson pilot was shown not to
be useful based on the heat maps so the East Jefferson Blvd. ride share sign would not become
permanent, whereas the rest will. Bureau of Indian Affairs Right-of-Way Application
Attorney McDaniels noted a correction to the title of agenda item 10.G., Bureau of Indian Right-
of-Way Agreement. The correct title should be Bureau of Indian Right-of-Way Application. The application is for the expansion of the existing utility easement that is on the Pokagon Band of Potawatomi Indians Property by ten (10) additional feet for future maintenance if needed.
Mr. Gilot asked if the City was applying for a right-of-way or an easement as the application
seemed to be using the terms interchangeably even though they are not synonymous words. Attorney McDaniels stated that the terminology used came from the Bureau of Indian Affairs where they call a right-of-way as what the City would call an easement. She clarified that the application was for an easement on the property and the rights for the City to do work in their
space.
Opening of Bids: 2022 Asphalt Materials Bid Mr. Murry asked about item 3. B. regarding the 2022 asphalt materials bid. He questioned how materials could be subdivided and given Minority and Women-Owned Business Enterprise goals
(MWBE goals). City Engineer Kara Boyles responded that there should not be goals on the
materials part of it. Attorney McDaniels advised that the MWBE requirements were on the trucking aspect of the project. Attorney McDaniels noted that if a project can be subcontracted out, the Office of Diversity and Inclusion (ODI) will apply MWBE contract goals. Mr. Miller referenced the specifications for the asphalt bid, specifically relating to the delivery of the
materials. Ms. Boyles explained that the wording in the bid looks like a contingency line for
delivering materials to the City in which there would be MWBE goals associated with the driving portion. President Maradik responded that it’s similar to a subject to that if under the circumstances the City was unable to haul their own material, the contractor would be asked to haul it. Mr. Miller asked if it was an alternate or a base bid price. Ms. Boyles explained that she
didn’t believe there were any alternates in the bid because they would only award based on unit
prices, so there is no total. Mr. Murray, seeking clarification, asked what the reasons were for lowering the goals were. VP Molnar requested that someone from ODI should be at the agenda review sessions and regular meetings when agenda items have MWBE goal assigned to them. Mr. Gilot commented that the specifications are not clear that the MWBE goals are only applied
to the trucking part of the project rather than the entire project. Ms. Boyles said they would make that correction in the language of the project specifications document for clarity on where the MWBE goals are being requested.

REGULAR MEETING MARCH 22, 2022 The Regular Meeting of the Board of Public Works was convened at 9:30 a.m. on Tuesday,
March 22, 2022, by Board President Elizabeth A. Maradik in the 13th Floor Conference Room of
the County-City Building, 227 W. Jefferson Blvd., South Bend, Indiana. The meeting was also streamed live to the public via Microsoft Teams. Board Clerk Theresa Heffner confirmed the presence of Board President Elizabeth A. Maradik, Vice President Joseph Molnar, and Board Members Gary Gilot, Jordan Gathers (arrived at 9:46), Murray Miller, and Board Attorney Clara
McDaniels (virtual), with a roll call. President Maradik reminded virtual attendees to mute their
microphones and turn off their cameras when not speaking, and to save their questions and comments for the Privilege of the Floor.
APPROVE MINUTES OF PREVIOUS MEETING
Upon a motion made by VP Molnar, seconded by Mr. Miller and carried by roll call, the minutes
for the Agenda Review Session and Regular Meetings of the Board held on March 3, 2022, and March 8, 2022, were approved.
NOTICE OF INTENT TO SELF PERFORM – 2022 ANNUAL PAVING PROGRAM (MVH)
Mr. Scott Kreeger, Engineering, advised that this was the date set for a discussion of the City’s
Notice of Intent to Self-Perform with its own qualified workforce, for paving Colfax Ave. (Eddy St. to Esther St.) in the amount of $133,050.28, Linden Ave. (Grant St. to Birdsell St.) in the amount of $136,598.70 and St. Vincent St. (Niles Ave. to Notre Dame Ave.) in the amount of $109,512.15. In a memorandum to the Board, he stated the city has published it’s paving list,
and these were the only three (3) of the forty-six (46) streets that exceeded the $100,000 limit.
He noted the costs include the labor, rental equipment, and asphalt material. Upon a motion made by VP Molnar, seconded by Mr. Miller and carried by roll call, the Intent to Self-Perform was approved.
OPENING OF BIDS – 2022 STREET AND SEWER MATERIAL BID – PROJECT NO. 122-028 (PR-00015077) This was the date set for receiving and opening of sealed bids for the above referenced project. The Clerk tendered proof of publication of Notice in the South Bend Tribune, which was found to be sufficient. The following bids were opened and publicly read:

President Maradik stated that since this is a materials bid MWBE requirements will not likely be
attached and would potentially only be associated if there is trucking for delivery of materials. Mr. Miller asked why some of the material bids have MWBE requirements, and some material bids do not. President Maradik clarified that the City typically picks up the material but when the
City is unable to, the contractor may be asked to deliver. That is when the MWBE requirements

AWARD BID AND APPROVE CONTRACT – SALE OF CITY-OWNED PROPERTY – 1514 DALE AVE. Mr. Andrew Netter, Community Investment, advised the Board that on March 8, 2022, bids were
received and opened for the above referenced project. After reviewing those bids, Mr. Netter
recommended that the Board award the contract to the lowest responsive and responsible bidder, Gladis Ibarra Duarte, 22240 Ireland Rd., South Bend, IN 46614, in the amount of $4,000, for a total amount of $4,156, inclusive of the Associated Fees referenced in the enclosed Purchase Agreement. Therefore, VP Molnar made a motion that the recommendation be accepted, and the
bid be awarded, and the contract approved as outlined above. Mr. Gathers seconded the motion,
which carried by roll call. OPEN MARKET AWARD QUOTATION – 2022 BIOSOLIDS TRUCKING FOR LAND APPLICATION CONTRACT – PROJECT NO. 122-031 (PR-00015085)
Mr. Jacob Klosinski, Engineering, advised the Board that on March 17, 2022, quotations were
received and opened for the above referenced project. After reviewing those quotations, Mr. Klosinski recommended that the Board award the contract to the lowest responsive and responsible bidder, Trucks R Us Inc., 23300 State Road 23, South Bend, IN 46614, in the amount of $145.00 (unit price, per truck, per hour). Therefore, VP Molnar made a motion that

AUTHORITY
The Board of Public Works (the “Board”) of the City of South Bend (the “City”) adopts this statement of policy (this “Policy”) pursuant to the Board’s authority for supervision of streets, alleys and City property under Indiana Code Section 36-9-6-2 and South Bend Municipal Code Chapter 17. STATEMENT OF PURPOSE AND INTENT

The cost associated with new sewer lateral connections, including pavement replacement, act as a
barrier to reinvestment in our existing urban neighborhoods. To support efficient infill development and reinvestment into our community, the City of South Bend has developed a new program to assist with these costs.
The Sewer Lateral Reimbursement Program assists property owners with the complete replacement of a sewer lateral from the house to the City’s main sewer line. The program only applies to new residential infill construction. PROGRAM GUIDELINES Section 1: Eligibility Through the Sewer Lateral Reimbursement Program, the City will reimburse property owners for qualifying expenses of new sewer lateral connections. To be eligible for participation, an applicant
must have plans to construct a new residential or neighborhood scaled multifamily residential structure within a qualifying zoning district. Section 2: Property Qualifications Properties must meet the following qualifications:
(i) Location: Property must be located in areas zoned under the South Bend Zoning Ordinance
as U1 Urban Neighborhood 1, U2 Urban Neighborhood 2, U3 Urban Neighborhood 3, or
UF Urban Flex.
(ii) Building Type: The new infill construction must be for a residential development up to 5
dwelling units.
(iii) Residential structure valuation: In order to keep the program targeted towards low-and
moderate-income neighborhoods, residential structures will need to meet a valuation
threshold which will be established annually in the program application. The applicant’s
structure valuation will be obtained through their new house permit as filed with the St.
Joseph County/South Bend Building Department.
(iv) Ineligible locations: A greenfield site (i.e., land previously undeveloped), is not eligible for
participation.
Section 3: Reimbursement Amount
The City will reimburse the applicant up to $20,000 for qualifying expenses. The property owner may be responsible for a portion of the project expenses and such cost share shall be outlined in the program application. Section 4: Qualified Expenses: Funding for the replacement of new sewer laterals will be provided
as reimbursement to applicants who meet all the qualifications of the program. Funding may be used towards the entire cost of the sewer lateral (from the main line to the residential structure). Qualifying costs for reimbursement include: labor and materials for the sewer lateral work, pavement restoration, sidewalks, curbs, and traffic control. Engineering and permitting costs are not eligible for
reimbursement. Section 5: Program Application Interested property owners will apply for the program prior to starting any construction on the sewer
lateral. The application will be available on the City of South Bend’s website and will be reviewed by City staff. Once a completed application is submitted and approved by City staff, the applicant may begin work on their sewer lateral project. The work must be performed by private, bonded, licensed contractors
and in accordance with the City’s Standard Specifications. After completion of work, the applicant may seek reimbursement. Construction work on the sewer lateral shall be completed no more than one year after approval of
the application. This resolution shall be in full force and effect as of the date of its adoption by the board.

In her memo, she stated Water Works customer service staff verified that all of the applicants are head of the households and have submitted proof of age sixty-five (65) or older.
