The August 27, 1990 meeting of the Personnel & Finance
Committee was called to order by its Chairperson, Council
Member Ann Puzzello at 4:40PM.
Persons in attendance included Council Members: Soderberg,
Zakrzewski, Slavinskas, Luecke, Puzzello, Niezgodski, and
Voorde: Don Porter, Kathy Dempsey, Katie Humphreys, and
Kathleen Cekanski-Farrand.
Council Member Puzzello noted that the first item on the
agenda was to review Bill #58-90 which addresses "Scrap
Metal Dealers, Junk Dealers, Recycling Operations, and
Transfer Stations. "
The Council Attorney noted that each Council Member should
have received a copy of a Substitute Bill #58-90. She noted
that she had met with Patricia DeClercq, the Director of
Code Enforcement last week. They had discussed and agreed to
amendatory language. She also noted that she had been in
contact with the City Attorney, whose office was also in
agreement with the language. Basically, the language in
Section 1 would grandfather current businesses in existence.
However, all new businesses or existing businesses which
expand after October 1, 1990 would be subject to the higher
fencing requirements for Class B Fencing.
She also noted that the Amendment set forth in Section 2
with regard Hardship Situations remain as originally
proposed.
Council Member Zakrzewski, the Sponsor of the Bill, then
gave further supporting comments in favor of the Bill.
Kathy Dempsey, then read a letter from Patricia DeClerq
voicing support of the Substitute Bill.
Council Member Luecke suggested that on Page 1, Paragraph 2,
that the Bill be amended to 8 feet. It was agreed that this
correction would be made. He also suggested that replacement
of fencing should also be considered in the amendatory
language at the top of Page 2. Council Member Zakrzewski
stated that he would be open to this suggestion. Both the
Council Attorney and Mrs. Dempsey noted that fencing is
typically replaced in part by weather related matters or
because of persons backing into the fencing. It was further
noted that in both instances the owners must replace the
fencing with fencing of uniform quality.

Council Member Coleman asked several questions with regard
to the replacement option and Council Member Voorde also
questioned Council Member Luecke with regard to this
proposal. Council Member Soderberg voiced concerned that it
should not become an undue hardship to businesses.
Following further discussion it was suggested that on Page 2
after the word expand that the following words be added "or
replace Type B Fencing in its entirety" and that in
Paragraph 4, on Page 2 that the word "fore" be corrected.
Council Member Luecke made a motion seconded by Council
Member Zakrzewski to incorporate those changes into the
Bill. The motion passed. Council Member Luecke then made a
motion seconded by Council Member Zakrzewski that amended
Substitute Bill be recommended favorably to Council. The
motion passed.
Council Member Puzzello noted that the remaining items
involve Bill Nos. 69-90, 70-90 & 71-90 all related to the
Budget for 1991. She noted that Minutes of the Personnel &
Finance Committee Hearings were presented to each Council
Member earlier.
Katie Humphreys, then passed out a 1 page handout entitled
"Ordinance/Budget Changes" (copy attached) , which would
formally be the Administrations recommendation to amend Bill
# 69-90.
Following discussion, Council Member Luecke made a motion
seconded by Council Member Voorde that Bill #69-90 be
recommended as proposed by the City Administration. The
motion passed. Council Member Luecke then made a motion
seconded by Council Member Voorde that Amended Bill 69-90 be
recommended favorably to Council. The motion passed.
The Committee then discussed Bill #70-90 addressing the
Levying of Taxes and Fixing the Rate of Taxation. It was
suggested that the City Controller have the current rate,
the advertised rate and the proposed rate available for this
evenings hearing. Following discussion, Council Member
Luecke made a motion seconded by Council Member Voorde that
Bill #79-90 be recommended favorably to Council. The motion
passed.
The Committee then reviewed Bill #71-90 which would
appropriate money to defray expenses at the Century Center.
Katie Humphreys noted that no changes were recommended from
the Committee hearings. Katie Humphreys noted that the
balance as of June 30, 1990 in the cash reserve was
$385,234. Following discussion, Council Member Luecke made a

motion seconded by Council Member Coleman that Bill #71-90
be recommended favorably to Council. The motion passed.
There being no further business to come before the
Committee, the meeting was adjourned at 5:25PM.
