Committee was called to order by its Chair Person Council
Member Lee Slavinskas at 4:50 p.m. in the Council informal
meeting room.
Persons in attendance included Council Members: Duda,
Niezgodski, Puzzello, Luecke, Voorde, Zakrzewski, Coleman,
and Slavinskas; Isaah Jackson, Hedy Robinson, Bernard
Feeney, Don Porter, and Kathleen Cekanski-Farrand.
Council Member Slavinskas noted that the first item on the
agenda was to review Substitute Bill No. 120-89 which would
amend the zoning ordinance for property located near the
interesection of Ewing Avenue and Prairie Avenue.
Mr. Bernard Feeney represented the petitioner for the
property in question. He provided a topography map. He
noted that the petitioner is requesting a zoning change for
parcel 1 to "B" Residential and for parcel 2 of commercial
"A" Height and Area. The zoning would allow the development
of a multi-family duplex condominium with 34 living units
within it. He noted that a small strip center/office area
is also being proposed along Prairie Avenue. Mr. Feeney
stated that one party did appear at the Area Plan Commission
but there was no official remonstrance. He reminded the
committee members of the hearing held by this commitee when
the vacation request was before it in the fall of last year.
He stated that since that time, the petitioner has been in
contact with the City Engineering Department as well as with
the Rum Village Neighborhood Association. He stated that
the engineering department has eliminated many of the cul-
de-sac's and that all requests of the City Engineering
Department would be incorporated. Council Member Slavinskas
noted that the proposed rezoning request received a
favorable recommendation from the Area Plan Commission.
Council Member Zakrzewski stated that the developer did meet
with Rum Village and that he was present at that meeting.
He stated that several questions by the residents were
satisfied. He noted that he has long been concerned with
regard to the intersection of Prairie and Ewing and hoped
that the City would continue to monitor the situation for
ongoing safety concerns. He stated that he was particularly
concerned with regard to being on Warren Street and making
a left onto Ewing. It was noted that there would be an
approximate sight line of 300 or more feet.
Mr. Feeney also noted that he had met with the Home Owners
Association and that the petitioner has committed to remove
a mound of dirt which causes vision problems and has also

agreed that a billboard would be removed. Discussion has
also taken place with regard to an acceleration and de-
celeration lane on Ewing.
Council Member Luecke questioned whether in fact the area on
the southeast corner was .a wetlands. It was noted that it
was and that it would be used for storm water retention but
that such retention would not pollute the area. Mr. Feeney
stated that the petitioner would be in compliance with all
state and federal regulations with regard to the wetlands
area. Council Member Luecke also questioned the character
of the wooded area. Mr. Feeney noted that the developer has
represented that as much of the wooded area as possible
would remain except for the necessary removal associated
with roadways, utility easements, and the retention basin.
Council Member Niezgodski questioned the status of the trees
and the wetlands. Mr. Feeney stated that in some instances
islands within the retention basin may be left with trees
remaining thereon. Council Member Niezgodski stated that
during the cleaning process the root system of many of the
trees may be destroyed.
Council Member Duda stated that she had again visited the
area in question this afternoon. She also noted the
extremely dense tree growth and that topography. She
supported the ongoing concerns with regard to the safety of
the Ewing/Prairie intersection. She stated that it was her
understanding that all possible alternatives were being
looked at by the City Engineering Department.
Mr. Feeney stated that the petitioner intends to continue to
work with the neighborhoods so that the development would be
a positive addition to this neighborhood.
Following further discussion Council Member Coleman made a
motion seconded by Council Member Niezgodski that Substitute
Bill No. 120-89 be recommended favorable. The motion
passed.
There being no further business to come before the committee
the meeting was adjourned at 5: 10 p.m.
