At its March 22, 2022 meeting, the Board of Public Works awarded the above referenced
quotation to you in the amount of $145.00 (Unit Price, Per Truck, Per Hour).
Please forward the following documents in one submittal by April 12, 2022 to my
attention for Board of Public Works approval at lhensley@southbendin.gov :
1) One (1) signed original of the Contract (enclosed); and
2) Certificate of Insurance naming the City of South Bend as an additional insured.

SUBJECT: Contract Award – Trucks R Us (V-00001707)
Project No. 122-031 2022 Biosolids Trucking for Land Application Annual
Contract (PR-00015085)
DATE: March 18, 2022
On March 16, 2022 the Department of Public Works received Open Market Quotes for the
above project. The Division of Utilities, Division of Engineering, Office of Diversity and
Inclusion, and Legal Department reviewed the documents and finds the information correct and
complete. Trucks R Us submitted two separate quotation packages, one with only MBE and
one with MBE and WBE. The other four vendors that were invited to quote did not submit a
quotation.
The Bids ranked as follows:
Bidder Unit Price Bid “Per Truck Per Hour”
1. Trucks R Us (MBE = 10.00%; WBE = 0.00%) $145.00
2. Trucks R Us (MBE = 6.40%; WBE = 10.50%) $185.00
The Departments recommend Award of the contract for the 2022 Biosolids Trucking for Land
Application Annual Contract to the lowest responsive, responsible bidder, Trucks R Us at the
unit price bid of $145.00 per truck per hour. The total contract amount shall be issued as a not
to exceed contract per the 2022 Budget for Land Application.
We kindly request that the Board of Public Works consider the approval of the subject
contract at its Regular Meeting on March 22, 2022. Land application will begin in March if field
conditions are acceptable and schedules permit.
The MWBE Goal for the project was set at 16.9% per the Quote Specifications. Trucks R Us
has committed to a 10% MBE goal (per MWBE Form 1.0) and intends to employ Kennedy
Expressline, Inc. to provide MBE trucking to supply vehicles to haul biosolids. Kennedy
Expressline, Inc. assisted Trucks R Us during the 2019, 2020, 2021 Land Application contracts.
No WBE Trucking firms were identified in the selected quote as the price increase to involve
both WBE and MBE resulted in a $55.00 increase to the price, and the contractor has provided
a price that is in the best interest of the City of South Bend with respect to the cost for trucking.
A waiver will be required since the WBE goal will not be met on this project.
The Division of Utilities will appropriate sufficient funds from the Organic Resources,
Contractual Services Other Account (641-06-605-515-439001). For questions regarding the

Division of Engineering.

PUBLIC WORKS CONTRACT
This Agreement is made and entered into this 22nd Day of March, 2022, by and between Trucks
R Us, Inc., 23300 State Road 23, South Bend, IN 46614 (the “Contractor”), and the Board of
Public Works (the "Board”).
The Contractor covenants and agrees to make the following improvement, as fully set out in the
Request for Quotations, Standard Specifications, Special Provisions, Plans, and Bid Proposals, all
of which are set forth as a part of this Contract, for:

CONTRACT

AMOUNT: $145.00 UNIT PRICE, PER TRUCK, PER HOUR
FUNDING: PR-00015085
The unit prices for this improvement were those prices as received and accepted by the Board on
the 17th Day of March, 2022.
The Contractor further agrees to notify the assigned Engineer when this improvement is
completed. This notification shall be in the form of a Project Completion Affidavit, signed by the
Contractor. Upon final acceptance of the improvement by the Engineer, the Contractor’s final
estimate will be presented to the Board for final Payment with one (1) copy of the Project
Completion Affidavit and one (1) copy of a Waiver of Lien.
Each of the Parties, by signing below, represents and warrants to the other Party that he/she/it has
the authority to bind the named person or entity to this Agreement.
