STAFF REPORT CONCERNING APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS Date: March 14, 2022 Application Number: 2022-0225A Property Location: Riverside Drive Embankment Architectural Style/Date/Architect or Builder: N/A Property Owner: MULTIPLE Landmark or District Designation: Riverside Drive Local Historic District, #7469- 85 Rating: N/A DESCRIPTION OF STRUCTURE/ SITE: The Riverside Drive Local Historic district is characterized by its proximity to downtown South Bend and by its intimate relationship with the St. Joseph River. Parcels in the project’s immediate vicinity are owned by the property owners along the west side of Riverside Drive. ALTERATIONS: AA 2022-0225 allowed for the removal of trees in preparation of bank stabilization projects. APPLICATION ITEMS: “Please see attached letter.” “The City of South Bend is submitting two Certificate of Appropriateness (COA) forms for the Riverside Drive Bank Stabilization Project. The first COA is for initial tree removal of 8 trees from the bank before the Indiana Bat Roost Season beings. These initial trees have been identified as having bat habitat potential and will be removed before April 1, 2022 as required by the State of Indiana. The second COA is for the remainder of the bank stabilization work, which includes: additional tree clearing for access, Rock-Toe construction up to the ordinary high-water mark of the river, erosion control blanket installation, seeding, and shrubbery planting. The work will occur in late summer 2022.” DESCRIPTION OF PROPOSED PROJECT: The applicant has requested approval to: Stabilize the failing riverbank along Riverside Drive in the 1000 and 1100 blocks of Riverside Drive, including: • “Rock-toe” construction up to the ordinary high-water mark of the river, • “Erosion control blanket” installation, • Seeding and shrubbery planting. Erosion along the river embankment adjacent to Riverside Drive in this area has steadily increased, especially after the major flood events that our community experienced during the last four years. HPC staff documented the worsening condition in 2018. City of South Bend Engineering staff applied for financial assistance to remedy the failing river bank, resulting in the $800,000 project under review. The east side of Riverside Drive in this area is made up of individually owned parcels. The City has received approval from the property owners to access these parcels to execute this work. Approval and review from other city and regional entities has already been acquired. STANDARDS AND GUIDELINES: RIVERSIDE DRIVE I. THE ENVIRONMENT A. THE DISTRICT ENVIRONMENT The district is characterized by its proximity to downtown South Bend and by its intimate relationship with the St. Joseph River. The district encompasses the seven blocks of Riverside Drive which follow the river front from Lafayette Street to the east of Angela Boulevard to the west. For a portion of that route, there is a row of houses facing the river from across Riverside Drive, while in another portion, residences are situated on both sides of the street, with some properties abutting the river and others located across the drive. The district also includes homes located on Hudson and Golden Streets, between the drive and the alley defining the southern boundary of the district, as well as three separate park areas which lie adjacent to the river’s edge: a portion of Leeper Park to the East; all of Shetterly Park in the middle and a portion of Brownfield Part to the West. Required Distinctive existing features such as parks, gardens, streetlights, fences, signs, benches, walkways streets alleys and building setbacks shall be retained. New plant materials, fencing, walkways, streetlights, signs, and benches shall be compatible with the character of the neighborhood in size, scale, material and color. Street lighting should be maintained at levels recommended by the Illumination Engineering Society. Light sources must have spectral distribution in all color ranges. Sources and light posts should be uniform throughout the district. Lamp fixtures and supporting posts must be similar in proportion, scale and detail to existing historic lamps (see appendix) or a suitable replacement which closely duplicates the standard in size, shape, style, and appearance, i.e., Hedwig Lighting Company Standard or similar. Streetlights should be placed so that adequate illumination is afforded all sections of the public sidewalks. Tree and landscaping elements that must be removed for one reason to another shall be immediately replaced by suitable flora. The river front neighborhood character of the district shall be retained. Recommended Whenever possible, the original features should be restored. Plant materials and trees in close proximity to buildings, sidewalks, or streets that are causing deterioration to those elements should be removed. If erosion control efforts become necessary to preserve the riverbank, they should involve processes and materials consistent with the natural beauty of the banks. Large, deep-rooted trees and shrubs as well as fast spreading ground cover should be used when planting for erosion control. As much natural vegetation as possible should be preserved. If large shrubs become unsightly, they should be cut back and allowed to rejuvenate. Dead and diseased material should be selectively removed. Do not dump leaved and grass clippings on planted slopes as this practice will kill much of the low ground cover and leave soil more susceptible to erosion. When replacement od utility poles or power supply lines is necessary, consideration should be given to underground conduits or utility poles erected along rear property lines Prohibited Existing relationships of buildings and their environments shall not be destroyed through widening existing streets, application of asphalt or other bituminous coverings, or by introducing new streets or parking lots. Signs, streetlights, benches, major landscaping items, fencing, walkways and paving materials which are out of scale or inappropriate to the neighborhood may not be used. The introduction of heavy trucks or similar vehicles in the district shall be prohibited. SITE VISIT REPORT: HPC Staff have been monitoring and photographing the condition of the riverbank since 2018. Staff most recently visited this location in fall of 2021. REQUIRED DOCUMENTATION AND SITE PLANS The Historic Preservation Commission of South Bend and St. Joseph County cannot render judgment nor process an Application without specific documentation. Comprehensive documentation protects both the owner of the property submitting the Application as well as providing a complete understanding of the project for the commissioners and staff when rendering a decision. Problems often occur during a project review or during the execution of the project when one or both parties are unclear as to the specifics. Applications will NOT be processed without all required fees and documentation. When an Application has been scheduled for any meeting where a review and decision are to be rendered, the owner and any architect or contractor (s) retained for the project must attend such meetings. Failure by the owner, architect, or contractor to attend such meetings may result in denial of the Application due to insufficient representation. Documentation shall include: detailed written description of the project including materials to be used, scale, dimen- sions, construction methods, finishes, manufacturers’ brochures and specifications and photographs of the area(s) which the project will affect. Photographs may be submitted in digital format, or in photographic print. When a project involves blueprints and/or site plans, one (1) set shall be submitted with the Application. Any documentation submitted to this office cannot be returned to the applicant. INSPECTION AUTHORITY All projects will be inspected during and following execution, for compliance with the decision (s) rendered by the Historic Preservation Commission of South Bend and St. Joseph County. Owner acknowledges that while the Historic Preservation Commission only considers Certificates of Appropriateness for exterior features, under certain circumstances it may be necessary for the Commission Staff to have access to the interior of the building in order to accurately assess the condition of the exterior feature and that the lack of access to the interior may prevent the Commission Staff from making a favorable recommendation. Any work performed on a historic landmark or in an historic district which does not conform to the Certificate of Ap- propriateness certificate, shall be immediately halted by the Historic Preservation Commission and the Building De- partment of South Bend and St. Joseph County. The work will occur in late summer 2022. History The 45-foot-tall sandy riverbank between Vassar Avenue and Angela Boulevard along Riverside Drive has eroded more and more over the years. Since my first week on the job in April 2017 with the Engineering Department, I have worked to find funding to address the failing riverbank. The erosion occurs in public right-of-way and across portions of private properties that extend across the street east of Riverside Drive. Each year, the erosion worsens with more trees, roots intact, sliding down the bank into the river. This eroding bank not only damages water quality by introducing significant sediment and nutrient loads into the river but also has the potential for impacting public infrastructure and the adjacent public road, Riverside Drive. I, on behalf of the Engineering Department, have applied for Indiana Department of Natural Resources and Great Lakes Commission Grants to help offset the cost of the bank stabilization. Through 2018 to 2021, the City was awarded funding from these agencies to perform a feasibility analysis, geotechnical investigations, survey, design, construction plans and specifications, and construction for bank stabilization.(1) In coordination with these agencies, the City has hosted several public meetings at the Near Northwest Neighborhood center to engage the public and gain input and interest in the project.(2) Several residents and the District Council Member (at the time), Mr. Tim Scott, attended the meetings, were supportive of the project, and seemed excited for assistance in getting the bank stabilized. With assistance from the City’s legal team, we successfully acquired Right-of-Entry agreements from all landowners impacted by the work, see attached Exhibit A. Page | 2 Construction Schedule: The tree removal work for the bat habitat trees is anticipated to begin March 14th thru April 1st. The remainder of the work is expected to begin in August 2022 and the bank will be stabilized by Fall 2022. The City has received all other permits to perform the work. The City awarded the project to Milestone Contractors North, Inc. for over $800k (with $200k coming from the Great Lakes Commission and the remainder funded from the Stormwater Utility Fees paid for by City of South Bend constituents). Plans for the project are included in Exhibit B. This project will not only improve the water quality of St. Joseph River but will also provide a healthy wildlife and vegetative habitat, protect the property owner’s property from further deterioration, and provide stability and protection to the public infrastructure and roadway. Sloping or benching for excavations greater than twenty (20) feet shall be designed by aregistered professional engineer.6. CONTRACTOR shall confirm all earthwork quantities prior to the start of construction. If an excess orshortage of earth is encountered, CONTRACTOR shall confirm with the OWNER and ENGINEER therequirements for stockpiling, removal or importing of earth.7. All fill material shall be approved by the ENGINEER prior to placement.8. On-site excavated soils, except topsoil, may be considered suitable for fill provided proper moisturecontent is maintained during placement and subject to inspection and approval by the ENGINEER. Aportion of the excavated soils may exhibit natural moisture content above optimum moisture. These soilsmay require air-drying and/or chemical modification prior to placement.9. Topsoil is not suitable for use as fill material unless approved by ENGINEER.10.Uniformly grade areas to create a smooth surface to thecross-sections, lines, and elevations indicated on the drawings. Provide a smooth transition betweenexisting grades and new grades.11.Topsoil shall be placed in one loose lift in all areas where the underlying soils will not support vegetativegrowth. If adequate topsoil volumes are not available from on-site sources, CONTRACTOR shall amendavailable soil to produce a suitable growth medium or import topsoil from offsite. The final surface shallbe graded smooth to final design grades. All significant surface variations,including vehicle tire or equipment track ruts, shall be smoothed out with a grader box or other method.Final grading performed by dozers shall be done in a manner such that the track cleats are orientedparallel to the contours to minimize runoff velocity down the slope and to help maintain moisture in thetopsoil.DEMOLITION NOTES1. CONTRACTOR shall be responsible for the protection of all facilities during the entire period of service.Any damages to the existing facilities, roads, or other property caused by CONTRACTOR orSUBCONTRACTOR shall be repaired at CONTRACTOR'S expense and in a manner and scheduleapproved by OWNER.2. Items noted or otherwise identified to be salvaged (if any) shall be returned to OWNER in the originalcondition.3. Notify ENGINEER immediately upon the discovery of any hazardous materials.4.
