Persons in attendance included Council Members: Coleman, Duda, Voorde, Niezgodski, Puzzello, Slavinskas, Zakrzewski, and Luecke; Jack Mathews, Pat DeClercq, Don Porter, David Chapleau, Mike Danch, Don Ross, and Kathleen Cekanski- Farrand. Council Member Slavinskas noted that the first item on the I agenda was to discuss Bill No. 140-87 which would amend Chapter 21 of the Municipal Code entitled Zoning. He noted that the Zoning and Vacation Committee had met several times previous to this meeting to discuss the Bill in detail. Mr. David Chapleau was then called upon from the City Attorney's Office to briefly highlight the Bill. He noted that there were eight basic areas addressed in the Bill which now totals 100 pages. These included: reducing nonconforming uses, clarifying many of the definitions, including changes and clarifications within the various use districts, amending the height and area regulations and development standards, addressing off-street parking and loading regulations, addressing the powers and authorities of the Board of Zoning Appeals, addressing the veto power of the Mayor, and addressing annexation procedures with regard to "A" Use and "A" Height and Area regulations. Council Member Slavinskas noted that the Bill in the revised form received a favorable recommendation at the Area Plan Meeting of December 19th. Council Member Puzzello stated that the office designation is a concept which she would like the City to start working on in the very near future. Mr. Jack Mathews stated that such concepts would be addressed in Phase II of the revisions of the Zoning Ordinance. Both he and Mrs. DeClercq stated that they would be most interested in moving ahead on the next phase of the amendments. Council Member Slavinskas noted that the City of Elkhart and Elkhart County st should be considered with regard to the buffer type zones which they have and their office designations. Council Member Luecke also suggested changes with regard to annexation procedures with regard to zoning classification and height and area as well as concerns with regard to the BZA and non-conforming use changes. Zoning and Vacation Committee January 22, 1990 Page 2 Upon further discussion Council Member Coleman made a motion seconded by Council Member Luecke that Phase II of the zoning amendments be begun by the City. The motion passed. Upon further discussion Council Member Luecke made a motion seconded by Council Member Coleman that Substitute Bill No. 140-87 be recommended favorably to Council. The motion passed. The next item on the agenda was to review Bill No. 96-89 which would amend the zoning ordinance for property located at the east corner of Ireland Road and Miami Highway in the City of South Bend. Mr. Michael Danch noted that the Substitute Bill is being offered on behalf of Goodrich Quality Theatres. It would allow the Petitioner to build a fourteen (14) plex-theatre complex. He noted that BZA granted the reduction of parking spaces and that there would be screening along the east boundary added to the final site plan. He noted that the mall was built in 1972 and as a result of Mr. Johnson's request, the entire area would be kept within one site plan. Council Member Slavinskas stated that several of his constituents were concerned over parking. It was noted that if the area would be rezoned and the development take place that an additional 370 parking spaces would be added by this development. Upon questioning it was noted that construction is to begin in February with the theatres to be open in the fall. It was also noted that Scottsdale Mall would be actually building the theatre complex and then would be leasing it back to the petitioner. Drawings of the theatre complex were passed out to the committee to review. (copies attached) Upon further discussion Council Member Coleman made a motion seconded by Council Member Zakrzewski that Substitute Bill No. 96-89 be recommended favorably to Council. The motion passed. Council Member Slavinskas then noted that the next Bill on the agenda was to review Bill No. 97-89 which is a zoning ordinance for the property located at 2411 South Main Street. He also noted that this was a substitute Bill which received favorable action at the December 19th meeting of the Area Plan Commission. Mr. Don Ross of Cressy & Everett spoke on behalf of the Petitioner. He noted that the building in question is the old Kroger store. Clifford Hamilton & Son would be moving its operation into this location. It is a mechanical Zoning and Vacation Committee January 22, 1990 Page 3 operation which he believes would be a compliment to this part of the City. He stated that there is more than ample parking for this project and other possible projects in the future. Council Member Niezgodski stated that the current owners Mr. & Mrs. Medich plan to move their location into the Studebaker Corridor. Upon further discussion Council Member Niezgodski made a motion seconded by Council Member Luecke that Substitite Bill No. 97-89 be recommended favorably to Council. The motion passed. The next item on the agenda was to review Bill No. 116-89 which would vacate a portion of West Wayne right-of-way from Lot No. 288. Mr. Don Ross of Cressy & Everett spoke on behalf of the petitioner. He noted that the vacation was necessary in order for Ehninger Florist Shop located at 111 West Wayne to construct a greenhouse. He noted that the design review committee and the BZA both gave favorable recommendations to this development. Upon further discussion Council Member Coleman made a motion seconded by Council Member Zakrzewski that Bill No. 116-89 be recommended favorable to Council. The motion passed.
