The October 23, 1989 meeting of the Zoning and Vacation
Committee was called to order by its Vice Chair Person
Council Member Steve Luecke at 4:30 p.m. in the Council
informal meeting room.
Persons in attendance included Council Members: Luecke,
Duda, Voorde, Niezgodski, Puzzello, and Zakrzewski; Jenny
Pitts Manier, Bernard Feeney, John Hamilton, Margot Doyle,
Don Porter, and Kathleen Cekanski-Farrand.
Council Member Luecke noted that the first item on the
agenda was to review Bill No. 79-89 which would vacate
certain streets and alleys between Ewing Avenue and Prairie
Avenue. It was noted that this was a substitute Bill.
Mr. Feeney presented drawings and blueprints of the area in
question on behalf of Chauny Huei and Sara Laun the
developers of the subdivision. The area included between
70 to 75 acres which would have approximately 200 homes, and
mixed us development including condominiums, apartments, and
a small section of commercial development. This project is
commonly known as the Emerson Forest Subdivision proposed in
Portage Township.
Council Member Zakrzewski voiced concern with regard to the
intersection of Warren and Ewing Avenue. Several Council
Members voiced concern with regard to the safety concerns.
It was noted that the Area Plan Commission gave a unanimous
recommendation in favor of the vacation.
Mr. Feeney noted that the area in question has a rolling
terrain and is heavily wooded, with both items being used in
the marketing of the property.
The northeast corner has wetlands and the developer is
concerned about proper development of the right-of-ways for
sidewalks, utilities, etc. He noted that the developer
would be willing to have a joint meeting of the Rum Village
Neighborhood Association as well as the Council Members.
Mr. Feeney also noted that junk cars are currently being
stored to the east of the property.
Mr. Hamilton, the President of the Rum Village Neighborhood
Association stated that this type of development would be
appropriate since the neighborhood is concerned over
commercial development. If it is to be primarily
residential and if the developer took a positive stance with
regard to reforestation, he did not anticipate that the Rum
Village Neighborhood Association would be oppossed to it.

Margot Doyle stated that Mr. Feeney had been very
instrumental in resolving problems at the Crosscreek
Drainage Development.
Since a quorum of the committee was not present, no formal
action on Substitute Bill No. 79-89 was taken.
The meeting was adjourned at 5: 00 p.m.
