Persons in attendance included Council Members: Niezgodski, Slavinskas, Luecke, Coleman, Duda, Voorde, Puzzello, Soderberg, and Zakrzewski; Mr. Peter Nemeth, Mr. John Oxian, Mr. David Fritz, Mr. Bruce Zakrzewski, Mr. Imre Brassai, Mr. Edward Hardig, Mr. Richard Nussbaum, Kathy Allen, Mr. Hall, Mr. K. C. Posius, members of the news media, and Kathleen Cekanski - Farrand. The first item on the agenda was to review Bill No. 41 -89 which would rezone the property located at 2004 South Twyckenham. The petitioner noted that the location has had a dental office in it for over 30 years. At the July 18, 1989 meeting of the Area Plan Commission it received an unfavorable recommendation. The petitioner received a variance at the September 28, 1989 Board of Zoning Appeals meeting granting a 7 foot instead of a 10 foot requirement regarding set backs. It was noted that 6 cars would be taken off Twyckenham. Council Member Coleman updated the committee with regard to the Area Plan Committee meeting. He noted that the dentist in question is building a new building in the County and would be renting the current office to another dentist. Council Member Coleman stated that he believes that this particular operation is not consistent with the neighborhood and that it should be "A" Residential and not "B" Residential. Council Member Luecke noted that the structure is a home as oppossed to a more commercial type building. Following further discussion Council Member Luecke made a motion seconded by Council. Member Puzzello that Bill No. 41- 89 be recommended favorably. The motion passed by a 3 to 1 vote with Council Member Coleman in the minority. Council Member Slavinskas noted that Bill No. 53 -89 which would rezone the properties located at 1405, 1407, 1409, and 1413 West Western Avenue was continued in the Council portion at the last Common Council meeting. He noted that at the Area Plan meeting of August 15, 1989 that it came to the Common Council without recommendation. Zoning and Vacation Committee October 9, 1989 Page 2 The petitioner, Mr. Imre Brassai stated that there would be four apartments in the brick building, four apartments in the other major building, and three separate one family units. Council Member Luecke stated that he had concerns regarding parking, fencing, and the safety of children in this particular neighborhood. Council Member Duda questioned how many parking spaces would be available and was advised that there would be 18. Council Member Coleman spoke against the proposed rezoning. He stated that he is concerned that the improvement costs have dropped from a projected $300, 000 figure to $180, 000. He also voiced concern with regard to the types of buildings involved in that the area was not supported of a residential use in this particular area. Council Member Slavinskas noted that at the last committee meeting the committee gave this particular Bill an unfavorable recommendation. The committee then reviewed Bill No. 69-89 which would designate the property located at 618 North Leland an historic landmark. Mr. David Fritz, the owner of the structure, spoke in favor of the. Bill. It was noted that the structure is rated an 11. Mr. Oxian stated that there are approximately 110 landmarks throughout St. Joseph County with 55 being within the City limits. Council Member Coleman voiced concern over the qualifications of landmarks. Council Member Luecke spoke in favor of the proposed designation. Following further discussion Council Member Luecke made a motion seconded by Council Member Puzzello that Bill No. 69-89 be recommended favorably to Council. The motion passed. The committee then reviewed Bill No. 70-89 which would designate the property located at 607 North Leland an historic landmark. Mr. David Fritz, the owner of the structure, spoke in favor of the Bill. He noted that this structure is also rated an 11. Mr. Oxian spoke in favor of the proposed designation. Council Member Luecke commended the owner both with regard to this building and the prior building involved in the prior designation request. Following further discussion, Council Member Luecke made a motion seconded by Council Member Puzzello that Bill No. 70- 89 be recommended favorably to Council. The motion passed. Council Member Slavinskas noted that the petitioner for Bill No. 78-89 which would rezone Hepler Street was not present. Therefore the committee took no formal action on this Bill. .' C- r Zoning and Vacation Committee October 9, 1989 Page 3 The committee then reviewed Bill No. 86-89 which would vacate Nutek Drive. Peter Nemeth showed a map to the committee showing that it was an unimproved street that was dedicated. Mr. K. C. Posius spoke in favor of the proposed project. Following further discussion Council Member Puzzello made a motion seconded by Council Member Luecke that Bill No. 86-89 be recommended favorably to Council. The motion passed. The committee then reviewed Bill No. 87-89 which would vacate a public right-of-way along Western Avenue. Mr. Bruce Zakrzewski, the controller for Transpo, spoke in favor of the Bill. He stated that there was concern over security and safety in this area. He noted that the Board of Public Works recommended the Bill favorably at its last board meeting. Following discussion Council Member Coleman made a motion seconded by Council Member Soderberg that Bill No. 87-89 be recommended favorably to Council. The motion passed. The committee then reviewed Bill No. 88-89 which would vacate an alley off of Leland Avenue. Mr. David Fritz spoke in favor of the Bill . He noted concerns with regard to speeding and safety. The Board of Public Works recommended the Bill favorably at its last meeting. Following discussion, Council Member Luecke made a motion seconded by Council Member Puzzello that Bill No. 88-89 be recommended favorably to Council. Council Member Soderberg reminded the Common Council with regard to the problems of access to buildings and the creation of T-alleys. He noted specifically a similar request in the River Park neighborhood. He voiced concern with regard to emergency vehicles and trash trucks. Council Member Luecke and Council Member Coleman stated that the particular vacation request was distinguishable from that heard earlier this year by the Common Council in the River Park Area. The committee then reviewed Bill No. 61-89 which involved a rezoning request for property located on Ireland Road. Mr. Edward Hardig and Mr. Hall were available to present the Bill. He noted that the property involved totals approximately four acres. He noted that at the Area Plan Commission meeting of August 15, 1989 that it came to the Common Council without recommendation. He then showed an architectural rendering of the proposed site. It was noted that the property would be rezoned from "A" to "C" . Council Member Puzzello noted that a similar operation on Edison Road had been received favorably by the community. • 6' Zoning and Vacation Committee October 9, 1989 Page 4 Council Member Slavinskas noted that the main residential owner in the area is satisfied. Mr. Hardig noted that there would be propery insulation for all blowers, that there would be proper fencing, and that they were concerned about the needs of the area with having this type of use (laundromat, dry cleaner, car wash) blend into the neighborhood. Council Member Coleman gave a further update with regard to the Area Plan Commission Meeting. Council Member Niezgodski questioned the drainage situation, and was advised that the petitioner would be building their own retention basin. Following further discussion, Council Member Soderberg made a motion seconded by Council Member Puzzello that Bill No. .61-89 be recommended favorably to Council.
