ZONING AND VACATION COMMITTEE

The May 8, 1989 meeting of the Zoning and Vacation Committee
was called to order by its Chair Person Council Member Lee
Slavinskas at 4: 00 p.m. in the Council informal meeting
room.
Persons in attendance included Council Members: Luecke,
Zakrzewski, Niezgodski, Soderberg, Puzzello, Slavinskas,
Voorde, and Coleman; John Leszczynski, Richard Morgan,
Attorney, Bruce Metzger, Al DeFreese, James Wensits, Joseph
and Helen Jenowski, and Kathleen Cekanski-Farrand.
Council Member Slavinskas noted that the first item on the
agenda was to review Bill No. 17-89 which would amend the
zoning ordinance for the property located on the South side
of Wilson Street.
Mr. Richard Morgan, the Attorney for the Petitioner, then
reviewed the proposal entitled "Ashbury Park" . He
introduced Mr. Al DeFreese, the Architect for the
development. It was noted that there would be 12 units
ranging between 2100 to 2300 square feet beginning at
$175, 000. 00 per condominium. The developers are Garden
Homes. The units would front on Wilson Street. It was
noted that the property in question is the old Cole
Associates, Inc. property. A diagram of the proposed
condominium project was then presented to the Committee
(copy attached) .
Council Member Luecke questioned why the "C" designation was
necessary in height and area. Mr. Morgan noted that this
was necessary in order to forgo the side yard requirements.
He then showed the final site P lan to the Committee and
noted that the highest unit would be 28 feet.
Council Member Soderberg questioned screening and it was
noted that many of the mature trees would be saved and that
new trees would be planted for proper screening.
Council Member Coleman noted that there were 2 remonstrators
at the Area Plan Meeting who were concerned over the "C"
designation. He did, however, that the 28 foot requirement
was specifically noted in the final cite plan. The Area
Plan Commission gave this a favorable recommendation at its
meeting of April 18, 1989.
Following further discussion Council Member Soderberg made a
motion seconded by Council Member Co1,eman that Bill No. 17-
89 be recommended favorably to Council. The motion passed.

The Committee then reviewed Bill No. 30-89 which would
vacate the first East-West Alley South of Mishawaka Avenue.
Bruce Metzger, the Petitioner, then gave the presentation.
He provided a diagram and photographs of the area in
question as well as several handouts (copies attached) .
The overall purpose of the proposed vacation is to eliminate
traffic with regard to children, dust, standing water, and
mud. He noted that on April 15, 1989 between the hours of
7:30 a.m. to 9:30 p.m. there were 54 utilizing the area in
question.
Mr. Joseph Jenowski of 921 South Ironwood spoke in
opposition to the proposed vacation. He also showed a map
to the Council Members. He noted that the Fire Department
advised him that a minimum turning radius of 20 feet was
required. He noted that there have been several accidents
onto Ironwood and that if the vacation took place that oil
trucks, trash trucks, etc would have to back onto Ironwood.
Mrs. Helen Janowski of the same address stated that she has
been a resident of the area for 17 years and also spoke
against the proposed vacation.
Council Member Luecke questioned whether the Petitioner had
an agreement to share the alley with the neighbor which
would be concreted and was advised that it would be.
Council Member Niezgodski voiced concern over the amount of
trucks and the problems of ingress and egress.
The Council Attorney then read the letter from Bert Prawat
of the Fire Department which recommended against the
vacation (copy attached) and it was also noted that the
Board of Public Works recommended unfavorably at their
meeting of April 17, 1989 on this proposed vacation.
Council Member Puzzello had several questions with regard to
the turning radius. She then called John Leszczynski, the
City Engineer, to the meeting. He noted that the Board of
Public Works recommended against the vacation and
specifically noted that garbage trucks and graders could not
make the turn.
Following further discussion Council Member Luecke made a
motion seconded by Council Member Puzzello to recommend Bill
No. 30-89 unfavorably. The motion was defeated by a vote of
3 to 2 . Council Member Slavinskas made a motion seconded by
Zoning and' Vacation Committee Page 3
Council Member Coleman that Bill No. 30-89 be recommended
favorably to Council. The motion passed by a 3 to 2 vote.
There being no further business to come before the Committee
the meeting was adjourned at 4:50 p.m.
