HomeMy WebLinkAbout04-11-88 Zoning & Annexation OJ nmm port tip Common on e0 of tip ettg of F.►m*t( gnu): ZONING AND VACATION COMMITTEE The April 11, 1988 meeting of the Zoning and Vacation Committee was called to order by its Chairman Councilman Lee Slavinskas at 5:05 p.m. in the Council informal meeting room. Persons in attendance included Councilmen: Luecke, Niezgodski, Soderberg, Puzzello, Slavinskas, Coleman, Duda, and Voorde, Jim Wensits, Don Ross, Julie Curry, Doug Carpenter, Mark and Jessica Kaczmarek and Kathleen Cekanski- Farrand. Councilman Slavinskas noted that the purpose of the meeting was to review two Bill's on the agenda namely Bill No. 6-88 and 7-88. Councilman Slavinskas noted that there was a substitute version of Bill 6-88 which would rezone the property located at 1613 South Chapin from "A" Residential, "A" Height and Area to "B" Residential, "A" Height and Area. He further noted that the Area Plan Commission at its public hearing on February 15, gave a favorable recommendation to the proposed re-zoning. Mr. & Mrs. Mark Kaczmarek then briefly reviewed the purpose of the rezoning. They noted that the property was purchased by them at a Sheriff's sale. They wish to remodel the structure so that four apartments can be located within it. There would be ingress and egress from both an interior and exterior stairway. It was noted that the structure has been vacant for approximately five to six years and that it would take between four to six months to remodel. He further noted that there would be two two-bedroom apartments and two one-bedroom apartments. Mrs. Kaczmarek then read a formal statement to tfi4 Council and noted that blueprints of the facility would be provided at the caucus meeting. Councilman Coleman noted that the Council should look at whether the structure is capable of being a single family dwelling unit. He noted that he does not believe that it is and it was further noted that the structure had a commercial use on the first floor at some point in time. It was noted that since Councilman Zakrzewski, the District Councilman for the area was not present for the Committee meeting that the Committee may wish to defer action at this time. It was also noted that the staff report from the Area illP Plan noted that there is commercial property to the North and to the West with residential property on the two other sides. It was also noted that a letter in opposition from the Rum Village Neighborhood Association had been received as well as a petition against the proposed rezoning. Following further discussion Councilman Soderberg made a motion seconded by Councilman Coleman that Substitute Bill No. 6-88 be recommended without formal recommendation. The motion passed by a 3 to 1 vote with Councilman Luecke in the minority. The Committee then reviewed Bill No. 7-88 which is a proposed rezoning for the property located at 3628 Edison Road. Mr. Don Ross of Cressy & Everett represented the petitioner Doctor and Mrs. Lawrence Curry. They wish to zone the property from "A" Residential, "A" Height and Area and "B" Residential, "A" Height and Area, to "C" Commercial, "A" Height and Area. Mr. Ross showed a preliminary site replat had been proofed by the Replat Commission.to He noted that all of the property is zoned by Dr. Currey and that he plans to develop three buildings, to be used for medical development known as the Edison Road Clinic. it is hoped that construction of the buildings could take place at the same time that the Edison Road Project is under way. It was noted that the area in question and especially the intersection has had ongoing drainage problems as well as traffic problems. Councilman Slavinskas noted that the Bill had a public hearing before the Area Plan Commission on March 15, 1988 and received a favorable recommendation. Following further discussion Councilman Coleman made a motion seconded by Councilman Soderberg that Bill No. 7-88 be recommended favorably to Council. The motion passed. It was recommended again that a letter be sent to the Area Plan Commission requesting one preliminary site plan on each proposed rezoning so that the Zoning and Vacation can review it during their meetings.
