ZONING AND VACATION COMMITTEE
The May 9, 1988 meeting of the Zoning and Vacation Committee
was called to order by its Chairman Councilman Lee
Slavinskas at 4:30 p.m. in the Council informal meeting
room.
Persons in attendance included Councilmen: Luecke,
Niezgodski, Soderberg, Puzzello, Slavinskas, Zakrzewski,
Coleman, Duda, and Voorde; Bill Gates, Van Gates, Mike
Danch, Jim Wensits, Dick Maginot, Doug Carpenter, C. Brian
Sauers, and Kathleen Cekanski-Farrand.
Councilman Slavinskas noted that the first item on the
agenda was to review Bill No. 18-88 which would amend the
zoning ordinance for property located at the southeast
corner of Locust and Prairie Avenue.
Mr. Mike Danch of Pierce & Associates stated that he is
requesting a zoning change from "C" Commercial, A Height and
Area to "A" Residential. As a result of the request to
change to "A" Residential a specific site plan is not
required by City ordinance.
Councilman Zakrzewski noted that approximately two years ago
a public hearing was held before the Common Council with
regard to the property in question and at that time he
believed that it would not be developed as a commercial
entity.
Questions were raised whether the homes would be hooked up
to City sewer and water and the committee was advised that
they would be hooked up to City services at the developers
cost. It was also noted that there was substitute on file
with the City Clerk's Office for this particular Bill.
Following discussion, Councilman Soderberg made a motion
seconded by Councilman Coleman that Substitute Bill No. 18-
88 be recommended favorably to Council. The motion passed.
Councilman Slavinskas then noted that the second item to be
reviewed was Bill No. 26-88 which was a Bill to vacate the
first north/south alley west of Williams Street.

Mr. C. Brian Sauers, an Attorney with Barnes & Thornburg,
then presented a summary of Bill No. 26-88. He stated that
the petition to vacate was filed with the City Clerk's
Office on March 16, 1988 and that it is needed for Mr. Van
Gates to continue the renovation and expansion of his
automobile dealership in the downtown area. He noted that
both Mr. Van Gates as well as Mr. Bill Gates were present.
Councilman Niezgodski stated that he had talked with Mr.
Bill Gates regarding the I & M pole and was assured that it
would be moved.
The Council Attorney noted that certain conditions were set
forth by the Board of Public Works and their favorable
recommendation on this vacation. She stated that she would
recommend that if the Council would go forward, that the
Bill be amended subject to those conditions. She also
advised that she could have the amendatory language ready
for this evening's Council meeting. The proposed amendments
were acceptable to the petitioner and the petitioner advised
the Council that they would have a letter addressing the
cost of the relocation of the I & M pole.
Following further discussion, Councilman Soderberg made a
motion seconded by Councilman Coleman that Bill No. 26-88 as
to be amended by the Council Attorney be recommended
favorably to Council. The motion passed.
There being no further business to come before the committee
the meeting was adjourned at 4:45 p.m.
