Slavinskas at 3 :40 p.m. in the Council informal meeting room. Persons in attendance included Councilmen:. Zakrzewski, Luecke, Puzzello, Slavinskas, Coleman, and Duda; Doug Carpenter, citizen member, Attorney Joseph Amaral, Ann Mannix, Steve Henry, Dick Maginot, James Wensits, Mike Danch, Dave Behr, and Kathleen Cekanski-Farrand. The first item on the agenda to be reviewed was Bill No. 41- 88 which would rezone the property located at the southeast corner of Jackson and Ironwood roads. Mr. Mike Danch of Peirce &. Associates stated that the area will have 389 single family lots. The development would abut the Stonehedge subdivision. All of the drainage requirements would be met to City limits. There would be 4 entrances namely two on Ironwood Road and two on Jackson Road. The name of the subdivision would be Greystone Manor subdivision. The petitioner for the rezoning is "Relative Real Estate Management, Inc. " out of Bristol, Connecticut. Mr. Frederick R. Hains is the attorney for the petitioner. Mr. Danch noted that the lots would be over 7, 000 square feet and the homes to be built would range in price from $65, 000. 00 to $100,000. 00 plus. He further noted that the area in. question was annexed into the City on September 15, 1988. The committee then reviewed a preliminary site development plan of the proposed subdivision. Following favorable comments, Councilman Steve Luecke made a motion seconded by Councilman Coleman that Bill No. 41-88 be recommended favorably to Council. The motion passed. Council Member. Ann Puzzello then reviewed Bill No. 105-87 which would amend the zoning for a portion of the northeast neighborhood. It was noted that a substitute bill would be considered. Council Member Puzzello stated that the original bill was before the Area Plan Commission approximately one year ago and received considerable remonstrance. The area in question now is considerably smaller and received a favorable recommendation from the Area Plan Commission at its meeting of September 20, 1988. Zoning and Vacation Committee 10-10-88 Page 2 Ann Mannix of Neighborhood Housing Services stated that one of the intents of the ordinance is to encourage single family home ownership. She noted that the area in question had not been rezoned since World War II. It was further noted that no remonstrance was heard at the Area Plan Meeting. Councilman Slavinskas and Council Member Puzzello then voiced favorable comments with regard to the proposed rezoning. Council Member Puzzello noted that the City had appropriated a considerable amount of money into the area with regard to services, and building and that alot of improvements had been made in the last 4 to 5 years. Councilman Luecke stated that in the 1st District a similar rezoning had taken place several years ago and has been successful. He therefore would be supporting the proposed Bill. Following further comments, Councilman Coleman made a motion seconded by Councilman Luecke that Substitute Bill No. 105- 87 be recommended favorably to Council. The motion passed. The Committee then reviewed Bill No. 83-88 which would vacate the first north-south alley west of Frances Street and Bill No. 84-88 which would vacate the first east-west alley south of Colfax Street. Mr. Steve Henry represented the petitioner's on the these proposed Bills. He provided blueprints of the area in question. He noted that Bill No. 83-88 was being filed on behalf of Doctors Lawton and Stenger and Troeger, Garcia and Ansari. He further noted that the property owners for Bill No. 84-88 were the same named doctors. The proposed vacation would be to allow additional parking for the building of a medical building which would be primarily used to serve cancer patients. Council Member Puzzello voiced several concerns with regard to the proposed vacations. She stated that three conditions must be met namely to address ingress and egress to the garage on lot number 4, to address the installation of a guard rail on the fence, and to provide a requirement for 45 degree parking. Reference was then made to the board minutes of the Public Works Committee Meeting of October 3, 1988 where many of these issues were discussed. Zoning and Vacation Committee 10-10-88 Page 3 Councilman Luecke questioned the vacation procedures. The Council Attorney noted that a clear and consistent procedure must be established by the Council. In this particular situation both of the proposed vacations are being requested by the same individuals whereas the next vacation would have different ownership interest involved. The Council Attorney noted that both Bills could go forward this evening with proper amendatory language being incorporated in each. She further indicated that she would prepare such amendatory language for this evening's meeting (copy attached) . Following further discussion, Councilman Luecke made a motion seconded by Councilman Coleman that the proposed amended version of Bill No. 83-88 be recommended favorably to Council. The motion passed. Following further discussion, Councilman Luecke made a motion seconded by Councilman Coleman that the proposed amendatory version of Bill No. 84-88 be recommended favorably to Council. The motion passed. The Committee then reviewed Bill No. 85-88 which would vacate the north 212 feet of the first north-south alley east of Michigan and the east 165 feet of the first east- west alley north of Marion. Mr. Joseph Amaral represented the petitioners. He noted that the petitioners are Memorial Health Properties, Inc. and the City of South Bend for the use and benefit of the South Bend Economic Development Commission. He noted that currently there is an agreement that Memorial Health Properties, Inc. will become the overall purchaser and land owner through a lease purchase agreement. The Redevelopment Commission will be acting upon a proper resolution. He noted that the proposed vacation received a favorable recommendation from the Board of Public Works. He further noted that he had had several neighborhood meetings and that Councilmen Duda, Coleman, and Luecke had been in attendance in those meetings. He further stated that there was no known remonstrance at this time. Mr. Amaral further stated that the purpose of the vacation is to permit the construction of a daycare center which would be operated eventually by LaPetite. Councilman Luecke stated that the neighborhood had been very supportive and that he was personally supportive of the proposed vacation. Council Member Duda also gave supporting comments as well as Council Member Puzzello. Zoning and Vacation Committee 10-10-88 Page 4 Following further discussion, Council Member Puzzello made a motion seconded by Councilman Coleman that Bill No. 85-88 be recommended favorably to Council. The motion passed.
