Resolution No. 122
A RESOLIITION OF THE SOIITH BEND REDEVELOPMENT AIITHORITY
ACCEPTING THE TRANSFER OF REAL PROPERTY
' FROM THE SOIITH BEND REDEVELOPMENT CO1~Il~iISSION
WHEREAS, the City of South Bend, Department of
Redevelopment, ("Redevelopment") is the owner of the following
described real property situated in St. Joseph County, Indiana:
See attached Exhibit A
(collectively hereinafter referred to as the Real Property); and
WHEREAS, pursuant to I.C. 36-7-14-12.2, the South Bend
Redevelopment Commission (the "Commission") may dispose of real
property;. and
WHEREAS, the Commission, desires to transfer the Real
Property to the South Bend Redevelopment Authority (the
"Authority") for construction of improvements to the Morris
Civic Auditorium and Palais Royale Ballroom; and
• WHEREAS, the Authority, desires to acquire the Real
Property from the Commission; and
WHEREAS, pursuant to I.C. 36-1-11-8, the Commission may
exchange or transfer property with another governmental entity
upon terms and conditions agreed upon by the two (2) entities as
evidenced by the adoption of substantially identical resolutions
of each entity;-and
WHEREAS, the South Bend Redevelopment Commission,__at its
meeting of February 20, 1998, adopted its Resolution No. ,
approving the transfer of the Real Property to the South Bend
Redevelopment Authority.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION AS FOLLOWS:
1. That-the transfer of the Real Property situated in St.
Joseph County, Indiana, and generally described as follows:

by the South Bend Redevelopment Commission to the South Bend...
Redevelopment Authority shall be, and hereby is, accepted.
• 2. That the Director of Redevelopment for the City of
South Bend shall cause the recording of the quitclaim deed

• conveying all of the right, title and interest of the South Bend
Redevelopment Commission in and to the Real Property to the South
Bend Redevelopment Authority.
3. That this Resolution shall be in full force and effect
upon its adoption by the South Bend Redevelopment Authority.

EXHIBIT A
A parcel of land located in the West Half (W'/=) of the Northwest Quarter (NW%.) of Section Twelve
' ~ . ""(12), Township Thirty-Seven (37) North Range Two (02) East of the Second Principal Meridian, all
being located in Portage Township, City of South Bend, St. Joseph County, Indiana and being a part
of Lot No. 8 and Lot No. 9 of the Plat of the Original Town, now City of South Bend and being more
particularly described as follows:
Bcginning at the Northeast comer of said Lot 9 of the Plat of the Original Town, now City of South
Bend; thence south along the east line of Lot 9 and Lot 8 and also being along the west Line of a I4-.
feet wide, north/south alley lying midway between Main Street on the west and Michigan Street on
the east, a distance of 108 feet, thence west, parallel with the north line of said Lot No. 9, a distance
of 36 feet; thence north, parallel with and 36 feet west of the east line of said Lots 8 and 9, a distance
of 108 feet to a point on the north line of said Lot No. 9; thence east along the north line of said Lot
No. 9 and also being along the south line of a I4-feet wide east/west alley lying midway between
