ZONING AND VACATION COMMITTEE
The December 21, 1987 meeting of the Zoning and Vacation
Committee was called to order by its Chairman, Councilman
John Voorde, at 3:45pm in the Council's informal meeting
room.
Persons in attendance included Councilmen and Councilwoman:
Beck, Puzzello, Serge, Voorde, Barcome, Paszek, and
Zakrzewski; Doug Carpenter, citizen member, Ideal Baldoni,
Don Niezgodski, Kenneth Fedder, Jim Miller, Mr. Dennis
Hartman, Mr. Dick Maginot, Sean Coleman, Roberto Parisi, Jim
Wensits, Dave Behr, and Kathleen Cekanski-Farrand.
Councilman Voorde noted that the first item on the agenda
was to review bill no. 127-87 which would amend the zoning
ordinance for property located at 529 Crescent Avenue. He
noted that the Area Plan Meeting of December 15, 1987 it
received a favorable recommendation.
Mr. James Miller, the attorney for the petitioner, showed a
site plan of the area in question. He noted that it is the
former Morse Electric property. The petitioner wishes to
enlarge the facility to add additional storage for
equipment. The property will be entirely fenced and will
change the zoning from B to D. He also noted that there
were no remonstrators at the Area Plan meeting. He further
indicated that there be additional landscaping on the
portion which faces the residential area and that there is a
security gate to the property.
Following discussion, Councilman Serge made a motion
seconded by Councilwoman Puzzello that bill 127-87 be
recommended favorably to the Council. The motion passed.
Councilman Voorde then noted that the Committee was to
review bill no. 126-87 which would amend the zoning for the
property located at 1406/1412 South Bend Avenue.
Council Barcome, the sponsor of the ordinance, briefly
explained the bill. He noted that the Area Plan meeting
there were two people in opposition, namely, Councilwoman
Puzzello and Louis Seago. He further noted that the Area
Plan Commission gave a bill to the Council without
recommendation. He stated that there would be no bar in the
restaurant and that it would be a family oriented facility
entitled "Parisi's Restaurant. "
Mr. Ken Fedder, the attorney for Mr. Parisi, then showed a
drawing of the proposed restaurant and several pictures of
the current site. He stated that the current restaurant has
outgrown its present location and that the area in question

would never go residential. It is located next to the Sears
store and would have substantial screening.
Councilman Zakrzewski questioned how large the facility
would be and was informed that the tables would be increased
from thirteen to twenty thus allowing approximately 80
patrons.
Councilwoman Puzzello stated that she cannot recall where
the City Council would approve a C commercial zoning next to
A residential on both sides. She also voiced concern with
regard to traffic problems. She stated that there was
considerable back up on State Road 23. She indicated that
the families living on both sides have voiced opposition to
the proposed rezoning. She also noted concern with regard
to the fact that there would be no site plan since the bill
was sponsored by Councilman Barcome. She questioned whether
the rezoning could apply only to Mr. Parisi.
Mr. Doug Carpenter questioned the type of fencing that would
be used and was informed that it would be wood. He also
thought that a passing blister would help the traffic
concerns.
Councilman Barcome stated that the traffic all along 23 is a
problem. The operational hours would be from 4pm to 9pm
with the peak hours between 7pm and 9pm.
Councilman Serge noted that the condition of the two homes
which would be torn down for the proposed restaurant are in
terrible condition. Councilwoman Beck noted that she had
not received any calls against the proposed rezoning.
Following further discussion, Councilman Serge made a motion
seconded by Councilwoman Beck that bill no. 126-87 be
recommended favorably to the Council. The motion passed by
a 3-1 vote with Councilwoman Puzzello in the minority.
The Committee then reviewed bill no. 115-87 which would
vacate certain property located near Dinan Court. Mr. Dave
Behr of the Holladay Corporation spoke on behalf of the
petitioners. He noted that two alleys were involved and
that this was a joint project between the Holladay
Corporation and Memorial Health Properties.
Following discussion, Councilman Serge made a motion
seconded by Councilwoman Puzzello that bill no. 115-87 be
recommended favorably to the Council. The motion passed.
No further business came before the Committee. The meeting
was adjourned at 4:20pm.
