HomeMy WebLinkAbout10-12-87 Zoning & Vacation OlDnttmmtn &port ZONING AND VACATION COMMITTEE • 4 Ma tilt Comm Council of ills aliig of*twill ink The October 12 , 1987 meeting of the Zoning and Vacation Committee was called to order by its Chairman, Councilman John Voorde, at 4 : 30 p .m. in the Council informal meeting room. Persons in attendance included : Councilmen : Taylor, Paszek, Voorde , Puzzello , Barcome , Serge, Braboy, and Zakrzewski ; James Husband, Isaiah Jackson, T. Brooks Brademas, James Wensits , Doug Carpenter, and Kathleen: .Cekanski-Farrand. Councilman Voorde noted that the first item on the agenda was to review Bill No . 80-87 , which is a Zoning Ordinance for property located at 716 North Niles. He noted that there was a substitute bill on file with the City Clerk' s office. Councilman Serge made a motion seconded by Councilman Taylor, that the Committee review the substitute bill. The motion passed. The re-zoning would re-zone the area in question to A3 , to allow an eighty unit development , plus gate house. Mr. T. Brooks Brademas stated that the land in question is the old Morse Electric Company property. He showed pictures of the proposed suites with a gate house and pool area and a blue print of the proposed project. He noted that at the Area Plan meeting , that residents did raise con- cern whether properties along Corby Street would see the actual units. He noted that because of the terrain, that they would not . He also noted that he intends to keep all of the wooded area along the North and East perimeter as a natural boundary. Mr. Brademas noted that the units are intended for individuals who plan to have extended visits of one week or more. There would be ten buildings with eight units in each. Each would have a complete kitchen and there would be sixty, one bedroom units and twenty, two bedroom units. He also noted that there would be meeting rooms in the gate house which could facilitate up to two hundred (200) people. Mr. Doug Carpenter questioned where the parking would be for the people attending the meetings , and Mr. Brademas noted that it would be to the South of the project and it would require B . Z.A. approval. Councilman Braboy noted that the residents who were present for the hearing stated that it would be an asset to the neighborhood. Following further discussion by the Committee, Councilman Taylor made a motion, seconded by Councilman Serge, that substitute Bill No. 80-87 be recommended favorably with the condition that the pet- itioner maintain the wooded area along the North and East boundaries as a natural screening barrier. The motion passed. The committee then reviewed Bill No. 75-87 , which is a Zoning Ordin- ance for property located at 1314-22 West Washington Street. Mr. James Husband, the petitioner for Hoosier Lawn and Garden, gave the presentation. He noted that there currently is no off-street parking for the proposed facility. Pass Passe ►ummwima co. Zoning and Vacation Committee Minutes/October 12 , 1987 Page 2 Councilman Voorde noted that the Area Plan Commission gave an unfavorable recommendation based on the fact that the preliminary site plan had no off-street parking provided within it . It was the Area Plan Commission' s opinion that such a condition would cause traffic congestion on Washington Street. Councilman Serge noted that there was opposition to the project at the Area Plan meeting. Councilman Braboy noted, however, that there was no opposition to the minority owned business , but that there was opposition due to the fact that the "comprehensive plan" from the Redevelopment Department had not been completed. She noted that it has been started, however until there was a plan in place the Council would not have guidance as to what would be the best use of the property in question. Mr. Douglas Carpenter noted that under the current city code , the petitioner could operate so long as he would not have more than five (5) employees . This fact was confirmed by the Council Attorney who noted that this provision is located at Section 21-18 (a) (38) , which allows Manufacturing and Assembly with no more than five (5) operating employees. Mr. Husband noted that he had an option to purchase the property in question. Councilman Braboy noted that both sides of Washington Street are within the enterprise zone. Upon questioning by Councilman Voorde, the Council Attorney noted that if the petitioner would request a continuence of the bill, that the sixty day manditory provision of the municipal code would not take effect. In essence, what this provision provides, is that if the Common Council fails to take action on a re-zoning ordinance within sixty days of receipt from the area plan, that the area plan decision would become effective. However, if the petitioner would request a continuence, the sixty day period would be tolled . Mr. James Husband then requested that Bill No. 75-87 be continued indefinitely so that additional time could be given for the Com- prehensive Plan by the Redevelopment Commission. Councilman Serge made a motion, seconded by Councilman Taylor , to accept the request of Mr. Husband with regard to the continuence. The motion passed. Therebeing no further business to come before the Committee, the meeting was adjourned at 5 : 00 p .m. Respectfully submitted, Councilman, John Voorde, Chairman
