The July 13 , 1987 meeting of the Zoning and Vacation
Committee was called to order by its Chairman, Councilman John
Voorde, at 3:35 p.m. in the Council informal meeting room.
Persons in attendance included: Councilmen Puzzello, Paszek,
Voorde, Beck, Barcome , Braboy, Serge, Zakrzewski , and Taylor ;
Mr. John Schalliol, Mr. Brian Poland, Mr. Pat McGraw, Mr. Gordon
Johnson , Mr. Richard W. Kintzle, members of the news media, and
Kathleen Cekanski-Farrand.
Councilman Voorde noted that there were several items on the
agenda for the Committee to review.
The Committee then reviewed Bill No. 56-87 which was a bill
to vacate a forty (40) foot right of way of Lathrop Street. Mr.
John Schalliol , Director of the St. Joseph County Regional Airport
Authority , then gave a short presentation. He noted that the
vacation would allow the development of a first class entry way
for the developing aviation project. He noted that FAA funding
was involved. He further noted that the Airport Authority owned
the property on both sides of Lathrop.
Councilman John Voorde noted that the vacation would involve
approximately two thousand (2,000) feet. He also indicated that
the Board of Public Works recommended the vacation favorably at
their meeting of July 7 , 1987. This was based upon favorable
recommendations from the Engineering Department , Area Plan
Commission and Community Development.
Following further discussion by the Committee , Councilman
Serge made a motion, seconded by Councilman Beck, that Bill No.
56-87 receive a favorable recommendation. The motion passed .
The Committee then reviewed Bill No. 47-87 which was a bill
amending the zoning ordinance for the property located at the
southeast side of South Bend Avenue near Edison Road. It was
indicated that a substitute version of Bill No. 47-87 was to be
considered. Councilman Beck made a motion, seconded by Councilman
Serge, to accept the substituted version.
Mr . Kevin Butler , attorney on behalf of Mr . Patrick
McGraw/petitioner , noted that the project was for a condominium
development. Originally, one hundred ten (110) units were to be
developed; however, the number of units was reduced to one hundred
two ( 102 ) . The Area Plan Commission gave a favorable
recommendation on the proposed project. Councilman Ann Puzzello
noted that it was the best plan for that area. .

It was indicated that entrances would be from Edison and
State Road 23. The complex is to have a pool as well as a
clubhouse, and all units will have fireplaces. It was noted that
the structure is to be comparable to the Jamison Inn , another
project of Mr. McGraw' s , and would be wood-framed .
Following discussion, Councilman Puzzello made a motion,
seconded by Councilman Beck, that the substitute version of Bill
No . 47-87 be recommended favorably to Council . The motion passed .
The Committee then reviewed Bill No. 32-87 which was a bill
to amend the South Bend Municipal Code, Chapter 21 , Article 6.5 ,
entitled Historic Preservation Commission. Mr. Brian Poland, the
acting Director of the Historic Preservation Commission, then gave
a short presentation. He noted that the ordinance would allow the
local commission to review National Register nominations within
the South Bend area and would allow the Commission to set up a
procedure for such review.
Following discussion, Councilman Serge made a motion,
seconded by Councilman Puzzello , that Bill No. 32-87 receive a
favorable recommendation. The motion passed .
The Committee then reviewed Bill No. 16-87 which was a zoning
ordinance for the property located at the 200 block of South Logan
Street.
Mr. Gordon Johnson of Cressy & Everett indicated that there
were currently three (3) vacant lots on the site. It was also
indicated that the Area Plan Commission gave an unfavorable
recommendation to the petition. He indicated that surrounding
commercial uses include a Famous Recipe restaurant, a former Citgo
station, and a 7-11 . The primary concern was with regard to the
curb cut which has since been satisfactorily agreed upon between
the developer and the engineering department.
Mr. Johnson indicated that the proposed project would be a
self-service car wash and would not have the problem of stacking
of cars which other car washes would have. He showed the
Committee a revised drawing of the project. He also indicated
that a wood screen fence would be erected on the west side of the
development next to the alley and that the alley would be paved as
it is currently undeveloped .

Councilman Beck noted that she had not received any calls
with regard to this project. It was indicated, however, that one
( 1) remonstrator voicing concern with regard to lighting did
appear at the Area Plan Commission. Mr. Johnson indicated that
all lights would be shielded. He also indicated that the
operation would be a 24-hour operation such as the 7-11 .
It was also indicated that the staff of the Area Plan
Commission thought the overall project would be a good use for the
property.
Following further discussion, Councilman Beck made a motion,
seconded by Councilman Taylor, that substitute Bill No. 16-87
receive a favorable recommendation. The motion passed .
There being no further business to come before the
Committee, the meeting was adjourned at 4 :00 p.m.
