The May 11 , 1987 meeting of the Zoning and Vacation
Committee was called to order by its Chairman, Councilman John
Voorde, at 3:45 p.m. in the Council informal meeting room.
Persons in attendance included: Councilmen Puzzello, Serge,
Braboy, Voorde, Paszek, and Barcome; Ken Fedder, Ann Kolata, Rick
Morgan , Bob Dunbar , Chris Davey , Mrs. Mangus, Tony Davey, David
Chapleau, Norman Primus , and Kathleen Cekanski-Farrand,.
Councilman Voorde noted that the first item on the agenda
was to review the substitute version of Bill No. 21-87 which
would amend Chapter 21 of the zoning provisions addressing
exceptions in "C" commercial districts .
Ann Kolata noted that the bill would amend Section 21-117.05
and would address a procedure where there is a "C" commercial use
in existence on the first floor and where residential use is
requested on the second or third floors above. She noted that
this would require a procedure through the Board of Zoning
Appeals and that all individuals living within three hundred
(300) feet of the structure would be notified of the hearing .
This topic has been discussed for a considerable period of
time and is now being prompted by the sale of Max's Grocery
Store.
Following discussion by the Committee, Councilman Serge made
a motion , seconded by Councilman Puzzello , to recommend
Substitute Bill No. 21-87 favorably to Council. The motion
passed .
The Committee then reviewed Bill No. 25-87 which is a bill
to vacate certain property known as the first east-west alley
south of Mishawaka Avenue. Mr. Ken Fedder represented the
petitioner. He noted that two (2) new optometrists would be
coming to the city and that Area Plan gave a favorable
recommendation to the alley vacation as did the Board of Public
Works.
He noted that he would be amenable to an amendment
incorporating the two (2) conditions set forth by the Board of
Public Works, namely a deed of dedication and a cross easement.
The Council Attorney recommended that the conditions be
specifically addressed within the ordinance.
Following discussion , Councilman Serge made a motion ,
seconded by Councilman Puzzello, that Bill No. 25-87 (as amended
by the conditions) be recommended favorably to Council . The
motion passed unanimously.

The Committee then reviewed Bill No. 17-87 which was a bill
to amend the Zoning Ordinance for the property located at 4100 S.
Main Street in the City of South Bend. Mrs. Mangus was the
petitioner who briefly reviewed the project .
Following discussion by the Committee, Councilman Serge made
a motion, seconded by Councilman Puzzello, that Bill No. 17-87 be
recommended favorably to Council .
The Committee then reviewed Bill No. 24-87 which is a bill
to vacate all of High Street lying south of the south line of
Hawbaker , and also all of Bowen Street lying west of Miami
Street. Mr. Rick Morgan of the Barnes and Thornburg law firm
represented the developers of the proposed Erskine Plaza. He
noted that this would be a $9 million investment in the south
side of the City. He showed a preliminary drawing of the
proposed shopping center and noted that there were no
remonstraters at the Board of Public Works meeting .
Additionally, he noted that he had letters of support from the
property owners in the area. He also indicated that there would
be a signal on Ireland Road .
Following discussion, Councilman Serge made a motion,
seconded by Councilman Puzzello , that Bill No. 24-87 be
recommended favorably to Council . The motion passed unanimously.
There being no further business to come before the
Committee, the meeting was adjourned at 4:05 p.m.
