JONES, CITY CLERK REGULAR MEETING JANUARY 10, 2022 Be it remembered that the Common Council of the City of South Bend, Indiana, met in -person and via Microsoft Teams app on Mondgy, janugU, 10 2022 at 7:00 p.m. Council President Sharon L. McBride called the meeting to order. Pastor Norm Andrews of Grace Point Church gave the invocation. City Clerk Dawn M. Jones announced: Good evening, members of the public. Hamann made a motion that the minutes of the December 13, 2021. meeting of the Council be accepted and placed on file. Councilmember Canneth Lee seconded the motion, which carried by a voice vote of nine (9) ayes. SPECIAL BUSINESS There was no special business arising. REPORTS FROM CITY OFFICES There were no reports from city offices. RESOLVE INTO THE COMMITTEE OF THE WHOLE REGULAR MEETING JANUARY 10, 2022 At 7:04 p.in. Councilmember Troy Warner made a motion to resolve into the Committee of the Whole. Councilmember Sheila Niezgodski seconded the motion, which carried by a voice vote of nine (9) ayes. Councilmember Canneth Lee, Chairperson, presiding. Councilmember Canneth Lee explained the procedures for the meeting per Article 1, Section 2-11 of the South Bend Municipal Code. PUBLIC HEARINGS BILL NO. 142-21 PUBLIC HEARING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING A PETITION OF THE ADVISORY BOARD OF ZONING APPEALS FOR THE PROPERTY LOCATED AT 1165 S FRANKLIN STREET Councilmember Lori K. Hamann stated that Bill No. 142-21 was previously heard by the Zoning and Annexation Committee and comes forth with a favorable recommendation. Joseph Molnar, Zoning Specialist, with offices on the fourteenth (14th) floor of the County -City Building, presented Bill No. 142-21. Councilmember Troy Warner requested confirmation that the variance is to have a taller fence, from six (6) to ten (10) feet. Joseph Molnar responded that the Board has already approved the variances of Zoning Appeals. This is for a special exception to allow for the proposed use. Tim Sexton, 405 Main Building, Notre Dame University, stated that the petitioner worked closely with Community Investment members Angela Smith and Tim Corcoran in this process. Councilmember Henry Davis Jr. asked if manufacturing should proceed at a rate comparable to what was achieved in the past and if a manufacturing plant will even be seen in South Bend. Tim Sexton responded that it is hoped that companies will relocate to South Bend, given the quality of research being performed. This is an enhancement of what was done in the past. Councilmember Rachel Tomas Morgan requested a synopsis of the research to be undertaken. Dr. Joshua Cameron, 50558 Hollybrook Drive, Granger, Indiana, responded that the new equipment represents an expansion into two (2) new markets for the turbomachinery laboratory, hypersonics, and the energy sector, to produce energy more efficiently. Councilmember Sheila Niezgodski stated that this research is a wonderful opportunity for the community. Councilmember Troy Warner made a motion to send Bill No. 142-21 to the Full Council with a favorable recommendation. Councilmember Sheila Niezgodski seconded the motion, which carried by a voice vote of nine (9) ayes. RISE AND REPORT Councilmember Rachel Tomas Morgan made a motion to rise and report to the full Council. Councilmember Troy Warner seconded the motion, which carried by a voice vote of nine (9) ayes. REGULAR MEETING RECONVENED Be it remembered that the Common Council of the City of South Bend reconvened in the Council Chambers on the fourth floor of the County -City building at 7:20 p.m. President Sharon L. McBride presided with nine (9) members present. 2 REGULAR MEETING JANUARY 10. 2022 BILLS — THIRD READING BILL NO. 142-21 THIRD READING ON AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING A PETITION OF THE ADVISORY BOARD OF ZONING APPEALS FOR THE PROPERTY LOCATED AT 1165 S FRANKLIN STREET Councilmember Canneth Lee stated that Bill No. 142-21 came with a favorable recommendation with a nine (9) to zero (0) vote. Councilmember Sheila Niezgodski made a motion to call for passage of Bill No. 142-21. Councilmember Lori K. Hamann seconded the motion, which carried by a voice vote of nine (9) ayes. President Sharon L. McBride stated that Bill No. 142-21 has passed. RESOLUTIONS BILL NO. 22-01 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF SOUTH BEND, INDIANA, THE CITY OF MISHAWAKA, INDIANA, AND ST. JOSEPH COUNTY, INDIANA, FOR THE MUTUAL OPERATION OF THE SPECIAL. VICTIMS UNITS ADDRESSING CRIMES OF SPECIAL GRAVITY IN ST. JOSEPH COUNTY Councilmember Eli Wax stated that Bill No. 22-01 was previously heard by the Health and Public Safety Committee and comes forth with a favorable recommendation. Councilmember Troy Warner recused himself from the vote on Bill No. 22-01, as he took part in drafting the agreement and represents a party to the agreement, the County Sheriff & County Police Department Scott Ruszkowski, South Bend Chief of Police, 701 W Sample Street, presented Bill No. 22-01. Councilmember Eli Wax states that this resolution will allow the city to enter the proposed agreement. The agreement calls for South Bend Police Department (SBPD) to provide two (2) sworn, uniformed officers and funding for an additional three (3) deputized officers. Kylie Connell, 53167 Meadowgrass Lane, South Bend, Indiana, stated that she is excited for the inter -agencies to continue to work together. It is hoped that the resolution will impact the community. Councilmember Troy Warner stated that the family violence unit has been in place since 1967. He thanked those involved in these discussions to investigate the most serious crimes, whereby service agencies are on -site to support victims. Councilmembers Canneth Lee and Eli Wax thanked those involved in this resolution, as people must receive the social services they need. Councilmember Henry Davis Jr., stated that a metro police department should be part of the discussion, as the SBPD needs support. 3 REGULAR MEETING JANUARY 10, 2022 Councilmember Karen L. White made a motion to call for passage of Bill No. 22-01. Councilmember Rachel Tomas Morgan seconded the motion, which carried by a voice vote of eight (8) ayes. Councilmember Troy Warner abstained. President Sharon L. McBride stated that Bill No. 22-01 has passed. BILLS ON FIRST READING BILL NO. 22-01 FIRST READING ON AN ORDINANCE OF THE COMMON COUNCIL OF THIS: CITY OF SOUTH BEND, INDIANA, APPROPRIATING `I,WO MILLION FIVE HUNDRED THOUSAND DOLLARS ($2,500,000) FROM SOUTH BEND'S AMERICAN RESCUE PLAN (ARP) FUND (#263) FOR PREMIUM PAY FOR ELIGIBLE EMPLOYEES PERFORMING ESSENTIAL WORK, PURSUANT TO FEDERAL GUIDELINES UNDER THE AMERICAN RESCUE PLAN ACT Councilmember Sheila Niezgodski made a motion to send Bill No. 22-01 to the Personnel and Finance Committee for a public hearing and third reading on Janum 24 2022. Councilmember Troy Warner seconded the motion, which carried by a voice vote of nine (9) ayes. UNFINISHED BUSINESS President Sharon L. McBride stated that mailers would be sent out with information on water bills to get citizens more involved in the process. NEW BUSINESS President Sharon L. McBride stated that the Mayor's Office is planning a second (2nd) installment of the Meet the Mayor and Team of South Bend initiative for February 8, 2022, from 6:00 p.m. to 8:00 p.m. at O'Brien Center. Council will have a table at the event and must sign a conflict of interest statement to be returned to the Clerk's Office. Councilmember Sheila Niezgodski stated that she had filed her conflict of interest statement this afternoon. Councilmember Henry Davis Jr. asked when there would be an update on WNDU. President Sharon L. McBride responded that there is expected to be an update received tomorrow on January 11, 2022. Councilmember Henry Davis Jr., asked when discussion on the delinquency of water bills will commence. President Sharon L. McBride responded that Councilmember Henry Davis Jr. could lead this initiative at a future Council meeting if he wished. Councilmember Lori K. Hamann noted that the County is winding down its ARP program to help residents with delinquent rent payments. Residents should now file their applications through the auditor's office if they wish to apply. PRIVILEGE OF THE FLOOR No residents were waiting to speak under privilege of the floor. 4 REGULAR MEETING JANUARY 10.2022 ADJOURNMENT There being no further business to come before the Council, President Sharon L. McBride adjourned the meeting at 7:43 p.m.
