The August 18, 1986 meeting of the Zoning and Vacation Committee was
called to order by its chairman Councilman John Voorde at 4: 35 p.m. , in
the Council meeting room.
Jon Hunt, Director or Redevelopment, indicated Bill No. 83-86 was for the
vacation of an alley, next to the library. He indicated that
Redevelopment owned both sides of half of the alley and the library owns
the other half. Council Member Voorde indicated that the Board of Public
Works gave the alley a favorable recommendation. Council Member Serge
made a motion that this bill be recommended to the Council favorable,
seconded by Council Member Zakrzewski. The motion carried.
Carl Ellison, a representative of Memorial Hospital, indicated this alley
was next to the Memorial Health Facility, and the hospital intended to
build a parking lot and wanted this alley vacated. Bill VanZimms, 125
Marion, a representative of the management of the MarMain, indicated they
were close neighbors with the hospital and there concerned about this
vacation. He indicated this alley is used by MarMain residents and
vehicles who supply the apartments. He indicated the vacation of this
alley would be a real detriment to the residents of the apartments. Janet
Alley, 125 Marion, spoke in opposition to this alley closing. Ed Tally,
president of the Northwest Neighborhood Association, spoke against this
alley vacation. He indicated the two major hospitals in town were
gobbling up our neighborhoods. He asked on behalf of the neighborhood
association that this vacation be turned down. Paul Kronewitter, member
of the Northwest Nieghborhood board, spoke against this vacation. Council
Member Serge made a motion to Bill No. 84-86 received an unfavorable
recommendation, seconded by Council Member Beck. The motion carried.
Carl Ellison asked that the bill be stricken from the Agenda. Council
Member Beck made a motion that the committe recommend this bill stricken,
seconded by Council Member Puzzello. The motion carried.
Council Member Voorde indicated that Bill No. 89-86 had received a
favorable recommendation from the Board of Public Works. Jim Miller,
attorney representing Van Gates, indicated they were asking for the
vacation in order to further expand their storage area for some of the
vehicles Gates has in its inventory. He indicted they were trying to
recoup some of the space taken by the stadium. He indicated that K. C.
Pocius, has a legitimate concern, and Gates was not trying to harm the
property owners in the neighborhood. Council Member Beck indicated that
Gates needed a long term plan on their expansion. K. C. Pocius, 312 S.
Taylor, spoke agains the closing of this alley. He indicated that by
closing even a portion of this alley this would make access nearly
impossible, and by bringing the parking lot closer to the neighborhood it
will damage the property values. Jeff Gibney, representing the Northwest
Heritage Association, spoke against this vacation. Brian Cone,
representing Historic Preservation, spoke against this vacation. Virginia
Guthrie, representing St. Patrick' s parish, indicated the church was
concerned about the expansion of Gates. Tony Pocius, spoke agains this
vacation. She indicated she was concerned about the guard dogs and the
safety of the children in the neighborhood. Council Member Zakrzewski
made a motion that this bill receive an unfavorable recommendation for the
committee, seconded by Council Member Beck. The motion carried.
Kathrine Barnard, Director of Code Enforcement, indicated that Bill No.
67-86 proposes amendments to two sections of the Zoning Ordinance, which
are inconsistent. Council Member Serae made a motion to recommend this to
