Rules Committee July 17, 1986
The meeting convened at 4:50 p.m. Council Members Beck, Braboy, Puzzello,
Taylor and Voorde in attendance.
Kevin Butler, attorney for the Rules Committee, indicated that a complaint
had been filed with the Council and referred to the Rules Committee. He
indicated that the Rules Committee had commenced action relative to the
complaint. He indicated requests that Councilman Paszek resign and that
the Council demand his resignation. He indicated that the Rules Committee
does have jurisdiction over this matter.
Council Member Taylor made a motion that the meeting be continued and the
Rules Committee made a recommendation and hold the final meeting on this
topic on Monday, seconded by Council Member Voorde. The motion carried.
Council Member Taylor made a motion that the investigation conducted so
far are in fact adequate for us to make our determination and conclude
investigation on this topic, seconded by Council Member Voorde. The
motion carried.
Council Member Taylor made a motion to probable cause does exist and the
Rules Committee should continue with discussion concerning recommendations
for action, seconded by Council Member Puzzello. The motion carried.
Marva Leonard, attorney, indicated she was representing one of the
complaining parties and she made an objection to Mr. McFadden, Mr. Butler
and the Rules Committee discussion the issues without the complainant
being involved.
Council Member Taylor made a motion that the complaint filed by the NAACP
and the Urban League was properly filed with the Common Council, seconded
by Council Member Puzzello. The motion carried.
Council Member Taylor made a motion that the Rules Committee does have
jurisdiction to hear this complaint, seconded by Council Member Voorde.
The motion carried.
Council Member Puzzello made a motion, based on information heard today
and previous information, that Mr. Paszek did say the things printed in
the Tribune, seconded by Council Member Taylor. The motion carried.
Council Member Taylor made a motion that Council Member Paszek was not in
violation of Indiana Code, seconded by Council Member Puzzello. The
motion carried.
Council Member Taylor made a motion that Council Member Paszek was in fact
in violation of Section 2-10.1 (a) , seconded by Council Member Puzzello.
The motion carried.
Council Member Voorde made a motion that Council Member Paszek was in
violation of Section 1-8(o) of the Municipal Code, seconded by Council.
Member Braboy. The motion carried.
Council Member Voorde indicated he would recommend Council Member Paszek
be publicly censure.

Council Member Taylor and Council Member Beck indicated they would support
public censure.
Council Member Taylor made a motion that Council Member Paszek be publicly
censured for his comments made June 23 in a telephone interview, pursuant
to Section 2-10. 1 of the Municipal Code of the City of South Bend,
seconded by Council Member Voorde. The motion carried on a vote of 4 ayes
and one nay (Council Member Braboy) .
Council Member Taylor made a motion that the Council carry out this
censure at a public meeting to be held June 21 at 4:00 p.m. , in the
Council Chambers, after a confirming vote of at least five members of the
Common Council, at which Council Member Paszek will be required to be in
attendance, seconded by Council Member Voorde. The motion carried.
Council Member Taylor made a motion that the Rules Committee submit the
written report for consideration by the Council for 10:00 a.m. , July 18,
Council Member Voorde made a motion the report will be prepared by the
Chairman, Vice Chairman and Council attorney, noting the fact that there
will be a public censure and that will be submitted to the complainant and
the respondent, seconded by Council Member Taylor. The motion carried.
Council Member Taylor made a motion to adjourn, seconded by Council Member
Braboy. The motion carried and the meeting was adjourned at 6: 35 p.m.
