At its February 8, 2022 meeting, the Board of Public Works approved the above
referenced amendment for an additional two (2) year term commencing January 1, 2022 to
December 31, 2023 and modified rates in the amount of $1,027,972.50.

FIRST AMENDMENT TO AGREEMENT FOR SERVICES
This First Amendment to Agreement for Services (this “Amendment”) is entered into
as of _______________, __ 20__,between the City of South Bend, Indiana, and Republic
Services, Inc.(the “Contractor), each and party and collectively, the parties.
Recitals
A.On January 1, 2019, the parties entered into the Agreement whereby Contractor
agreed to provide the City disposal services at its Green Tech Transfer & Recycling Facility.
B.The parties desire to modify certain terms of that Agreement as set forth below.
Agreement
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of
which the parties acknowledge, the parties agree to the following terms and conditions:
1.Term. Pursuant to Section 3, TERM, the parties agree to extend the term for an
additional two-year term, commencing on January 1, 2022 (“Amendment Effective Date”)
and ending on December 31, 2023.
2.Rates. Exhibit A is modified as follows:
The rates for Optional Renewal Terms are deleted and replaced with the following:
Dates Per Ton Tipping Fee
January 1, 2022-December 31, 2022 $32.77
January 1, 2023-December 31, 2023 $33.43
3.All other terms of the Agreement remain as written.
