The May 12, 1986 meeting of the Zoning and Vacation Committee was
called to order by its chairman Councilman John Voorde at 4 :15 p.m. in
the Council informal meeting room.
Persons in attendance included Councilmen Serge, Braboy, Beck, Puzzello,
Zakrzewski, Barcome, Paszek,and Voorde; Doug Carpenter, Mr. John Hamilton,
Mr. T. Brooks Brademas, Mr. James Wensits, Mr. Dick Maginot, Mr. Bill
Peterson, and Kathleen Cekanski-Farrand.

Councilman Voorde noted that Bill No. 48-86 would not be heard by the
Committee in light of the fact that the Board of Public Works requested a
continuance in order to view the proposed area to be vacated. They would
have a recommendation to the Council for the next regular Council meeting.
The next item on the agenda was to review Bill .No. 25-86 which would
re-zone from "A" Residential A Height in Area to "E" Heavey Industrial A
Height in Area, and area of approximately acres along 4000 South Gertrude
in the Sixth District. Councilman Voorde noted that this was being sent to
the Council by the Area Plan without recommendation.
Mr. T. Brooks Brademas, the developer of the proposed asphalt hatching
plant, then .gave a presentation. He noted that petitions in opposition
which had been sent to each of the councilmembers contained signatures of
individuals who lived approximately five miles away.
He noted that the basic concerns involved odor, smoke, and noise
problems. Mr. Brademas stated that there would be no odor, smoke or noise
off the edges of the site. He stated that he had talked to the Health
Department today and that there were no instances of complaints of similar.
operations.
He noted that councilmen Paszek, Barcome, Voorde and Zakrzewski raised
concerns with regard to traffic. Mr. Brademas stated that none of his
trucks would go in a northerly direction and would never go on to Ewing.
He further mentioned that he would use tandem trucks of a 15 ton maximum.
Mr. Brademas then passed around for the Committee' s consideration the
St. Joseph County Land Use Maps for the area. He stated that was consistent
with the land use plan.
He also added that a firing range adjacent to the area in question
would be in place. He noted that 50 new jobs have already been created by
his Operation from May 20, -1985 through May 12, 1986 , seven of which were
minoritys. He then circulated a list of employees. _
He requested that the Common Council be reasonable in reviewing the
zoning petition. He further noted that he would guarantee 20 new job
opportunities and would earmark five for disadvantaged. He stated that the
batching operation would use five of the forty acres with the remaining part
being a buffer. He stated that future plans would develop the front part as
an industrial park but he believed that this would require both Area Plan

and Council approval.
Councilman Zakrzewski noted that he believed the competition was good
however he further believed that many small businesses are better than one
large business. He noted that in. his review of the petitions that 85%
of them were from City residents with the remaining 15% residing in the
County.
Councilman Zakrzewski stated that traffic remained a high concern
to him and that it would be difficult if not impossible to restrain traffic
on Gertrude and Ewing Street.
Councilman Puzae.11o_questioned the creation of' 20 jobs. It was noted
that four people would be on the site itself and that four crews would be
involved. . Mr. Peterson then reviewed the crew operation as proposed.
He noted that a similar plant was in existence in Washington, Indiana and
that some of the individuals from that location would come to South Bend
for set-up purposes. Councilman Puzzello also raised a question with regard
to mobility and she was advised that the operation would not be mobile.
It was further stated that Mr. Brademas would not be seeking tax abatement.
Councilman Braboy noted that many of the concerns brought to her
attention questioned on ingress and egress to the site location and
whether there would be extension costs to the City for the extension of
sewers and Water. Mr. Brademas stated that there would not be such a cost
involved.
Mr. John Hamilton stated that the situation was one of the
economically powerfully versus single family home owners. He did not believe
that junkyards would be allowed to expand in response to Council President
Beck' s question regarding zoning and location of single family homes.
Councilman Beck also noted that a new zoning law would take effect September
1 and read briefly from the law at I.C. , 36-7-4.-500. Mr. Hamilton noted
that the arguments involved go far beyond 300. feet adjacent to the proposed
site. He mentioned a culvert problem, the fact that the road is in poor
condition, as well as traffic concerns. Councilman Beck questioned whether
Mr. Hamilton was representing the remonstrators in the role of an attorney
and she was advised that he was serving as a volunteer.
Councilman Barcome raised concerns with regard to a letter he had
received with raised questions of smell and stains from various residues,
Mr. Brademas stated that he would address this and that it would not be a
problem..of his operation.
Following further discussion Councilman Zakrzewski made a motion
seconded by Councilman Puzzello that Substitute Bill No. 25-8.6 go to
Council unfavorably. A 2-2 vote resulted.
Councilman Beck then made a motion seconded by Councilman Serge that
the bill go to Council without recommendation. The motion passed 3 _to 1.

There being no further business to come before the Committee the
meeting was adjourned at 5 :05 p.m.
