ZONING AND VACATION COMMITTEE

The January 27 , 1986 meeting of the Zoning and Vacation
Committee was called to order by its Chairman , Councilman John
Voorde at 4 : 00 p .m. in the Council informal meeting room.
Persons in attendance included: Councilmen Beck, Puzzello,
Voorde, Zakrzewski, Paszek, and Braboy; Kevin Butler, Charles
Sausman, Jan Mellema, Kathleen Cekanski-Farrand and members of
the news media.
Councilman Voorde noted that the first item on the agenda
was to review Bill No. 177-85 which would annex property located
at 22901 Cleveland Road into the city limits. Mr. Kevin Butler,
in his representation of the petitioner, noted that the site in
question was the TransTech site on the new Cleveland Road and
that the property owners were asking for a voluntary annexation
into the City.
Mr. Butler noted that final action on the rezoning would
take place in February. It was further noted that the matters of
City water and sewer would be reassessed.
Following discussion by the Committee , the substitute
version of Bill 177-85 was recommended favorably by Councilman
Beck and seconded by Councilman Puzzello . The motion passed .
The Committee then reviewed Bill No. 1-86 which was a bill
to vacation certain property commonly known as the first east-
west alley north of Edison Road running west from the first
north-south alley west of Hickory for a distance of approximately
four hundred twenty (420) feet .
Mr. Kevin Butler who represented the petitioners noted that
all adjoining property owners were in favor of the proposed
vacation of that alley. He further noted that the Area Plan
Commission recommended the vacation favorably as did the Board of
Public Works. It was noted that the alley had never been used as
an alley per se .
Following discussion, Councilman Beck made a motion,
seconded by Councilman Puzzello, that Bill No. 1-86 go to Council
favorably . The motion passed .
The Committee then reviewed Bill No. 2-86 which was a bill
to vacate the property commonly known as a fourteen ( 14) foot
alley between Lots 25 , 26 , 27 , and 28 of Berner Grove First
Addition for the purpose of improving property with commercial
retain stores and a parking lot .

Mr. Chuck Sausman basically reviewed the petition. He noted
that the property is currenly vacant and that a twenty-four (24)
hour operation (commonly known as a 7- 11 store) would be
developed in the proposed area. He noted that there would be
attractive screening and that all deliveries would take place in
the front of the building. It was further noted that a setback
variance had been approved by the Board of Zoning Appeals and
that Mr. Panzica would handle all architectural renderings.
Councilman Paszek noted concern over the filling station aspect
of the proposed 7-11 development. Councilman Beck noted that no
remonstrators had contacted her. It was also noted that Area
Plan sent a favorable recommendation on the proposed project .
Following discussion by the Committee, Councilman Puzzello
made a motion, seconded by Councilman Beck, to recommend Bill No.
2-86 favorably to Council . The motion passed .
Councilman Voorde noted that there were no presenters
present at the Committee meeting for Bill No. 170-85 which was a
bill to vacate property commonly known as the first east-west
alley south of Delaware Street running east from Olive Street to
Phillipa. In light of that , no recommendation could be made by
the Committee .
The Committee then reviewed Bill No. 132-85 which was a bill
to vacate the property commonly known as the first north-south
alley west of Laurel Street running from Western Avenue to Napier
excepting the intersecting east-west fourteen (14) foot alley for
a distance of 243.56 feet , more or less , all being on Willets
Subdivision of B.O.L. 89 and Deardoff's Subdivision of B.O.L. 90
and lying between Lots 1 and 10 of Lots 6 and 15 respectively.
Councilman Beck spoke on the proposed bill . The Board of
Public Works made a favorable recommendation with regard to the
entire alley . It was noted , however , that if the legal
description would be amended, the ordinance would have to go back
to the Board of Public Works for a new review and recommendation
and be reported back to the Common Council.
Following discussion by the Committee, Councilman Beck made
a motion, seconded by Councilman Puzzello, that Bill No. 132-85
be continued until the February 24, 1986 meeting of the Common
Council . The motion passed.

Councilman Braboy stated that she believed it would be a
mistake to vacate the entire alley. It was also noted that a
letter should be sent from the Clerk's office with regard to the
proposed continuance so that the petitioner is aware of the new
hearing date.
There being no further business to come before the
Committee , the meeting was adjourned at 4 : 35 p.m.
