HomeMy WebLinkAbout04-24-84 Zoning & Vacation Alum tllrt rpurt • Oa hit Mammon Mound! atilt Mug of ecauth Nutt: ZONING AND VACATION COMMITTEE The April 24 , 1984 meeting of the Zoning and Vacation Committee was called to order by its Vice-Chairman Councilman Thomas Zakrzewski at 4: 45 p.m. in the Council Informal Meeting Room. Persons in attendance included Councilmen: Braboy, Puzzello, Paszek, Zakrzewski, Crone, Beck, Serge, _ and Taylor; Douglas Carpenter, Sheryl Bressler, Jim Wensits, John Leszczynski and Kathleen Cekanski-Farrand. Councilman Zakrzewski noted that he had called the meeting since Councilman Voorde would not be back in the City until this evening' s Council meeting. The Committee then discussed Bill No. 34-84 which would vacate an alley near Monroe Street. The petitioners include Dainty Maid Bake Shope, Hablin Company, Inc. and Jack Schmidt of Crescent Realty. It was noted .that the Board of Public Works gave a favorable recommendation to the alley vacation at its meeting of April 16 , 1984 subject to the City being provided the needed right of way to allow traffic to turn at the intersection of the T-alley created by this vacation and to any any all utility easements . Councilman Crone asked who enforces such conditions and was advised that they. should be made a part of the ordinance. The Council Attorney agreed to draft the necessary amendatory language to Section V of the Ordinance to make the ordinance effective after compliance with the conditions set forth by the Board. Following further discussion, Councilman Serge made a motion seconded by Councilman Puzzello that Bill No. 34-84 as amended be recommended favorably. to Council. The motion passed unanimously. The Committee then reviewed Bill No, 35-84 which would vacate approximately 390 feet of Butternut Road south of Lathrop.: St. ,The petitioner was the St. Joseph County Airport Authority. The vacation would allow all airport property to be contained within one fenceline. Mr. Leszczynski noted that the Board of Public Works gave a favorable recommendation with no conditions attached. Councilman Serge then made a motion seconded by Councilman Beck that Bill No 35-84 go to Council favorably. The motion passed unanimously The Committee then reviewed Bill No 36-84 which would vacate the first east-west alley north of Hastings Street which is in the Third District. The petitioners are residents of the area who desire the vacation to insure the safety of senior citizens and children in the area. It was noted that when the Ironwood Grand Trunk Railroad Crossing is, blocked a traffic hazard is created by drivers driving into the east end of the alley thinking they can continue north to Jefferson. Councilman Beck noted that all of the residents within the area had been contacted except for one individual who is presently in Florida. She also noted that a revised petition in favor of the vacation has also been prepared by the residents. Approximately five property holders have garages .affected by this alley and it was uncertain whether people north of the area would have, problems by the vacation. Mr. Leszczynski noted that the Board of Public Works sent the Bill to Council without recommendation. Following further ••l( ..f.. . .V•LLMIM. CO. Pale 2. Zoning and Vacation Committee discussion Councilman Puzzello made a motion seconded by Councilman Beck that Bill No. 36-84 be sent without recommendation to the Council. The motion passed unanimously. Bill 30-84 was then discussed by the Committee. This Bill would designate 1840 Kessler as an historic landmark within the City. It was noted that it received a favorable recommendation from the Area Plan Commission and had a 12 rating. Mr. Carpenter questioned whether the property owners are contacted regarding such designations, and was informed that typically they are in light of possible tax consequences and restrictions on exterior improvements. Following discussion Councilman Serge made a motion seconded by Councilman Puzzello that Bill No. 30-84 go to Council favorably. The motion passed unanimously. Bill No, 16-84 which would amend the zoning of a parcel on Bendix Drive was then discussed. It was noted that this Bill was continued at the last Council meeting in order to allow the petitioner to revise his final site plan in light of objections made by the residents in the area. Councilman Braboy passed out a statement which would be read into the record this evening by Mr. George H.Flake who is opposed to the re-zoning (copy attached) . She noted that she met with the residents last evening to review the revised site plan and noted that the residents are still not satisfied. They still believe that there is a safety problem, noise and air pollution problem, and a possible drainage problem resulting from the proposed four foot mound of dirt. She appealed to the Committee not to approve the re-zoning. Councilman Puzzello expressed concern that during the two week period between the last public hearing and tonight that the company had not met with the residents. Councilman Beck noted that she had telephoned Mr. Nimtz on Saturday regarding this situation. Mr. Carpenter noted that he had worked for Area .Plan for six years and that the staff of the Area Plan should be used more in lending their expertise to situations like this one. Following further discussion Councilman Beck made a motion seconded by Councilman Puzzello that Bill No. 16-84 be recommended unfavorably to Council. The motion passed unanimously. The Council Attorney then passed out a substitute version of Resolution 9C which would approve an amended scrap and junk yard license for Metal Resources Corporation and would waive the 1, 000 ft. requirement of Municipal Code Section 4-51. She noted that the substitute resolution had been prepared by the legal department. Councilman Zakrzewski stated that he had had a meeting with residents of Rum Village and had talked with their President. Their concern was that once a variance is made for one company that it would be made for all. He also noted that couple living closest to the project also was dis-satisfied and were to talk with Mr. Rifkin of the Company today. The Council Attorney stressec that requests of this type are reviewed on a case by case basis, which Council- man Zakrzewski noted that he had brought to Rum Villages attention. Page" 3. Zoning and Vacation Committee Councilman Crone noted that from her discussions it appeared that Rum Village was concerned about the long range effect of the variance but was not opposed to this company. Councilman Beck noted that most of Rum Village is zoned Industrial and that steps should be taken to change the zoning classification back to Residential. She noted that she had been in communication with Roger Baele who was interested in such a project. Mr. Carpenter agreed with Councilman Beck' s recommendation that the Area Plan Commission should prepare a land use plan for future development with proper separation between land uses. Councilman Beck noted that she had received letters from the Mayor of Fort Wayne and the City Council President of Fort Wayne which supported this company. The parent company has its office in Fort Wayne. She directed the Council Attorney to draft a letter to Mr. Johnson of the Area Plan Commission to begin acting on her zoning upgrading for the Rum Village area.
