The January 23, 1984 meeting of the Zoning and Vacation Committee
was called to order by its Chairman,- Councilman John Voorde at 5 : 15 p .m.
in the Council informal meeting room.
Persons in attendance included : Councilmen Taylor , Voorde , Brayboy,
Beck, Serge, Puzzello , Zakrzewski, Paszek, and Crone; Kevin Paulson,
Kathleen Cekanski-Farrand and members of the news media.
Councilman. Voorde updated the Committee on Bill No . 84-83 which
involves a proposed re-zoning of 1406 through 1412 South Bend Avenue for a
pizzeria. This bill received an unfavorable recommendation from the Area
Plan Commission. At the' request of the petitioner, Councilman Voorde suggested
that a motion to strike the bill would be in order. Councilman Serge made a
motion seconded by Councilman Beck that the Committee recommend that the bill
be struck from the agenda at this evening' s council meeting . The motion
passes unanimously.
Councilman Voorde noted that the next item for discussion by the
Committee was Bill No . 130-83 which involved a re-zoning of the property
located at 1017 South 21st. Councilman Voorde read excerpts • from the minutes
from the Area Plan meeting which noted that the proposed re-zoning from A to
B was recommended unfavorably to Council in light of the fact that. the
re-zoning of the River Park neighborhood to A • Residential was completed in 1980.
Thus the proposed re-zoning would be inconsistent. The Area Plan Commission
noted that there was a possibility to re-zone it to A-1 to allow a duplex
which would require structural renovation .
Mr . Kevin Paulson, the petitioner for the re-zoning then gave a
presentation. He noted that he presently rents to one boarder who is a
handicapped ::student at IP. He had a signed petition of all of the immediate
neighbors who were in favor of the proposed re-zoning . He noted that he was
not interested in an A-1 designation since he did not want to make the needed
structural changes required by that classification.
Councilman Voorde stated that he had had a meeting earlier this
afternoon with various members of the Area Plan staff and the City Attorney.
He noted that it was Mr. Hill ' s opinion that the petitioner could legally rent
to two or possibly three -individuals under the present zoning . The Council
Attorney agreed with this interpretation.
Following discussion by Committee members , Councilman Beck made a motion
seconded by Councilman Puzzello to recommend Bill No . 130-83 unfavorably to
Council . The motion carried. Councilman Voorde then inquired whether the
Committee would recommend an A-1 classification. There was no favorable
response.

The Council Attorney then recommended that since the petitioner was
aware of his options under the current zoning laws that a motion to strike
the bill from the agenda would be in order if the petitioner agreed. Mr .
Paulson agreed with this recommendation and Councilman Zakrzewski also
voiced his support . Councilman Beck then made a motion seconded by Councilman
Zakrzewski that at the request of the petitioner the Committee would recommend
that Bill No . 130-83 be struck from the agenda. The motion passed unanimously
and superseded the previous motion.
The Committee then reviewed Bill No . 123-83 which would re-zone the
property located at 1815 Ireland E. from A to B. This bill received a
favorable recommendation and the district councilman was in support of the
re-zoning. Councilman Serge then made a motion seconded by Councilman
Puzzello that Bill No . 123-83 be recommended favorably to Council. The motion
passed unanimously.
Councilman Voorde then read into the record a memorandum from
Gladys Muhammad dated January 11 , 1984 , regarding a parking lot located at
1106 S . 20th Street . (Copy attached)
There being no further business to come before the Committee the
meeting was adjourned at 5 : 40 p .m.
