,A RESOLUTION OF THE ST. JOSEPH COUNTY COUNCIL
DESIGNATING AN ESTABLISHING AN HISTORIC LAND-
MARK BY RESOLUTION AS REQUESTED
(12768 Dragoon Trail )
WHEREAS, the Historic Preservation Commission of South Bend
and St. Joseph County did on March 19, 1979, at its regular commis-
sion meeting, recommend that the structure commonly called the
"Cook School" and located on what is commonly called 12768 Dragoon
Trail , Mishawaka, St. Joseph County, Indiana, which structure
was erected in 1880, be declared as an historic landmark by re-
solution of the St. Joseph Count Council .

BE IT RESOLVED BY THE ST. JOSEPH COUNTY COUNCIL, INDIANA:
That this structure, built in 1880, and commonly known as
the "Cook School", located at 12768 Dragoon Trail , be declared an
historic landmark.

AN ORDINANCE RESCINDING ORDINANCE NUMBER 92-76, AND
RESCINDING THE DESIGNATION AND ESTABLISHMENT OF THE
REAL ESTATE LOCATED AT 52228 GUMWOOD ROAD, AND THE
IMPROVEMCNT_S LOCATED THEREUPON, AS AN HISTORIC L4 0ARK
WHEREAS, by its Ordinance Number 92-76, the St. Joseph County Council
heretofore designated and established the following described property as an
historic landmark , under Ordinance Number 154A-1973, as amended , to-wit :
29.4 ac. fronting Gumwood Road beg. 652.35 '
N of SW corner NW Sec. 22-38-3E
The historic landmark designation included improvements located upon such
property and commonly described as 52228 Gumwood Road; and,
WHEREAS, by reason of certain modifications made or to be made to
the residential structure located thereupon, the Historic Preservation
Commission of St. Joseph County, and the owner of such real estate, have
requested that the historic landmark designation of such residential
structure be rescinded; and,
WHEREAS, the modifications made or to be made to such residential
structure will change the architectural quality of such structure if this
is to continue as an historic landmark.
NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE ST. JOSEPH COUNTY COUNCIL, THAT:
SECTION 1 . Ordinance Number 92-76 is hereby rescinded.
SECTION 2. The designation of the real estate described as :
29.4 ac. fronting Gumwood Road beg. 652.35'
N of SW corner NW Sec. 22-38-3E;
commonly described as 52228 Gumwood Road, including all improvements located
thereupon, as an historic landmark, is hereby rescinded.
SECTION 3. This Ordinance shall be in full force and effect from
and after its passage and approval , as required by law.

AN ORDINANCE TO AMEND AND CLARIFY RESOLUTION R3-79,
THE SAME BEING A RESOLUTION DESIGNATING AND ESTABLISHING
AN HISTORIC LANDMARK (12768 Dragoon Trail - Penn Twp. )
WHEREAS, by its Resolution R3-79, the St . Joseph County
Council did establish a historic landmark for the structure
known as "Cook School" , located at 12768 Dragoon Trail; and
WHEREAS, property with such property address was at one
time platted as Lot #10 and Lot #11 within "Bradford' s Sub. "
at one time an Unrecorded Subdivision; and
WHEREAS, the property owner wishes to sell Lot 410,
which contains no structures) but is instead vacant land,
NOW, THEREFORE, BE IT ORDAINED BY THE ST. JOSEPH COUNTY
COUNCIL THAT:
Section 1 . Landmark status is herebv rescinded for Lot
10, located on the property once included together with
another lot assigned the address of 12768 Dragoon Trail,
within the Unrecorded Subdivision known as "Bradford' s Sub. "
in Penn Township.
Section 2 . The plat map for the subject property is
included herewith as "Exhibit All and incorporated by
reference .
Section 3 . Landmark status is retained for the
structure originally known as "Brown School" and located on
Lot #11 within said Unrecorded "Bradford ' s Sub. " in Penn
Townshin.
Section 4 . No provision of this ordinance may replace
proper subdivision and zoning as may be required in order to
develop Lot #10 .
Section S . This ordinance shall remain in effect from
and after its passage by the Council and approval by the
County Commissioners .
