Site Plan Description: The current site plan shows an addition added to the current business at 450 S. Carlisle to increase the size of the restaurant. The final design and size have not been determined. Zoning and Land Use History and Trends: The building of the current business dates to 1904, a similar beginning point for the surrounding neighborhood. Most of the homes and commercial structures date to the early 1900s when the area experienced large scale growth through growing manufacturing employment opportunities and incoming immigration. The neighborhood is dotted with a number of small scale restaurants and commercial establishments at corner properties zoned appropriately. Traffic and Transportation Considerations: Carlisle Street is a narrow two lane street with on-street parking. Agency Comments: There were no engineering comments at this time. Staff Comments: The proposed rezoning will allow for the expansion of an existing building and business in line with the traditional development of the surrounding urban neighborhood. The design of Ignition Park was developed under previous development standards that allowed the buildings to be placed with the rear of the building facing Franklin Street. This has created a style of development that has resulted in Franklin functioning more like an alley than a street. Analysis: The proposed Special Exception to allow for the expansion of a heavy industry use is consistent with the character of the district in which it is located. The site has been in operation for several years. The Special Exception will allow for the expansion of the current use and improve current operations, allowing the operations to remain in South Bend. The proposed variances will provide the appropriate space for the new tanks within the constraints of a limited site. The increased fence height is necessary for screening and security. While Franklin Street is technically the front, it serves as an industrial alley with the true front of the building facing west. A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA APPROVING AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF SOUTH BEND, INDIANA, THE CITY OF MISHAWAKA, INDIANA AND ST. JOSEPH COUNTY, INDIANA, FOR THE MUTUAL OPERATION OF THE SPECIAL VICTIMS UNITS ADDRESSING CRIMES OF SPECIAL GRAVITY IN ST. JOSEPH COUNTY WHEREAS, the City of South Bend, Indiana, through the South Bend Police Department ("SBPD") has a history of cooperating with the St. Joseph County Prosecutor in the investigation and prosecution of crime within the City of South Bend; and WHEREAS, St. Joseph County, Indiana, has created the Special Victims Unit ("SVU") that conducts criminal investigations of child abuse and sex crimes deemed to have high impact upon the safety and welfare of citizens of St. Joseph County, Indiana, and which further provides services to victims of certain crimes; and WHEREAS, the SVU presently combines the expertise of highly skilled and trained law enforcement officers from the St. Joseph County Police Department, the SBPD, and the Mishawaka Police Department, as well as the technical and support services of Indiana University South Bend and the Notre Dame Security Police Department, to among other things investigate, provide services to victims, gather and report data, and share information with the SBPD concerning crimes involving child abuse and sex crimes and other connected crimes in St. Joseph County; and WHEREAS, Indiana Code 36-1-7, the Interlocal Cooperation Act, authorizes one or more governmental entities to exercise, jointly or by one entity on behalf of others, powers that may be exercised by such units severally; and WHEREAS, the Indiana Cities of South Bend and Mishawaka, along with the County of St. Joseph share a combined interest in entering into an Interlocal Agreement so that by working cooperatively, they may efficiently and effectively investigate, provide services to victims, gather and report data, and share information concerning crimes of child abuse and sex crimes and other connected crimes in St. Joseph County. WHEREAS, pursuant to IC 36-1-7, the City will cooperatively assist the SVU operation by providing South Bend Police Department officers to serve as Investigators, by providing each of these Investigators with a vehicle and requisite equipment pursuant to the Interlocal Agreement, and by providing funds to pay for the cost and expenses of three additional Investigators of approximately $99,055 per officer annually, for an annual total of about $297,165. The Prosecutor of St. Joseph County will provide for the facilities needed for the SVU operations, and the cost of the SVU command staff, among other things; and WHEREAS, The City of South Bend, the City of Mishawaka, and St. Joseph County, Indiana, have entered into an Interlocal Agreement, a copy of which is attached hereto and incorporated herein as Exhibit A, containing all the governing provisions for South Bend's participation in the cooperative SVU crime investigation and service program; and WHEREAS, sufficient funds exist within the City's 2022 Budget to cover the City's costs of participation in the cooperative SVU crime investigation and service program during calendar year 2022. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. The Common Council of the City of South Bend, Indiana, has considered and hereby ratifies, confirms, and approves the Interlocal Agreement attached as Exhibit A to this Resolution, governing the City of South Bend Police Department's participation in the SVU crime investigation and service program in St. Joseph County, Indiana. Section II. The Mayor is authorized to execute the Interlocal Agreement in form and substance the same as or similar to that of the Agreement attached hereto as Exhibit A. Section III. This Resolution shall be in full force and effect retroactively as of January 1, 2022 from and after its adoption by the Common Council and approval by the Mayor. Sharon L. McBride, President South Bend Common Council City Clerk BILL NO. 01-22 Page 1 of 4 BILL NO. 01-22 ORDINANCE NO. __________________ AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING TWO MILLION FIVE HUNDRED THOUSAND DOLLARS ($2,500,000) FROM SOUTH BEND’S AMERICAN RESCUE PLAN (ARP) FUND (#263) FOR PREMIUM PAY FOR ELIGIBLE EMPLOYEES PERFORMING ESSENTIAL WORK, PURSUANT TO FEDERAL GUIDELINES UNDER THE AMERICAN RESCUE PLAN ACT _____________________________________________________________________________ STATEMENT OF PURPOSE AND INTENT _____________________________________________________________________________ The American Rescue Plan Act of 2021 (“ARP Act”) was established on March 11, 2021, to provide financial assistance to entities and industries affected by the COVID-19 pandemic (42 U.S.C. §§ 602 and 603). The U.S. Department of Treasury issued an Interim Final Rule (31 C.F.R. Part 35, Subpart A) effective May 21, 2021, governing use of such funds by local governments. Pursuant to Section 9901 of the ARP Act, funds were to be distributed to state and local governments to compensate for the adverse effects of the COVID-19 pandemic. Under the Interim Final Rule, an approved use of the ARP Act funds by local government is the payment of premium pay to eligible employees of the local government who performed essential work in mitigating or responding to the COVID-19 public health emergency. Under the Interim Final Rule, “[e]ssential work means work that: (1) [i]s not performed while teleworking from a residence; and (2) [i]nvolves: (i) [r]egular in-person interactions with patients, the public, or coworkers of the individual that is performing the work; or (ii) [r]egular physical handling of items that were handled by, or are to be handled by patients, the public, or coworkers of the individual that is performing the work.” (31 C.F.R. § 35.3) The Mayor of South Bend has identified the following City employees as eligible for premium pay under the ARP Act: 1) all members of the Fraternal Order of Police Lodge 36; 2) all members of the South Bend Firefighters Association Local No. 362 of the International Association of Firefighters AFL-CIO; 3) all members of Teamsters Local Union No. 364 Affiliated with the International Brotherhood of Teamsters of America; and 4) certain non-bargaining officers and employees of the City of South Bend who qualify for premium pay under the rules and regulations of the ARP Act. Page 2 of 4 On June 28, 2021, the Common Council of the City of South Bend, Indiana, passed Ordinance No. 10785-21, which created the American Rescue Plan Fund (#263) for the City of South Bend. Fund #263 is to be used “for the purpose of receiving federal assistance under the ARP Act and distributing those funds in accordance with the ARP Act and all other relevant federal and state guidelines.” (Section I of Ordinance No. 10785-21). In consideration of the requirements of the ARP Act and the Mayor’s designation of eligible employees, this ordinance appropriates Two Million Five Hundred Thousand Dollars ($2,500,000) from Fund #263 for the purpose of making one-time payments of premium pay to employees of the City of South Bend who performed essential work by providing critical services to protect the safety and welfare of South Bend’s citizens or who helped maintain continuity of operation of essential critical infrastructure during and after the shut-down of the City in 2020 due to the COVID-19 pandemic. These employees faced heightened risk to their own health and safety in the performance of essential services and are qualified by federal guidelines to receive premium pay under the eligibility standards of the ARP Act. This ordinance is in the best interest of the citizens of South Bend and in grateful acknowledgement of essential work performed by the City’s public safety, solid waste, and other City employees during the COVID 19 health pandemic. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana as follows: SECTION I. The recitals set forth in the Statement of Purpose and Intent of this ordinance are true and accurate and are incorporated herein by reference. SECTION II. Consistent with the most recent authoritative guidance issued by the United States Department of the Treasury or other applicable federal agency, the Administration and Finance Department shall make payments in the following manner: 1. The City of South Bend shall issue one-time premium pay up to the Maximum Amount (as defined below) for each eligible employee, subject to the following conditions: a. To be eligible for premium pay, an employee must (i) have been employed by the City at some time during the 15-month period from March 1, 2020, through May 31, 2021 (the “Qualification Period”), and (ii) have been employed by the City as of the date that premium pay under this Ordinance is issued, unless he or she died, or retired as recognized by the Public Employees’ Retirement System, after October 1, 2021; and b. The amount of premium pay to each eligible employee will be determined by the ratio of the number of whole or partial Page 3 of 4 months the employee worked for the City during the Qualification Period to the total number of months in the Qualification Period, multiplied by the Maximum Amount applicable to that employee. 2. “Maximum Amount” means: a. $2,500, for each sworn officer of the Fraternal Order of Police Lodge 36; b. $2,500, for each member of the South Bend Firefighters Association Local No. 362 of the International Association of Firefighters AFL-CIO; c. $2,000, for each member of Teamsters Local Union No. 364 affiliated with the International Brotherhood of Teamsters of America; or d. $2,000, for each of certain non-bargaining officers and employees of the City of South Bend who performed essential work as defined by the ARP Act and whose services were designated by the Mayor as having been critical to protect the health and well-being of the citizens of South Bend in response to the COVID-19 public health emergency. SECTION III. The sum of Two Million Five Hundred Thousand Dollars ($2,500,000) is appropriated from and set aside within the City’s American Rescue Plan Fund (#263) for the purpose of making the premium pay payments described in this ordinance. SECTION IV.
