The August 18, 1982 meeting of the Residential Neighborhoods Committee
was called to order at 6: 20 p .m. by its chairman Councilman Beverlie Beck.
Persons in attendance included: Councilmen Crone, Beck, Voorde,Harris ,
Szymkowiak, and McGann; Carolyn Pfotenhauer, Eli Miller, Delores Kovas ,
Paul Hooker, Kathleen Hooker, Joan Wagner, John Lanphere, George Divjack,
Roger Baele, Arthur Quigley, Marchmont Kovas , and Kathleen Cekanski-Farrand.
Councilman Beck stated that the purpose of the meeting was to continue
the review of the Noise Control Bill pending before the City Council . She
then called upon the Council Attorney who reviewed the bill section by section.
Carolyn Pfotenhauer also reviewed the bill and stated that its overall
purpose should be to establish an objective decibel standard to measure noises .
Councilman Beck then opened discussion and requested input from
the citizens present . Paul Hooker, a clinical audiologist, stated that all
sounds should be measured from a particular place. He explained such
measurements when dealing with stationary sources and vehicular.: sources . He
also suggested that the Council might want to consider different dBA levels
for different times of the day. He made further suggestions as far as
terminology for the bill.
Councilman Crone questioned what priority noise control was with
the City Administration. She noted that the vehicular noise ordinance which
was passed last year by the City Council was not being enforced on a regular
basis . She noted the lack of noise meters which also would affect enforcement.
She was concerned that during the process of reviewing the proposed budget
for next year, no department had included any line-item appropriation for
the purchase of any noise control meters . Councilman Crone concluded by
stating that unless the City Administration is willing to cooperate with
regards to enforcement, that passage of another law by the City Council may
be a futile attempt and a disservice to our citizens .
Mr. Quigley of the Northeast Neighborhood Council stated that he
believed the bill was a good one and hoped that the City would be able to
have enough meters so that one could be placed in each police substation.
Eli Miller of the Chamber of Commerce voiced concern over the
regulation of industrial noises . He stated that the City receives few if
any complaints about industrial areas and that such areas were governed by
OSHA regulations . It is his desire to retain jobs in this community and
that hopefully the good intentions of a noise control bill could be reduced
to one page.
Councilman McGann cited several examples where citizens may take
things into their own hands to deal with noisy parties . In light of the
unique position of the fourth district and its high concentration of college
students , he believed that such an ordinance was long overdue .
Mr. John Lanphere of Audio-Video Design Services also made several
suggestions and offered to work with the Council in proposed modification.

Following further discussion by the Committee, the Council Attorney
then made the following suggestion: That she would redraft the noise control
bill in light of tonight' s meeting and have a new bill ready for the
August 23rd Council meeting. She noted that Brad Garton of IACT would be
present at that Council meeting in his capacity as a noise coordinator for
the State of Indiana. She further stated that she would incorporate the
suggestion of different dBA levels for specific times of the day based on
zoning that industrial areas would be exempt until such time that regulations
made be warranted, and that technical changes regarding terminology would
also be incorporated.
Councilman Beck agreed with the suggestions of the Council Attorney
and recommended that any person interested in giving further assistance
contact her after the meeting.
There being no further business to come before the Committee, the
meeting was adjourned at 7: 50 p.m.
