HomeMy WebLinkAbout10-07-82 Committee of the Whole Olnmmtttrr rpnrt iIJn the mammon tlounrU of the elitg of'oath lino): COMMITTEE OF THE WHOLE The October 7, 1982 meeting of the Committee of the Whole was called to order by Councilman John Voorde at 4: 00 in the Council informal meeting room. Persons in attendance included: Councilmen Beck, Voorde, Crone, McGann, Szymkowiak, Zielinski, Taylor and Harris, John Peddycord, Carolyn Pfotenhauer, Eugenia Schwartz, Sherrie Petz, Katherine Barnard, Kathleen Cekanski-Farrand and members of the news media. Councilman Voorde noted the receipt of the October 6th memo from the Mayor stating that representatives from Crowe Chizek would be unavailable to give further explanation of the proposed office automation system, at today' s meeting. Councilman Voorde then noted that Kathy Barnard had requested .a few moments to update the Council on the enforcement of the Auto Service Center Ordinance. Mrs. Barnard then passed out a memo (attached) which showed that 42 applicants are in compliance with the ordinance, 21 applicants. would need to erect fences, 2 applicants do not comply with fire safety regulations, and 70 have not returned their applications. She also passed out pictures of various locations which would require fencing. Carolyn Pfotenhauer then passed out a letter indicating various areas of suggested changes to Ordinance No. 7058-82 dealing with automotive repair and service centers. (Attached) Mr. Peddycord, an attorney representing the Automotive Service :Cbuncil of Indiana and Mr. Robert Palmer were then called upon. Mr. Peddycord stated that he would prefer to work out a compromise rather than bring a lawsuit. He further indicated that he sees the City using licensing to deal with problems which are actually zoning and nuisance related. Mrs. Barnard stated that her department has learned alot over the past month and that the time was well spent. There are approximately 20-30 chronic problem areas which will have to be dealt with.. Several Councilmen asked questions with regards to the ordinance. The Council Attorney then suggested that she would meet with Mr. Peddycord and a representative of the City Attorney' s office. to disucss the alleged problem areas. She will then report back to the Council with an update. The Committee then turned to review Bill No. 76-82. A substitute verison of the Bill was passed out by Eugenia Schwartz. She highlighted the various changes that were made which were suggested at the last meeting of the Committee of the Whole. Councilman Crone suggested that committees or commissions serve at the pleasure of the appointing bodies. It was noted that the Area Plan Commiss• ion and the Older Adults Commission presently emcompasses such language, and that such language should be incorporated into the Energy Conversation Commissil and. the Traffic Commission. A considerable amount of disucssion followed, but there was an overall consensus to include such language. Mr. Schwartz was to check into the Civic Center Board of Managers, to see if such language could also be included there. Iw[[ /w[N alefr PURU•Miwo CO. Page 2. Committee of the Whole Councilman Voorde suggested that Section 2-1221, pertain to both leased and City owned motor vehicles. Councilman Voorde made motion. seconded by Councilman Crone that this Section be amended to include these vehicles and to exclude the Mayor' s vehicle and undercover vehicles as the only exceptions. The motion lost by a 3-4 vote. Councilman McGann made a motion seconded by Councilman Zielinski that Section 2-1.221. apply to leased and City owned vehicles with the followinc_ exceptions: vehicles used by the Mayor, City Attorney, City Engineer, City Controller and Economic Development Director, and those under I.C. 9-1-1-9; and that a seal of suitable size be placed on the car doors with the "City of South Bend"and"For Official Use Only"inscribed. The motion passed 5-2 with Councilman Voorde and Crone in the minority. The Councilmen then reviewed the Mayor' s letter of October 7th (attached) addressing the proposed Department of Code Enforcement. Several Councilmen had questions related to this department. Councilman Crone questioned how the Mayor could state that there would be "no additional cost to the taxpayers" when in fact new monies were needed. Mrs. Barnard stated that she would be working within the 1983 budget as passed, and would be submitting a transfer ordinance to reallocate the budgeted money so that the increase in salaries could be paid. The Council then discussed the concept of mayoral succession in such instances when the Mayor became incapicated and unable to carry out his duties, or when he was physically out of town such as when he is on vacation. Councilman McGann suggested that the Mayor file with the City Clerk a written document stating who would be the "acting Mayor".. Various other questions were raised by the Committee and discuss followed. It was suggested by Councilman Voorde that Mrs. Schwartz prepare the needed amendments so that they could be heard next Monday evening. The Council. then reviewed Bill No. 108-82. Mrs. Barnard suggested amending it by two separate ordinances addressing 1983 and 1983.. It was agreed that this would be the best route rather than amending it per her memo of October 7th.
