Personnel and Finance Committee
The September 29, 1980 meeting of the Personnel and Finance
Committee was called to order by its Chairman, Councilman Beverly
D. Crone, at 6 :00 p.m.
Persons in attendance included the following: Councilmen Crone,
Beck, Voorde, McGann, Serge, Szymkowiak, and Kopczynski; Citizen
Member Konnie Beasley; City Attorney Richard Hill; and Council
Attorney, Kathleen Cekanski-Farrand,
Chairman Crone announced that the purpose of the meeting was to
discuss Bill No. 106-80, a bill proposing the inclusion of a new
Article 17 in the Municipal Code entitled "Rates Charged for Public
Records and Fees Charged for Legal Advertisement., "
Chairman Crone then asked Councilman Voorde, the sponsor of
the Bill, to give some background behind it,
Councilman Voorde highlighted that he had initiated this Bill
at the request of the. City. Clerk' s office, He noted that funds are
presently running out-in the Clerk' s budget for such legal advertise-
ments. He suggested that a discussion on "the need" of such a bill
may be in order,
The Committee then reviewed Bill No 106--80 by section, Consi-
derable discussion took place on Section 2-205 which is entitled
"Rates Charged for Public Records "
City Attorney Richard Hill then gave an overview to the fee
structure presently being charged. He noted that the Engineering
Department, Board of Public Works, and Building Department are
presently charging for documents. - He stated that he was uncertain as
to the origin of charging for these documents , but would check into
the matter further,
Councilman McGann suggested delegating to the Board of Public
Works the role of setting charges for duplication of documents, and
certification of documents,
Discussion then took place on Section 2-206 entitled "Fees for
Legal Advertisement, " Councilman Voorde noted that the three areas
included, namely: Tax abatements, rezonings, and voluntary annexations ,
are all areas where the petitioners were receiving a benefit. The
Council Attorney and City Attorney then briefly reviewed the state
law pertaining to legal advertisements. A paper documenting the
legal advertisement costs in these three areas, was then circulated.
Following discussion, Councilman Voorde made a motion to strike
Section 2-205 as presently written and substitute a declaration of

authority to the Board of Public Works for the setting fees for
duplication, if this is necessary, He further recommended that Section
2-206 be retained with the deletion of sub-section (b) . Councilman
McGann seconded the motion. The motion was passed with Councilman
Voorde and McGann in favor, and Councilman Crone opposed.
Councilman Crone explained that she believed that the policies
for duplication fees and advertisement fees should be formalized.
However, until she received further legal authority on the topic,
that she saw no need for a city ordinance in the area. •
There being no further business to come before the committee,
the meeting was adjourned at 7 :00 p.m.
