The following Bonds were released: Linden avenue Pipe Sewer South Bend Avenue Brick Pavement Crescent avenue Pipe Sewer Bronson street Brick Pavement Staples & Ackerman C. H. Defrees Staples & Ackerman James Nelson Plat of Birner Place Addition filed and. approved. Plat of Huey Heights filed and approved. Engineer reported grade as follows: Anthony street; Poland street; Bertrand street; Meade street; Chapin street and Longle:l'avenue. Same approved. Engineer filed assessment rolls and final estimate for Brick Pavement on Bronson street from Michigan street to Marietta street; Water Connections on Main street from Jefferson street to urayne street; Water connections on Miami street from Vistula avenue to Bowman street. All under Improvement Resolutions Nos. 419, 457 & 456 respectively. Resolved, that notices as to the amounts of assessments be published for six consecutive days in the South Bend Daily Times. commencigg on the 7th day of August, 1907, stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the 20th day of August, 1907, at 7:15 P. M. Resolved further, that the entire wort under the above contracts be accepted and approved and the final estimate thereon allowed. Notice of this resolution shall be published on the 7th day of August, 1907, in the South Bend Daily Times, stating that this Board will give a hearing on the €cic{.ptance of such work at its office in the City Hall on the 20th day of August 1907, at 7:15 P.M. Resolved by the Board of Public Work5 of the City of South Bend, Indiana: That an improvement be made of the kind, Size, location and terminal points as follows: Brick Pavement and Grade, Curb & Walk on Park avenue from west line of Forest avenue to east lime of Leland avenue. _Said improvement shall be known and designated as "THE PARK AVENUE BRICK PAVEMENT AND GRADE CURB & WALK IMPROVEMENT" and shall be constructed according to the plans and specifications prepared by the City Civil Engineer, filed herewith. Notice of this resolution shall be published on the 7th day of August and on the 14th day of August, 1907, in the South Bence Daily Times. Said improvement shall be known and designated as "THE LONGLEY AVENUE GRADE CURB & WALK IMPROVEMENT"' and shall be constructed accordig to the plans and specifications prepared vy the City Civil Engineer filed herewith. Notice of this resolution shall be published on the 7th day of August and on the 14th day of August 1907, in the South Bend Daily Times. Hearing given on Condemnation Resolution No. 30, appropriating the following cescribed property: Olive street to be opened and extended for its full width of sixty (60) feet from the north right of way of the New Jersey, Indiana and Illinois Railroad to the south line of Sample street estended west, crossing and extending over the right of way of the New Jersey, Indiana, & Illinois R. R. The Grand Trunk Western Ry .and the Indiana, Illinois & Iowa Ry. (now called the C. I. & S. Ry.) tl Also opening and extending of Sample street westerly over and across the right of way of said railroads its full width of sixty-six (66) feet. Hearing given on Assessment Rolls and final estimates for Brick Pavement on West Jefferson street from Chapin street to Walnut street; Pipe Sewer on Rush street from Monroe street to South street; Pipe Sewer on Cherry street from Washington street to Jefferson street; Grade, Curb & Walk on Miller Court from Sample street to Osborne street; Grade, Curb & Walk on the west side of Ernsperger street from Vistula avenue to the alley north of Randolph street; Grade, Curb & Walk on Merry avenue from Grant street to'Washington street; Cement Walk & Curb on Marion Blvd from Navarre street to Bartlett street; Cement sidewalk on South side of Indiana avenue from High street to Dale avenue and Water Connections on Oak street from Scott street to LaPorte avenue. : All under Improvement Resolutions Nos. 417, 431, 4499 404, 402, 4241, 4262 409 & 452 respectively. In the matter of the Condemnation of a building at No. 805 W. Division street hearing on same was deferred until August 16th, 1907- at 10 A. M. All members present. The Board having under advisement a certain contract entered into with the Chicago, South Bend & Northern Indiana Railway Company on the 20th day of July, 1907, and having considered the same together with a special committee of the common council, it is held advisable to amend said contract to read as follows, to -wit: THIS AGREEMENT, made and entered into this 12th day of August, A. D. 1907, by and between the City of South Bend, Indiana by and through its Board of Public Works, hereinafter called the"City", party of the first part, and the Chicago, South Bend & Northern Indiana Railway Company, a corporation duly created and orgeAized under the laws of the State of Indiana, hereinafter called the"Railway Company; party of the second part, WITNESSETH:- That, consent, permission and authority are hereby given and granted by the City�� and vested in the Railway =Company, its successors and assign s to transport and operate the Winona Interurban Railway Company's interurbea, treet railroad cars and its own over and'V[Don the tracks of the Railway Gompan and to carry,passengerg Mail, express matter and other property therein, subject to and in conformity with all of the restrictions, limitations and conditions contained in Ordinance No. 696 adopted by the Common Council of the City of South Bend, Indiana the 19th day of January, 1995, and ordinances supplementary thereto, except as herein otherwise provided. The interurban passenger cars which shall hereafter be procured and used, shall be of the best style, modern'in construction and equipment, and kept well painted. Other interurban cars shall be of the same general style and character as`the express cars now in use by the Railway Company, or of such modern and improved style as may be in general use from time to time in other cities of the State, and not to exceed two of such cars in number in one train, shall be operated on said tracks, and no stLch,ears shall be loaded or un-loaded except at stations used by the Company for the storage of exptess and other matter. This contract shall be in full force and effect from and after its approval and confirmation by an Ordinance passed by the Common Council and approved by the Mayor of the City. IN WITNESS WHEREOF, the. City, party of the first part hereto, has hereunto caused its name to be signed by the members of the Board of Public Works of the City, and the Railway Company has caused its name to be hereunto set and its corporate seal affixed by S&ruel T. Hearing given on Vacation Resolution No. 48, vacating the following described property, wo-wit:-- - The alley between the south east corner of lot 128 and the south west corner of lot 128, both in Daniel Garst's First Addition of South Bend City, now a part of *hid City of South Bend, and extending north to the south line of lot 248 in said addition, and running thence east to -the west line extended of lot 250 in Daniel Garst's Re -Plat of lots 121 to 126,bnth inclusive, of his said First Addition to South Bend City(said alley from Tutt street to this point being fourteen (14) feet wide) and running thence south between lot 250 and lot 251 in said Re -Plat on the east and lot 127 in said First Addition on the west, to Tutt street. (said part of alley being twelve (12) feet wide). In the above matter no remonstrators appeared and no remonstrances were filed. The Board therefore declare the above described property in all things vacated. The property of the Studebaker Bros Mfg. Co. is benefitted in the amount of $50.00 No property is injuriously effected. The property of the Studebaker Bros. Mfg.. Co. in therefore assessed in the amount of 050.00. Now comes the Studebaker Bros. Mfg. Co and waives notice of assessment under Vacation Resolution No. 48, and pays into the Treasury of the City of Soubh Bend the sum of $50.00 The Board met in regular session at 10 A. M. All members present. Routine business only transacted.
