The Board met in regular session at 10 A. M. All members present.
Contractor Bond of C. C. Shively filed and approved.
The Engineer filed assessment roll and final estimate for Water connections
on Crescent avenue from Emerick.street to Hill street; Brick pavement on South Bend
avenue from Notre Dame street to Eddy street; Pipe Sewer on Miami street from.
St. Joseph River to Bowman street, under Improvement Resolution No. 435, 392
& 33S respectively.
Resolved that notices as to the amounts of assessments, be published for six
consecutive days in the South Bend Daily TIxes, commencing on the 5th day of June,
1907, stating that this Board will give a hearing on the amount of such assessments
at its office in the City Hall on the 18th day of June, 1907, at 7:15 P. M.
Resolved further, that the entire work under the above contract be accepted and
approved and the final estimate thereon allowed. Notice of this resolution shall be
published on the 5th day of June, 1907, in the South Bend Daily Times, stating that
this Board v4d ll give & hearing on the acceptance of such work at its office in the
City Hall on the lFth bay of June, 1907, at 7:15 P: M.
Contracts were signed with W. FI. Burke & Co'for Water Connections on
East Bronson street; DeMaude avenue from Woodward avenue to Portage avenue;
Michigan avenue from alley west of Johnson street to Olive street; California
street from Woodward avenue to DeMaude avenue and Washingtnn street from Mill
street to the West Race.
Hearing on LaPorte avenue Asphalt Pavement from Washington street to
Colfax avenue, deferred until September 3rd, 1907, at 10 i,,, M.
Hearing on Condemnation Resolution No.'29 for the opening of Blaine avenue
deferred until Friday June 7th, 1907, at 10 A. M.
Contract signed With Thos. Williams for Water connections on Oak street
iron Scott street to LaPorte avenue; Chas Coussens & Co for Sewer Connections on
Oak street from, Scott street to LaPorte avenue; and East Washington street from
Mill street to hest Race.
Bids were opened for Brick Pavement on East Washington street from
Mill street to the West Race. C. H. Defrees being the lowest and best bidder
the contract was awarded to him for said work. Barr Block to be used.
Bonds of C. H. Defrees were filed and approved and Contracts were signed for
Brick Pavement on Alley South of Division street. No..l & No. 2; Cherry street;
Oak street; California street and DeMaude avenue. `
Bond of Chas Coussens & Co filed and approved and Contract signed for
Cherry street Pipe Sewer.

VACATION RESOLUTION NO. 46.
Resolved By the Board of Public Works of the City of South Bend, Indiana: That it is
desirable to vacate the fs=_lowing:
A strip of land two feet in width off of and along the South side of the alley
adjadekt,lto and on the north oflot 63 in the 3rd Plat of Shetterly Place and extending
from the northwest corner of lot 63 east a distance of 103 1/2 feet.
The following property may be injuriously or beneficially effected by such vacation.
Lot 63 3rd Plat of Shetterly Place owned by Frank H. & Flora M. Goodman
Lot 64 3rd Plat-. of Shetterly Place owned by Ryell T. F- Annie P. Miller and J. L. M. &

street from Hudson avenue to Leland avenue; Sewer & Water connections on Jefferson
street from Chapin street to Walnut street, All under Improvement Resolutions Nos. 371,
451, 433 respectively
No remonstrators appeared and no remonstrances were filed. The Board therefore
find that the property assessed in said roils filed May 24th, 1907$ is benefitted in
the amount of assessments as shown on said rolls and the Board further find that the
assessment roll filed May 24th, 1907, and the final estimate allowed May 24th2 19072
should be and the same is hereby in all things ratified, confirmed and approved

Contract entered into with the Chicago, Lake Shore & South Bend Railway Co
for an extension of time to July lst, 1905, on their franchise to build an
Interurban Railway into the City of South Bend. The same was referred to the
Common Council for its action and consideration thereon.

No remonstrators appeared and no remonstrances were filed. The Board therefore find
that the property assessed in said rolls filed June 4th, 19072 is benefitted in the amount
of assessments as shoe on said rolls, and the Board further find that the assessment
roll filed June 4th, 1907, and the final estimate allowed June 4th, 1907, should be and
the same is hereby in all things ratified, confirmed and approved.
Hearing given.on Vacation Resolution No. 46, vacating the following described
property:
A strip of land two feet in w idth off of and along the south side of the alley
adjacent to and on the north of' lot 63 in the 3rd Plat of Shetterly Place and extending from

damages under Condemnation Resolution No. 27, adopted on 5th day of February, 1907,
which said roll of awards and damages was adopted on the 26th day of April, 1907,
and the Board having-; considered the various remonstrances filed herein it. is
considered and adjudged that the various tracts of real estate nemed in said roll
are respectively benefi tted and damaged in the amounts set out in said roll and
the said remonstrances filed herein are accordingly overruled and said roll of
