ORDINANCE NO. 77/95/-g'4 AN ORDINANCE CLOSING THE RAILROAD RELOCATION AND RECONSTRUCTION FUND AND TRANSFERRING THE UNUSED AND UNENCUMBERED BALANCE OF $85,337.42 TO THE GENERAL FUND OF THE CITY OF SOUTH BEND AND APPRO- PRIATING SAID FUNDS TO ACCOUNT 399.0, OTHER CON- TRACTUALS, TO BE ADMINISTERED BY THE DEPARTMENT OF ADMINISTRATION AND FINANCE. STATEMENT OF PURPOSE AND INTENT: A Railroad Relocation and Reconstruction Fund was created by Ordinance No. 7108-82 in order to pay the City's portion of the total cost of grade separation improvement pursuant to I.C. 8-6-2.1 and tax monies remaining in the then existing Track Elevation Fund were transferred into the newly created fund. The purposes for which the Railroad Relocation and Reconstruction Fund was created have been fulfilled and the Council now desires to close said fund and to transfer the unused and unencumbered balance of said tax monies to the General Fund of the City of South Bend, pursuant to its authority under I.C. 36-1-8-5 and to appropriate same for improvements, equipment and for the payment of such other fees and expenses attributable to the operation of a professional baseball team at the Stanley Coveleski Regional Stadium. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS: SECTION I. That the sum of $85,337.42, being the amount of tax monies remaining in the Railroad Relocation and Reconstruction Fund, is hereby transferred from said fund to the General Fund of the City of South Bend, Indiana. SECTION II. That the Railroad Relocation and Reconstruction Fund created by Ordinance No. 7108-82 be closed and that Section 2-164 of the Municipal Code of South Bend, Indiana, entitled Railroad Relocation and Reconstruction Fund be deleted in its entirety. SECTION III. That the sum of $85,337.42 is hereby appropriated for the year 1986 from the General Fund and shall be administered by the Department of Administration and Finance and distributed as set forth below: 0399. 0 Other Contractuals $85,337.42 SECTION IV. This Ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. South Bend, IN 46601 Dear President Beck: The enclosed ordinance is being filed for first reading at the October 27, 1986 Council meeting. The ordinance proposes to transfer $85 ,337. 42 from the Railroad Relocation and Reconstruction Fund to the General Fund of the City of South Bend and then appropriates those funds to contractual services within the Department of Administration and Finance. Under I .C. Code 36-1-8-5 a municipality may transfer the surplus balance of a fund for which the purpose it was created for has been completed. Those remaining funds under the statute must be transferred to the General Fund of that municipality. I am asking that the above named fund be closed and the balance transferred as those funds which were originally intended for the Olive/Sample overpass are no longer needed. By transferring them to the General Fund and appropriating same, they would become available for expenditures on improvements, equipment, and for the payment of such other fees and expenses attributable to the construction and operation of a professional baseball stadium.
