All action under C6ndemnation Resolution No. 26..Rescinded. y CONDFIVATION- RESOLUTION NO. 27. Resolved by the Board of Public Works of the City of South Bend, Indiana: That the following described property be appropriated for the use of said city; All of lot A. lst•Plat of Chapin Place, owned by Edward P. & Marie Pearl Chapin. Begin at S. E. Corner of lot 41 thence N.Wly on the S. line of said lot to SW corner of same, thence N on the West line of said iot to a point of intersection of a circle of a radius of 76 1/2 feet, the center bfnwhich circle is 16 112 feet south of the north line and 16 1/2 feet west of the east line of Lot -63 in 3rd Plat of Shetterly's Place; thence south Ely on the line of said circle to place of beginning. lst Plat of Chapin Place, owned byEdward P. & Marie Pearl Chapin. All of lot 64 in 3rd Plat of Shetterley's Place, owned by Ryell T. & Annie P. Miller & J. L. M. & Kate V. Shetterley. This Board, at its office in the City Hall on the 26th day of Feb 1907, at 10 A. M. will hear and receive remonstrances from all persons interested in or affected by these proceedings. Light ordered at the Cor of Marion Boulevard and Navarre street. • Tuesday Feb 26th, 1907. The Board met in regular, session at 10 A. M. All members present. Petition filed for Asphalt Pavement on.East Washington street from Emerick street to Eddy street. South Bend Electric Co were notified to place the arc light located at the cor of Wayne street& Vistula avenue in the center of the avenue. Engineer filed assessment roll and final estimates for'Pipe.Sewer on College street and Linden avenue from Fassnacht avenue to Johnson sfreet; Sherman avenue from Van Buren street to Michigan avenue; Leland avenue from the lst angle in Leland avenue to Hudson avenue; Notre Dame street from Jefferson street to Sorinstreet, all under Improvement resolutions Nos. 387, 4152 412 & 403 respectively. Resolved, that notices as to the amounts of assessments be published for six consecutive days in the South Bend Daily Times, commencing on the 27th day of Feb, 1907, stating that this Board will give a hearing on the amount of such assessments at its office in the„City Hall on the 19th day of March, 1907, at 7:15 P. M. Resolved further, that the entire work under the above contracts be accepted and approved and the final estimate thereon allowed. Notice of this resolution shall be published on the 27th day of February, 1907, in the South Bend Daily Times, stating that this Board will give a hearing on the acceptance of such work at its office in the City Hall on the 19th day of Larch, 1907, at 7:15 P. M. Hearing given on Condemnation Resolution No. 27, appropriating the following described property for public use: All of Lot "A" 1st Plat of Chapin Place, owned by Edward P. & Marie Pearl Chapin. Goodman. In the above matter no remonstrators appeared and no remonstrances were filed, the Board therefore declare the above described property condemned and jappropriated for public use. The City Engineer was instructed to make up the roll showing the awards of damages and the assessment for benefits. I - % 631 Tuesda February•26th, 19007. SPECIAL SESSION TUESDAY EVENING FEBRUARY 26TH, 1907, AT 7:15 P. 14. The Board met in Special session at 7:15.P. M. All members present. Hearing on_the-Declaratory Resolution.for Pipe Sewer on Bronson street from Marietta & Bronson street west 120 feet, under Improvement Resolution No. 421, was deferred until Friday Hatch lst, 19072 at 10 A. M. ' Remonstrance filed against the Howard street Pixie Sewer, same was OVER -RULED. Petition filed for sand filler on the Michigan avenue Brick Pavement, instead of ?cement filler as specifications call for. Petition was granted and the Engineer instructed.to amend the specifications. • I Hearing on Declaratory Resolutiono- for Brick Pavement on East Washington street from Emerick street to Eddy street, under Improvement Resolution No.416 was deferred until Tuesday March 12th, 1907, at 7:15 P.•M. Hearing given on Declaratory Resolutions for the following improvements: Brick Pavement on West Je fferson street from Chapin street to Walnut street; Brick Pavement on Michigan avenue from the alley West of Johnson street to the east line of Olive street; Brick Pavement on East Bronson -ptreet from Michigan street to Marietta street; Brick Pavement on Crescent avenue from Hill street.to Emrick street, Pipe Sewer on Howard street from the St. Jos.River at Leeper avenue to St. Louis street. All under Improvement Resolutions Nos. 417, 418, 419, 420, 422 respectively. In the above matter no further remonstrators appeared and no further remonstrances were filed. All other remonstrances were over -ruled. The Board therefore find in each and every case in said improvements that the benefits to the property and to the city of South Bend are equAl to the estimated cost of said improvements and the same are hereby in all things ratified confirmed and approved. Engineer filed estimated cost as -follows: Howard street Pipe Sewer, 6,946.00 Crescent avenue Brick Pavement 19625.00 West Jefferson street Do. 139122.00 Michigan avenue Do. 11,912.00 Bronson street Do. 112517.00 East Washington street. Do. 20,065.00 Be it resolved that notices be published in the South Bend Daily Times on the 2nd day of March and on the 9th day of March, 1907, to the effect that this Board wi&l receive bids for said improvements up to 10 A.
