T..& I. R. R. Viaduct, under Improvement Resolution No. 35� and 241 respectively. Resolved, that notices as to the amounts of assessments be published for six consecutive days in the South Bend Daily Times, commencing on the 3rd day of October 1906, stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the 12th day of December, 1906, at JO A.''M. Resolved further, that the entire work under the above contracts be accepted and approved and the final estimate thereon allowed.' Notice of -this resolution shall be published on the 3rd day of Deeember,.1906, in the South Bend Daily Times, stating that this Board will give a hearing on the acceptance of such work at its office in t,. the City Hall on the 12th day of December, 1906, at 10 A. All under Improvement Resolutions Nos. 353, 4112 3-0, 373 & 377 respectively. Acting President. SPECIAL SESSION TUESDAY EVENING DECEMBER 11TH, 1906, AT 7:15 P. M. The Board met in Special Session at 7:15 P. M. All members present, I Remonstrance filed by Catherine Kent against the North Taylor street Brick Pavement. Remonstrance filed against the Cedar Street Pipe Sewer. Assessment Rolls for Hearing on North Taylor street Brick Pavement, Cedar Street Pipe Sewer and Ford street Grale, Curb & Walk, under Improvement Resolutions Nos-393,337 & 397 resp deferred until Friday December 14th, 1906, at 10 A. M. Hearing given on Assessment Rolls and final estimates for Brick Pavement on Bronson & Marietta street from Vistula avenue to Sample street, Brick Pavement on Perkins street from Chapin street to Laurel street; Brick Pavement on Alley South of Wayne street from Main street to Lafayette street; Brick Pavevement on Coquillard School Alleys; Brick Pavement on Alley South of Colfax avenue from Lafayette to William street, Cement Walk & Curb on Parry street from Division street to Eddy street, Pipe Sewer on Sherman avenue from Van Buren street to Portage avenue, Grade. -Curb & Walk on Laurel street from Divisi- on street to Perkins street, Pipe Sewer on St. Louis & Miner street from South Bend ave to St. Peter street; Pipe Sewer on Ford street from Chapin street to Scott street. All under Improvement Resolutions Nos. 340, 3702 3912 395, 396, 3362 375, 379, 395 & 386 respectively. In the above improvements no remonstrators appeared and no remonstrances were viled The Board therefore find that the property assessed in said rolls filed November 27 1906, is benefitted in the amount of assessments as shown on said rolls and the Board further find that the p,ssessment rolls filed November 27th, 1906, and the final estimate allowed November 27th, 1906, should be and the same in hereby in all things ratified, confirmed and approved. 594 The Board met in regular session at 10 A. lei. Co'Munication received from the Common Council enclosing petitions as follows: One for Brick Pavement on Broadway from Lafayette street to Carroll street and one for an electric light at the Corner of Garst street and Franklin street. Ttearingd deferred until Wednesday December 19th, 19062 at 10 A. Ta: on Assessment Rolls for Brick Pavement on Taylor street from Michigan avenue to Marion street, Grade, Curb & Walk on Ford street from Warren street to the C. I. & S. R. R. Pipe Sewer on Cedar street from Emerick street to Eddy street. All under Improvement Resolutions T Nos. 353, 397 and 337 respectively. Petition filed for light at Corner of Mich street and Indiana avenue. Hearing$ deferred -until Wednesday December 19th, 1906, at 10 A. M. on Supplementary Assessment Rolls for Brick Pavement on Portage avenue and Grade, Curb & Walk on Portage avenue, under Improvement Resolutions Nos. 241 & 359 respectively. Rearing given on Condemnation Resolution No. 2-44 appropriating the. following des- cribed property for the opening of an alley between Main and Plichigsn streets from Indiana avenue South: Begin on the south line of Indiana avenue 165 feet west of the west line of Mich- igan street; thence south parallel with the west line of Michigan street 567.91 feet to the south line of the Cook property; thence west 14 feet; thence north parallel with said west line to the south line of In6iana avenue; thence east 14 feet to the place of beginning. In the above matter no further remonstrators appeared and all other remonstrances were over -ruled. The Board therefore declare the above described property in all things condemned and appropriated for Public use. The Engineer was instructed to make up the Roll for the assessments for benefits and the awards of damages,at some future date. President. 596 The Board met in regular'session at 10 A. M. Mr. Papczynski absent. Engineer instructed to amend Assessment Roll for Pipe Sewer on Crescent avenue, assessment to be made to include lots Nos. S & 9 in Dinana 2nd Addition. Hearing given on Assessment Rolls and final estimates for Pipe Sewer on Crescent avenue from Emerick street to Hill street, Pipe"Sewer on Linden avenue from Meade street to Anthony street, Grade, Curb & Walk on Milton avenue from Michigan street to Fellows street and Water Connections on South Bend avenue from Notre Dame street to Eddy street All under improvement resolutions Nos. 373, 330, 377 &411 respectively In the above matter no further remonstrators appeared and no further remonstrances were filed. All other remonstrances were over -ruled. The Board therefore find that the property assessed in said rolls filed December 9th, 19062 is benefitted in the amount of assessments as shown'on said rolls, except the Crescent avenue Pipe Sewer Assessment Roll, which was amended, and the Board further find that the assessment roll filed December £nth, 1906s and the final estimate allowed December £nth, 1906, should be and the seine are hereby in all things ratified, confirmed and approved. In the matter of a hearing on Supplementary Assessment Roll for Cement sidewalks on Portage avenue from Hudson avenue to Kinyon street and for Brick Pavement on Portage avenue from Forest avenue to the I. I. & I. Viaduct, under Improvement Resolutions Nos. 359 & 241 respectively. The Board being advised in the matter find that the objections of the remonstrators should be and the same are hereby sustained and all action in the above matter is hereby rescinded. City Engineer was instructed to make some amendments to the Ford Street Assessment Roll for Grade, Curb & Walk. Hearing was given on Assessment Rolls and final estimates for Brick Pavement on N. Tp*rlor street from Michigan avenue to Marion street, Pipe Sewer on Cedar street from Emerick street to Eddy street, Grade Curb & Walk on Ford street from WOr.en street to the C. I. & S. R. R. All under Improvement Resolutions Nos. 393, 337 & 397 respectively. In the above matter no further remonstrantors appeared and no further remon- strances were filed. All other remonstranees were over -ruled. The Board therefore find that the property assessed in said rolls filed. November 27th, 1906, is bene- fitted An the amount of ar_sessments as. shown on said rolls, with the exception of Ford street, Grade, Curb & Walk which was amended, and the Board further find that the assessment roll filed November 27th, 1906, and the final estimate allowed November 27th, 1906, should be and the same is hereby in all things ratified, confirmed anlapproved as amended. 59 The Board met in regular session at 10 A. M. Mr. Papezynski absent. Proposal: submitted by E. R. Dumont by Harry R. Wair Atty, in which it is proposed to install a system of public drinking fountains and waste paper depositaries in the business.distriet. All former action under Condemnation Resolution -No. 21 adopted on the 13th day of September, 1905, `is hereby rescinded. CONDF�NATION RESOLUTION NO. 25. Resolved by the Board of Public Works of the City of South Bend, Indiana: That the following described property be. appropriated for the _use of said city►;. Begin on the east line of Webster street a a point 10.6 feet south of the south line of Huron street, which point is south line of right of way of Indiana, Illinois & Iowa R. R., thence north easterly with said south line of right of way to the south line ofo.Huron street; thence east 53.5 feet; thence south westerly to a point 22.1 feet south of beginning; thence north to the place of beginning. The following described property may be injuriously or beneficially affected by such appropriation: No. Qf 1Qt. Add. All of lot 25 Wilsons Sub -Div of Bank Out lot 94. R. The purpose of such appropriation is to open a public street and.thoroughfare from Huron street to Webster street. Notice of this resolution shall be published on the 22nd day of December and on the 29th day of December, 1906, in the South Bend Daily Times. This Board; at its office in the City Hall on the 9th day of January 1907, at 10 A. M. will hear and receive remonstrances from all persons Interested in or affected by these proceedings. No further remonstrators appeared and no further remonstrances were filed. All other remonstrances were over —ruled. The Board therefore find that the property assessed in said rolls filed December 8th, 1906, is benefitted in the amounts of assessments as shovm on said rolls, as amended, and the Board°further find that the assessment roll filed December £nth, 1906, and the final estimate allowed December £nth, 1906, should be and the same is hereby in all things, ratified, confirmed and approved as amended.
