AN ORDINANCE TO VACATE THE FOLLOWING
DESCRIBED PROPERTY
The entire North-South alley ALSO the west 1/2 (one-half )
of the East-West alley within the city block bounded by:
Monroe-Main - South and Lafayette Streets in Martins
Add to the City of South Bend, Indiana
STATEMENT OF PURPOSE AND INTENT
Pursuant to Indiana Code Section 36-7-3, the Common
Council is charged with the authority to hear all petitions
to vacate public ways or public places within the City.
The purpose of this ordinance is to vacate certain
public property in order to promote security and discourage vandalism at
the Studebaker National Museum by restricting vehicle traffic.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, as follows :
SECTION I. The Common Council of the City of South Bend
having held a public hearing on the petition to vacate the
following property:
The entire North-South alley ALSO the
West 1/2 (one-half ) of the East-
West alley within the city block
bounded by:
Monroe - Main - South and Lafayette
Streets in Martins Add
to the City of South Bend, Indiana
(See Exhibit "A" )
hereby determines that it is desirable to vacate said property.
SECTION II. The City of South Bend hereby reserves the
rights and easements of all utilities and the Municipal City of
South Bend, Indiana to construct and maintain any facilities,
including, but not limited to, the following: electric, telephone,
gas, water, sewer, surface water control structures and ditches,
within the vacated right-of-way, unless such rights are released
by the individual utilities.
SECTION III. The following properties abut the above
described property:
Lots 43-44-45-46-47-48,55-56-57-58-59-60 of
Martins Add to the City of South Bend.
SECTION IV. The purpose of the vacation of the real property
is to:
Promote security and discourage vandalism at
the Studebaker National Museum by restricting
vehicle traffic.
SECTION V. This ordinance shall be in full force and effect
from and after its passage by the Common Council and approval by the
Mayor.

RE: ALLEY VACATION (STUDEBAKER NATIONAL MUSEUM)
Dear Council Member:
The purpose of vacating the alleys abutting and adjacent to
the Studebaker National Museum is for security and improvements
that require property that is of one unit or rather singular as
opposed to a mall type operation. We (the City) would
appreciate any action taken on your (the Councils) part to help
this Bill become an Ordinance.

Dear Members of the Council:
In accordance with Municipal Code Section 18-53 . 8, a favorable
recommendation is being submitted to the Common Council concerning
the Vacation Petition filed by the City of South Bend, Division of
Engineering, to vacate the following alleys:
The entire north/south alley ALSO the west 1/2 (one-half)
of the east/west alley within the city block bounded by:
Monroe-Main-South and Lafayette Streets in Martins Add. to
the City of South Bend, Indiana.
For your information, a Public Hearing concerning the Vacation
Petition as filed was held by the Board of Public Works on
November 10 , 1986 .
Mr. Joseph J. Pluta, Director, City of South Bend, Division of
Engineering, was present and spoke in favor of the proposed
vacation. Mr. Gregory Bajer, 1211 Dodge Street, Mishawaka,
Indiana, was also present on behalf of Ms. Jule Bell, 210 West
Monroe, Elkhart, Indiana, an abutting property owner. Mr. Bajer
advised that Ms. Bell owns property at the northeast corner of the
north/south alley to be vacated and is concerned that closing the
alley would cut-off access to the rear of a building at that

location. After reassurance by the Board that vacating the alley
would not cut-off needed access, Mr. Bajer informed the Board that
he was not opposed-, to the closing of the alley. For your
information, a copy of the excerpts of the minutes of the Public
Hearing is attached.
Therefore, the Board of Public Works favorably recommends the
vacation of the above referred to alleys subject to any and all
utility easements.
