GAMMON Approved and signed by me UC-li 2y 19 S76 ,rL-e, G Mayor . • ORDINANCE NO. 1(09(0 -g(o AN ORDINANCE AMENDING CHAPTER 6 OF THE SOUTH BEND MUNICIPAL CODE, ENTITLED BUILDINGS STATEMENT OF PURPOSE AND INTENT: To provide minimum standards to safeguard life , public safety and welfare, and real and personal property by regulating the design and construction of buildings and structures in the City of South Bend and to update the Municipal Code fee schedules, certain amendments and additions to the South Bend Municipal Code , Chapter 6, entitled Buildings are required . NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: SECTION I. Chapter 6, Article 1, Section 6-4 of the South Bend Municipal Code is amended as follows : Section 6-4 . Permit Fees . (4)-(6) Reserved . (7) The fee for a permit for banner signs shall be five dollars ( $5. 00) each. (8) Wrecking and demolition permit fees shall be as follows : a. Residential : 1. Thirty-five dollars ( $35. 00) per one-story building with ten thousand one ( 10, 001) or more square feet. (9) Change of classification $ 1.00 of a building (10) Installation of elevator $ 5.00 ( 11) Installation of new $ 25. 00 billboard (12) Construction of sky signs First five hundred (500) square $ 10. 00 feet or fraction thereof Each additional square foot $ .02 above five hundred (500) on the readable side . (16) No permit, except for the change of classification of building, shall be issued for a lesser fee than two dollars ( $2.00) . ( 17) The fees for installation of a wood burning stove are as follows : a. Flue ( including chimney and chimney connector)-Five dollars ( $5. 00) . b. Existing masonry chimney (new flue liner)-Five dollars ( $5. 00) . c . Hearth extension ( fireplace stove or fireplace insert)-Five dollars ( $5. 00) . d. If the work does not pass inspection, a re-inspection fee of ten dollars ($10. 00) shall be charged for each future reinspection of that phase of work. ( b) The fees provided in this section shall not include permits for plumbing, heating or electrical installations covered by other provisions of this Code or other ordinances of the City. The payment of such penalty shall not release the person in default from any other penalties hereafter provided . SECTION II. Chapter 6, Article 2, Section 6-5 of the South Bend Municipal Code shall be amended to read as follows : Section 6-5. .Adoption of Reference . The following rules, regulations and codes are hereby adopted by reference as fully as if set forth herein to govern the erection, construction, enlargement, alteration, repair, moving , improving , removing , conversion, demolition, equipping, using , occupying or maintenance of buildings and structures in the city: ( 1) Indiana Building Code , 675 IAC 13-2, 13-3 and 13-4 which adopts by reference the Uniform Building Code and the Uniform Building Code Standards, 1985 Edition. ( 2) Indiana Electrical Code , 1984 Edition (675 IAC 17) originally published as ( 81R 1010) which identifies amends and incorporates therein the National Electrical Code , 1984 Edition. ( 10) Indiana Standards for Permanent Installation of Manufactured Homes, 675 IAC 3-3, originally published as ( 6 1729) under that title . ( 11) General Adminstrative Rules-Also known as the Indiana Administrative Code, 675 IAC 12 ( 675 IAC 12-1 and 675 IAC 12-1) , also known as the General Administrative Rules. • SECTION III. Chapter 6, Article 4, Section 6-10 of the South Bend Municipal Code shall be amended to read as follows : Section 6-10. Fees, registration and permits for plumbing services . (A) No person shall perform or cause to be performed the installation or alteration of any plumbing work on or within the City without obtaining in advance, a permit from the Department. (-A.}(B) Schedule of permit fees. ( 1) Definitions. As used in this subsection, the following words shall have the following meanings : (a) Plumbing services : The construction, installation, removal , alteration, repair, remodeling , or removal and replacement, or the causing of such work to be done, for any plumbing , gas, or drainage equipment, or any water softening or conditioning or water sprinkler equipment or apparatus within or adjacent to any building or premises. (b) Excavator: A person who installs sewers or drainage systems and/or devices, such as drain basins, drywalls, storm sewers , sanitary sewers, and septic tanks . (c) Journeyman plumber : A person who holds an Indiana license and who engages or offers to engage in, as an occupation or trade , plumbing services under the supervision, direction and responsibility of a licensed plumbing contractor. (d) Maintenance technician : A person who is employed on a permanent basis to keep the premises of a commerical business establishment or multifamily residential establishment in good repair. (e) Plumbing contractor: A person who holds an Indiana license and who , for compensation, undertakes to or submits a bid to or does himself or by others perform plumbing services and who is responsible for substantially all of the plumbing services within the entire project, or one who fabricates units or plumbing substantially completed and ready for installation. (f) Sewer cleaners : A person who cleams or otherwise repairds sewers . ( 2) Registration required : (a) All persons performing plumbing services within the City shall register with the Department; provided , however, that the owner-occupant of a dwelling of eight (8) or fewer residential units shall not be required to register when he or she is installing , altering or repairing the plumbing of those residential units. (3) Permits required : 1 • (c) Other limitations on permit issuance : 1 . An excavator may only be issued a permit for sewer and water line work from a distance of two (2) feet outside of the foundation walls of any building or structure to the public way. 2. A fire protection sprinkler contract may only be issued a permit to install or repair fire protection sprinkler systems. 3. A lawn sprinkler system contractor may only be issued a permit to install or repair lawn sprinkler systems, including backflow protection devices. 4. A maintenance technician may only be issued a permit to repair plumbing or to replace fixtures which require no changes to the piping , provided that the repair or replacement is to plumbing at his regular place or employment as a maintenance technician. 5. A sewer cleaner may only be issued a permit to repair or alter existing drainage piping , or to install sewer or water lines, from a distance of two ( 2) feet outside of any building or structure to the public way. 6. A swimming pool installer may only be issued permits required for work connected with the installation of swimming pools . 7. A water softener dealer may only be issued a permit to install water softening equipment or apparatus . (-C)-(D) All plumbing installations requiring a permit shall be inspected by the plumbing inspector three ( 3) times, once each for underground work, rough-in work, and final completion. A complete line test shall also be supervised by the plumbing inspector. The plumbing permit holder shall notify the plumbing inspector at least twenty-four ( 24) hours in advance of the time the work is ready for inspection. If the work does not pass inspection, a reinspection fee of ten dollars ( $10. 00) shall be charged for each future inspection of that stage of work. SECTION IV. Chapter 6, Article 1, Section 6-2)4 is amended to read as follows : Section 6-24. Permits. ( a) Required in advance . No person shall perform or cause to be performed the installation of heating , ventilating , air conditioning or refrigeration equipment or systems without obtaining , in advance, a permit form the Department. ( b) Fees. Each application for a permit for installation of heating , ventilating, air conditioning , and refrigeration equipment or systems shall be accompanied by fees in accordance with the schedule below. When the total capacity of any system in any single installation is provided by more than one ( 1) unit, the sum of the capacities of each unit and the total number of such units shall determine the fee . Barnard 219/284-9486 o i rector 219/284-9325 Jack A.Mathews Building Commissioner October 6, 1986 South Bend Common Council Members 3rd Floor, County-City Building South Bend, Indiana 46601 RE: Amendment to Chapter 6 of the South Bend Municipal Code Dear Council Members: The attached ordinance amends Chapter 6 of the South Bend Municipal Code entitled "Buildings. " The amendments increase many of the permit fees charged for construction work. The amendments to Section II (3) and (4) adopt the 1985 State Codes for Plumbing and Mechanical Work. Section VII adopts amendments to the State Enforcement of Building Standards Law (The Unsafe Building Law) . The amendments were adopted by the State Legislature in an attempt to further strengthen the Code Enforcement hearing process and the enforcement standards for unsafe properties. The permit fees have not been changed since 1982 . The increases reflect the increased cost of inspection services and have been increased an average of 25%. The rationale for changing the fees 25% was based on increased material and labor costs of 6% per year since 1982. This is a moderate increase when we consider the additional cost to the City of providing inspection services for new construction and rehabilitation projects. If Code Enforcement were to attempt to recover the full cost to the City for eight building inspectors, the increase in permit fees would have been 85%. These proposed changes in the permit fees attempt to more realistically reflect the cost of the building inspectors services which are performed in order to assure that construction work is completed according to the codes and to insure that all health and safety regulations are followed. • Council 'Members - 2 - October 6, 1986 Attached is a list of all the permit fees which will be affected by this ordinance.
