AN ORDINANCE AMENDING THE METHOD OF COMPUTATION OF
WASTEWATER RATES FOR APARTMENT COMPLEXES,
HOTELS, MOTELS, AND MOBILE HOME PARKS
AND AMENDING CHAPTER 17, ARTICLES 5 AND 6
BY AMENDING SECTION 17-47. 1
STATEMENT OF PURPOSE AND INTENT:
The Common Council of the City of South Bend , by Ordinance
No . 6820-80, adopted on September 15, 1980, established for the first
time minimum rates per unit in apartments complexes, hotels, motels,
and mobile home parks . The Council now desires to amend the method
of computing such charges to both minimize the effect of vacant units
in said complexes and otherwise treating dwellers in such units more
similarly to other residential users of wastewater services .
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend , Indiana, as follows :
SECTION I. Section 17-47. 1 of Article 5 of the Municipal
Code of the City of South Bend , shall be amended by amending Sub-
section (d) in its entirety to read as follows :
(d) There shall be , and are- is hereby established for the
use of and the services rendered by the wastewater treatment plant of
the City of South Bend for a family dwelling unit located in an
apartment complex , hotel or motel , or mobile home park the following
method of computation ra-te-s--d--ctra-rge-8-r, which shall be implemented
beginning on the first of the month following the effective date of
this ordinance :
(1) Divide the usage shown on the meter by the
number of dwelling units served by that
meter to produce the average dwelling unit
usage ; and
(2) Apply the average dwelling unit usage to the
rate table set forth above to produce the
average dwelling charge ; and
(3) Multiply the average dwelling unit charge by
the total number of dwelling units served by
the meter to produce the customer charge .

Re : Amendment to Wastewater Rate Ordinance
Dear Council Members :
The attached ordinance is an effort to resolve complaints that
have been raised by various apartment complexes concerning the
imposition of a per unit minimum upon apartment complexes commencing
October 1, 1980. The method of computation enclosed in this bill
should be revenue neutral to the City of South Bend .
Your consideration and approval of this ordinance is
recommended .
