GAMMON Approved and signed by me C -06 (4 ig j !� / Mayor ORDINANCE NO. 74, AN ORDINANCE AMENDING CHAPTER 9 OF THE SOUTH BEND MUNICIPAL CODE TO UPDATE SECTIONS CONCERNING FIRE PREVENTION STATEMENT OF PURPOSE AND INTENT: To bring the Municipal Code into conformity with State statutes and regulations governing fire prevention, certain amendments and additions to the South Bend Municipal Code , Chapter 9, entitled "Fire Prevention" are necessary. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: SECTION I. Chapter 9, Article 1, Section 9-1 of the South Bend Municipal Code is amended to read as follows : Section 9-1. Definition. As used in this chapter, the National-Fire-bade Indiana Fire Prevention Code , hereinafter referred to as the tee IFPC means the fire prevention code of the City of South Bend , Indiana. SECTION II. Chapter 9, Article 1, Section 9-2 of the South Bend Municipal Code is amended to read as follows : Section 9-2. Nationat-Fire-bode Indiana Fire Prevention Code - Adopted by Reference . The NFG IFPC, 1975 1985 edition, as promulgated by the latonar-Fire-Protection-Assactattan Indiana Fire Prevention and Building Safety Commission, together with any and all references thereto is made a part of this chapter with the same force and effect as though set out in full herein as the official fire prevention code of the City of South Bend , Indiana, except for such changes, additions or deletions as are specified in this chapter . At least two (2) copies of such fire prevention code with such amendments and supplements are on file and open for public inspection in the offices of the etty-Grer:k Fire Department and SECTION III. Chapter 9, Article 1, Section 9-3 of the South Bend Municipal Code is deleted in its entirety, and a new Section 9-3 is adopted , as follows : Section 9-3. Reserved. SECTION IV. Chapter 9, Article 1, Section 9-4 of the South Bend Municipal Code is deleted in its entirety, and a new Section 9-4 is adopted , as follows : Section 9-4. Reserved . SECTION V. Chapter 9, Article 1, Section 9-5 of the South Bend Municipal Code is amended to read as follows : Section 9-5 . Adoption of 4f-f-iii-e1- Reg l ti -lsio-.--5- Indiana Flammable Combustible Liquids and Gases Code by reference . (a) The -0-f-=iii-&l- -No-.--5- Indiana Flammable and Combustible Liquids and Gases Code , 1-9-7-3- 1985 edition, as adopted and promulgated by the Iii-an-t�S-tfrt-e- i-re--Gotnm-issi-on Indiana Fire Prevention and Building Safety Commission, together with any and all references thereto is made a part of this chapter with the same force and effect as though set out in full herein. (b) Whenever a particular subject matter is not treated within the context of the--ru1-es--and--regulations this code , then the -tie--Ya-t-ib-rra3 Indiana Fire Prevention Code will be the applicable standard to be followed . If the subject matter is treated in both -Of-'3e-1a3- gu3atlon--NO--.--5-and--the- a-tivnal--Pire- -Oode Indiana Fire Prevention Code and the Indiana Flammable Combustible Liquids and Gases Code , and they are in conflict, then the Off3-c3ai-ftegu3.at3nn--No:-" Indiana Flammable and Combustible Liquids and Gases Code shall be the applicable standard to be SECTION VI. Chapter 9, Article 2, Section 9-12 of the South Bend Municipal Code is amended to read as follows : Section 9-12. Required; Responsibility for Installation and Maintenance; Standards. (a) All multiple-dwelling units and rental units as heretofore defined shall be equipped with smoke detectors . ( b) The owner, manager or agent of the heretofore defined multiple-dwelling units and rental units shall be responsible for the installation and maintenance of all smoke detectors . (c) In apartment houses, rental units and existing hotels and motels, the smoke detectors shall be mounted on the ceiling or wall every fifty ( 50) feet, at a point centrally located in the corridor, and in the area giving access to the rooms used for sleeping purposes. (d) In boardinghouses, lodging houses, rooming houses and new construction hotels and motels, or those hotels and motels in which corridors or sleeping rooms are remodeled after the passage of this article, the smoke detectors shall be centrally located on the ceiling of each room used for sleeping purposes and every fifty ( 50) feet along each corridor. (e) All smoke detectors shall be located within twelve (12) inches of the ceiling, and no detector shall be recessed into the ceiling . (f) When actuated , all smoke detectors shall provide an audible alarm of at least eighty-five (85) decibels at ten (10) feet, and such alarm shall be capable of persisting for at least four (4) minutes. (g) Each and every apartment house and rental unit to be built or in the process of being built and those existing units which undergo electrical work to the extent that a new service panel is put in and individual room circuits to each dwelling unit are added , must have a smoke detector permanently mounted to a standard electrical outlet or junction box without a disconnect Section 1413 1210 of the Indiana eonstruotiori-Rules-art&-Regula- tioris Building Code , Volume I, 1978 1985 edition, as amended from time to time , will satisfy the requirements of this subsection. SECTION VII. The amendments lists the updated editions of the codes required by the State of Indiana. These codes include the Indiana Fire Prevention Code ( IFPC) and Indiana Flammable and Combustible Liquids and Gases Code . The 1985 Indiana Fire Prevention Code ( IFPC) replaces the National Fire Code (NFC) . Thank you for your consideration of these amendments.
