Ordinance No. 4990-68, as amended, which ordin- ance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of'South Bend, St. Joseph County, State of Indiana: A parcel of land being a part of the Southeast Quarter of Section 11 and part of the Southwest Quarter of Section 12, Township 37 North, Range 2 East, Second P.M. , St. Joseph County, Indiana and being more particularly described as follows : Commencing at the Northeast corner of Tract 3 of the Studebaker Corp. Replat as recorded in the office of the Recorder of St. Joseph County, Indiana in Plat Book 11, Page 184 thence South 0-12 '-10" East, along the West right-of-way line of LaFayette Street, a distance of 1108.17 feet to the place of beginning; thence contin- uing South 0-12 ' -10" East, a distance of 80 . 00 feet; thence South 89-50 ' -22" West, a distance of 250 . 00 feet; thence North 0-12 ' - ' 0" West parallel with the West right-of-way line of said Lafayette Street, a distance of 80 . 00 feet; thence North 89-50 '-22" East, a distance of 250 . 00 feet to the place of beginning containing 0. 46 acres more or less. be and the .same is hereby established as "D" Light Industrial and "F" Height and Area. This ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the mayor, and legal publication. ;� / 1 ;p ''�'' r of the • , on Council ZONING APPLICATION Date Filed: August , 1986 Application No. Date Received by the Area Plan Commission: August , 1986 The undersigned makes application and petitions the Common Council of the City of South Bend to amend the zoning ordinance as herein requested. 1 ) The property sought to be rezoned is located just north of the corner of Lafayette and Sample Street in the City of South Bend on the west side of the street. 2 ) The name and address of the property owner is Transwestern Investment, Inc. , c/o Robert W. Green, 330 E. Jefferson Blvd. , South Bend, Indiana 46601, Telephone 232-3992 . 3 ) The name and the address of the contingent purchaser is South Bend Policemen's Federal Credit Union, 701 W. Sample Street, South Bend, Indiana 46621, Telephone 234-1524 . 4 ) It is desired and requested that this property be rezoned from "E" Heavy Industrial and "F" Height and Area to "D" Light Industrial and "F" Height and Area. 5 ) The rezoning is requested to allow the contingent purchaser to construct a building to house the South Bend Policemen' s Federal Credit Union. 6 ) Attached is a copy of (a) legal description of the property; (b) a list of the names and addresses of all property owners within 300 feet of the petition property; (c) five (5 ) site plans ; and (d) addressed, stamped envelopes for all property owners within 300 feet of the petition property. 7 ) By signing this petition, I and any contingent purchaser under- stand that if the Council approves this petition to rezone, it may be approved subject to the submittal of a final site plan. A final site plan must be submitted to the Area Plan Commission within one (1) year of the Council ' s action. JOSEPH COUNTY, IN Executive Director Room 1140 County-City Building South Bend, Indiana 46601 (219) 284-9571 September 17, 1986 The Honorable Common Council City of South Bend County-City Bldg. - 4th Floor South Bend, In 46601 RE: A proposed ordinance and site development plan of Transwestern Investment, Inc. to zone from "E" Heavy Industrial, "F" Height and Area to "D" Light Industrial, "F" Height and Area, property located on the west side of Lafayette Street, approximately 150 feet north of Sample Street, City of South Bend Gentlemen: The above referenced ordinance and site development plan of Transwestern Investment, Inc. was legally advertised September 5 and September 6, 1986. The Area Plan Commission gave it a public hearing on September 16, 1986, at which time the following action was taken: Upon a motion by Robert Lehman, being seconded by Rene Vandewalle, and unanimously carried, the proposed ordinance and site development plan of Transwestern Investment, Inc. to zone from "E" Heavy Industrial, "F" Height and Area to "D" Light Industrial, "F" Height and Area, property located on the west side of Lafayette Street, approximately 150 feet north of Sample Street, City of South Bend is sent to the Common Council with with a favorable recommendation subject to a Final Site Development Plan PLEASE NOTE that the Ordinance has been amended by the petitioner to include a legal description different than that used for the Common Council's first reading. The amended Ordinance was the Ordinance legally advertised and heard by the Area Plan Commission. Herendeen, Attorney STAFF REPORT TRANSWESTERN INVESTMENT, INC. #1044-86 September 5, 1986 West side of Lafayette Boulevard, approximately 150 feet north of Sample Street City of South Bend REQUESTED ACTION: The petitioners are requesting a zone change from "E" Heavy Industrial, "F" Height and Area to "D" Light Industrial, "F" Height and Area to allow for the construction of a credit union. EXISTING LAND USE: The property is vacant. SURROUNDING LAND USE AND ZONING: Located to the north is the Avanti Corporation; to the east across Lafayette Boulevard is a junk vehicle storage yard; to the south is a parking lot; and to the west is a parking lot. ACCESS: Access to the site will be from Lafayette Boulevard. DRAINAGE: The drainage has not been addressed by the petitioners. DATA: The total site to be rezoned is 20,000 square feet. Of that, the buildings will occupy 1,517 square feet, or 7.6% of the site; the parking and drives will occupy 17,683 square feet, or 88.4% of the site, and approximately 800 square feet or 4% of the site will remain as open space. SITE PLAN: The site plan is preliminary. AGENCY COMMENTS: The City Engineer made the following comments: "1. City water and sanitary sewer are available to the site. • 2. Storm water must be retained on site with drywells at a rate of 30 gallons/100 sq. ft. of roof and paved areas. ' 3. Curb cuts must be per city standards." The City Building Department made the following comments: "The property is currently zoned "E" Heavy Industrial and "F" Height/Area. The petition to rezone to "D" Light Industrial is probably the highest and best use. Commercial uses are allowed per 21-35(a) (28) in "D" Zoned districts.
