Whereas, the Board did on the 20th day ofFebruary 1906, pass certain resolutions for the improvement of streets in this City, to -wit: - Asphalt pavement on S. Fain street from Was�iington street to Colfax avenue, Asphalt pavement on William street from Colfax avenue to Washington street, Asphalt pavement and Grade, Curb F- Walk on Jefferson street from Vistula avenue to River bridge, Brick Pavement on W. And Whereas It has come to the attention of this Board that an uncertainty has arisen with reference to the issueing of bonds under said resolutions, Therefore it is ordered by the Board that all of said resolutions should be and they are hereby in all things resci.nded.. Gentlemen: -- We the undersigned propertyowners propose to give to the City all land - necessary to open Carroll street between Penn avenue and,Indianaavenue to conform to width of said streeet north of Penn avenue on the following terms and conditions. PROVIDED, that the City will exempt Said property owners from any cost or assessments for grading Curbing and laying of cement sidewalks on said portion of said street. Hearing given on Declaratory resolutions for the Following improvements, to -wit: - Grade, Curb & Walk on Golden avenue From Portage avenue to Leland avenue, Pipe Sewer on Allen street from Mich ave to south end of allen street, Pipe Sewer on Johnson street & Michigan avenue from Fassnacht avenue to Olive street, all under improvement Resolutions Nos. 3199 320 & 321 respectively. In the above matter no remonstrators appeared and no remonstrances were filed. The Board therefore.Find in each and every ease in said improvements that the benefit to the property and to the City of South Bend are equal to the estimated cost of said improvements and the same are hereby in all things ratified, confirmed and approved. Resolutions were received from the Council asking for sidewalks on Sample street from Vistula avenue to Michigan street. Also for repairing of walks on Vistula avenue from the brand Trunk R. R. to Monroe street. President. 4243 Tuesday April 17th, 1906. The Board met in regular session at 10 A. M. All members present. Hearing given on Condemnation Resolution No. 22, appropriating -the following described property for alley purposes: A Strip Nine feet nine tenths (9.9) wide off the north end of lots 41, 42, 43 and F in Rockafellers 2nd addition. In the above matter no remonstrators appeared and no remonstrances were filed. The Board therefore find that the above described property should be and the same is hereby in all things condemned and appropriated for a public alley. City Attorney was notified to have the South Bend.Electric Company to remove the transformers from in front of the Diller and Donahue Lumber Yard on St. Joseph Street. Bond of T. C. Barnes filed and approved and contract signed for Eddy streeet & Mishawaka avenue Grade, Curb & Walk Improvement. In the above matter no remonstrators appeared and no remonstrances were filed. The Board therefore find in each and every case in said improvements that the benefits to the property and to the City of South Bend are equal to the estimated cost of said improvements and the same are hereby in all things ratified, confirmed and approved. The undersigned Appraisers to whom was referred the above entitled matter, do hereby report that the assessment complained of by the Plaintiff in said cause does not exceed the special benefits to said property, and the assessment made by the Board of Public Works, to —wit: Two hundred forty—nine Dollard and three cents ($249.03) upon the 26th day of January, 1906 is hereby in all things confirmed and approved by us.
