Hearing given on assessment rolls an6l final estimates for the following improvements, to -wit: - Grade & Curb on Notre Dame street from G. T. W. R. R. to proposed boulevard, Grade, Curb & Walk on Lincoln street from Washington street to Longley avenue, Grade, Curb & Walk on Kerr street from Chapin street to Catalpa ave--,ue, Grade, Curb & Walk on Haney avenue from Michigan street to Carroll street, Grade, Curb Walk onBirdsell street and Sancome avenue from Linden avenue to La Porte avenue, Pipe Sewer on Oak street from Scott street to Cottage Greve avenue, Pipe Sewer on W. , Jefferson street from Chapin street to Laurel -street, Pipe Sewer on Dayton street from Michigan street to Witwer avenue, Pipe Sewer on Sherman avenue from Michigan avenue to South end of Sherman avenue, Brick Pavement on 1st alley west of Michigan street from South street to alley south. All under Improvement Resolutions Nos. 290, 290, 2972 2_792 2919 2745 301, 3021 2751, 291 respectively. No remonstrators appeared and. no remonstrances were filed. The Board therefore find that the property assessed in said rolls filed. December 19th, 1905, is benefitted in the amount of assessments as shown on said rolls and the Board find that the assessment roll filed December 19th, 1905, and the final estimate allowed December 19th 1905, should be and the same is hereby in all things ratified, confirmed and approved. 7 Remonstrance.f'iled a-_ainst the Bronson street Pipe Sewer. Contract signed for same. Communication received from J. M. Studebaker ask-'ng that the Board of Public Works sign an agreement to keep the Electric Fountain, which he donated to the City for Howard Park, in repair and proper running order at all times. Petition filed for the opening of the alley west of Taylor street running south from Michigan avenue. Hearing given on Assessment. Rolls and final estimates for Pipe Sewer on Bronson street from Main street to Lafayette street and Pipe Sewer on Scott & Lindsey streets, under Improvement Resolutions Nos. 292 & 271 respectively. No remonstrators appeared and no remonstrances were filed. The Board therefore find that the property assessed in said rolls filed December 19th, 105, and the final estinate allowed December 19th, 1905, should be and the same is hereby in all things ratified, confirmed and approved. President. 9 The Board met in regular session. at 10 A. M. Mr. Papczynski absent. Petition filed for the vacation of part of Harlins Sub -Division of Bank Out Lot 82. Referred to the Engineer. Clerk & City Sealer instructed to advertise for bids for a public scale to be installed at the rear of the Central Fire Station. Bids to be received up to 10 a. m. on the 20th day of January, 1906. AGREEMENT WITH STUDEBAKER---- HOWARD PARK FOUNTAIN. Confirming an informal agreement heretofore made between J. M. Studebaker, party of the first part,_ and the Board of Public Works of the City of South Bend, party of the second part, said agreement being ,as; fellows J. M. Studebaker is to pr4sent freeHof all charges to the city of South Bend an electric fountain to be erected by the donor in Howard Park. The same is to be setup, fully completed, and all connections made,.in good running order, fully without cost to the City of South Bend. On the part of the city the Board of Public Works promises to keep the fountain and its connections, including the electrical apparatus, in proper running order and good repair. The use of the fountain and the exhibitions of the electrical display'to be wholly within the province and direction of the Board of Public Works. Witness our hands this 6th day of January, 106. South Bend Electric Company were notified to install an Arc Lamp on W. Division street near the Singer Factory, to be installed under the direction of. the Street Commissioner. The following Bonds were released: — Hoban & Roach E. Wayne street Pipe Sewer C. H. Defrees Tutt Street Brick Pavement C. H. Defrees Foote street Grade, Curb, Walk & macadam. SPECIAL SESSION TUESDAY EVENING JANUARY 16TH, 1906 AT 10 A. 14., The Board net in special session at 7:15 P. M. All members present. Hearing given on the Assessment Roll andfinal estimate for the Nigh & Wenger street Pipe Sewwr, under Improvement Resolution No. 294. No Remonstrators appeared and no remonstrances were filed. The Board therefore rind that the property assessed in said rolls filed December 30th, 19052 F..:. is benefitted in the amount of assessments as shown on said rolls and the Board rind that the assessment roll filed December 30th, 1905, and the final estimate allowed December 30th, 1905, should be and the same is hereby in all things ratified, confirmed and approved. In the matter of the Portage avenue grading assessments, Remonstrances were filed by the Muessel Brewing Company, halter G. Muessibl, Mrs. E. Peters, H. N. Kibler, Kinyon Bros., and Messrs Ritner, by the law firm of Anderson. DuShane and Crabill, against the amounts of their assessments. Messrs A. G. Harlin, Garwood and Kinyon were sworn and testified regarding the benefits and damages to the effected property on said street by the above stated grading. Final hearing on said assessment Roll and final estimate under Improvement Resolution No. 26-8 was deferred until Friday January 19th, 1906, at 10 A. M. Hearing on the Assessment Roll and final estimate for the Grading on Portage avenue from the I. I. b- I. R. R. Viaduct to the City Limits, under Improvment Resolution No.,Q Bdeferred until Friday January 26th, 19062 at 10 A. M. Proposition filed by Andrew Anderson, Emma BuShane:and Jennie Putman, offering to sell a parcel of land to the City for the extension of Leeper Park. President. The Board met in regular session at 10 A. M. All members present. Bids were received and opened. for a Public Scale. The Bids were referred to the City Sealer and the matter taken under advisement. Petition filed for Grade, Curb & Walk on Carroll street from Pennsylvania avenue to Calvert street. Application filed by A. M. Levin, Mechanical Engineer, for position with City. Friday Janu The Board met in regular session at 10 AIi. All members present. Contract awarded to the Howe Scale Company for the public scale to be installed in the rear of the Central Fire -Station. Contract price $310.00 Remonstrance filed by M. J. Warrell and Jane Warrel against the amount of their assessments on the Portage avenue grading. Hearing given on the Assessment Roll and final -estimate for the grading of Portage avenue from the I. I. & I. Viaduct to the City Limits, under Improvement Resolution No. 258. In the above matter remonstrances were filed and remonstrators appeared. The Board being adtised find that said roll should be amended. The Board therefore find that the property assessed in said rollt filed December 19th 1905, is benefitted in the amount of assessments as shown on said roll, as amended. Therefore the Board find that the assessment roll filed December 19th, 1905, as amended., and the final estimate allowed December 19th, 1905, should be and the same is hereby in all things ratified, Confirmed and approved. Eight (8)2 Sixteen (16), Seventeen (17), Eighteen (19), Nineteen (19), Twenty (20), Twenty one (21), and Twenty-two (22), and all of Harlin Court from Washington street to the south line of Jefferson street. That part of the alley lying east and. west along the North side of said lot Sixteen that lies between the northeast corner of said Lot Sixteen and Harlin Court; All of Jefferson street lying between the west line of Harlin Court and the cen- ter line of Cherry street, except the parcel thereof bounded by aline running as follows: Beginning at the intersection of the center line of Cherry street and the North line of Jefferson street; thence running west to the Southeast corner of Lot Twenty-two (22); thence South Sixteen (16) feet; thence east;to the center line of Cherry street; thence North to the place of beginning. In the above matter no remonstrantors appeared and no remonstrances were filed. The Board therefore declare the above described property in all things vacated. The property of A. G. Harlin is benefitted in the amount of $25.00. No property is injuriously affected. The property of A. G. Harlin is therefore assessed in the amount of $25.00. Now comes A. G. Harlin and waiving notice of assessment under Vacation Resolution No. 40, pays u-'1to the treasury of said City the sum of $25.00 VN-OU President.. 871 Saturday January 27th, 19M. Communication received from the Common Council inclosing proposed amendments to the franchise of the Indianapolis, Logansport and S. Bend Traction R. R. Co. President. 37 The Board met in Regular session at 10.01clock A.M. Mr.Papezinski.Absent. Remonstrance filed against the Pavement of Leland Ave.from Marion street to Portage Ave. Petition filed for Pipe SeWer on Chesnut street,from Washington street to L.S & M.S R R:Co tracks,same was referred to the Engineer for specifications.
