Mr. Papczynski absent. Routine business only transacted. President. 226" relay November 4th. 1905. The Board zPt in regular session at 10 A. M. Mr. Papczynski. absent. IMPROVEMENT RESOLUTION NO. 304. Resolved by the Board of Public Works of the City of South Bend, Indiana: That an,improvement be made of the k�nd, size, location and terminal points as follows; A Trunk Sewer in and along Kenwood avenue and Meade street from Johnson street to Linden avenue. Said improvement shall be known and designated as "THE KENWOOD AVENUE AND MEADE STREET TRUNK SEWER" and shall be constructed according to the plans and specifications prepared by the City Civil Engineer, filed herewith. Notice of this resolution shall be published on the 9th day of November and on the 16th day of November, 1905, in the South Bend Daily Times. This Board will give a hearing on this resolution at its office in the City Hc.11 on the 21st day of November, 1905. at 7:15 P. M. A Bond or Bonds to be issued to the Contractor in payment for such work where the property owner signs waiver required as according to law. Adopted this 4th day of November, 1905. President. 32 FFriday November loth, 1905. The Board met in regular session at 10 A. M. All members present. Bids were opened and referred to the Engineer for tabulation for Dayton street Grading. Petition filed by Toefi1 Bidnorowicz for vacating a certain street (nunamed) running test from Prairie avenue. Petition filed for light at the corner of Michigan avenue and Allen street. Renewal of the South Bend Electric Co's Bond filed and approved. Bonds of H. DeVos & Co filed and approved for Dayton street Pipe Sewer and the west Jefferson street Pipe Sewer. Contracts signed for same. Engineer reported grade on Quincy street, Vassar avenue and Cleveland avenue. Same were approved. Engineer filed Assessment Rolls and final estimates for the following improvements, to -wit: -- Pipe Sewer on Wayne street from St. Louis street to St. Peter street, Grade, Curb & Walk on Harper court from Vistula avenue to River avenue, Grade, Curb & Walk on River avenue the full length, Grade, Curb & Walk & Macadam on Foote street from Michigan street to Lafayette street, Grade, Curb & Walk on Eddy street from South Bend avenue to St. Vincent street. All under Im.proveMent Resolutions Nos. 277, 2992 299, 267 & 269 respectively. Also Sewer and Water Connections on Tutt street from Lafayette street to the C. & S. B. R. R. Resolved, that notices as to the amounts of assessments be published for six consecutive days in the South Bend Daily Times, commencing on the llth day of Nov- ember, 1905, stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the 21st, day of ?November, 1905 at 7:15 P. M' Resolved, further, that the entire work under the above contracts be accepted and approved and the final estimate thereon allowed. Notice of this resolution shall be published on the llth day of November, 1905, in the South Bend Daily Times stating that this Board will give a hearing on.the acceptance of such work at its office in the City Hall on the 21st day of November, 1905, at 7:15 P. Petition filed asking that the Cushing addition sewer be cleaned. Street Commissioner was instructed to do the same. Petition filed for Pipe Sewer.on N. Walnut street and ,Linden avenue from. Fassnacht avenue to Birdsell street. Referred to Engineer for Specifications. Plat of Wards Sub -Division of Lots 10 & 11 Muessel addition filed and approved. Petition filed for light at the corner of Miami street & Penn avenue. Referred to Street Commissioner for investigation. Hearing given, on Vacation Resolution No. 39 (Columbia street) Rescinded. President. TUESDAY EVENING SPECIAL SESSION NOVEMBER 14TH, 1905, AT 7:15,P. M. The Board met in Special Session at 7:15 P. M. All members present. Hearing on Asse!:-sment Roll and final estimate for Arnold street Brick Pavement, under Improvement Resolution No 243, deferred until Wednesday morning November 15th, 1905, at 10 A. M. Y President. November 15th, 1905. The Board met in regular session at 10 A. 14. All members present. Petition filed by George Beutter asking to be refunded the amount of $20.00 for a defective sewer tap in front of his property at No. 1925 S. Michigan street.- Referred to the Common Council. Hearing given on Assessment roll and final estimate for the Arnold street Brick Pavement. Under.Improvement Resolution No. 24.3. No remonstrators appeared and no remonstrances were filed. The Board therefore find that the 'property assessed in said rolls filed. September 19th,-1905, is:b.enefitted in tha amount of assessments as shown on said rols and the Board find that the assessment roll filed September 19tn, 1905, and the final estimate allowed September l9th2 1905, should be and the same is hereby in all thisgs, ratifies?, confirmed and app-°oved. Guarantee Bond for Arnold street Brick Pavement. B 0 N D. Five Year Guarantee. KNOW ALL MEN BY THESE PRESENTS, That John Siders and John Sidmon as principal and John K. Hadley and Canton Hollow Brick Company as sureties are hereby lend and firmly bound to the City of South Bend, Indiana, in the sum of ONE THOUSAND ($1,000.00) Dollars, for the payment of which well and truly to be made, t:iiey jointly'and severally bind themselves, their heirs, executors, administrators and assigns by these presents. The conditions of the above obligations, and the consideration therefor, are such, that whereas the above bound John Siders and John Sidmon have completgd the work under the contract for paving Arnold street from Division street to Semple .street, under Improvement Resolution No. 243 adopted by the Department of Public Works of the City of South Bend, on the 29 day of March, 1905; and whereas a remonstrance from the property owners of said street has been filed, remonstrating against the acceptance of said work, owing to alleged imperfect -tons in workmanship, and alleged inferiority of the brick used on said street; and whereas a doubt exists in the minds of the said Board of Public Works as to the advisibility of accepting said work; NOW THEREFORE to induce the acceptance of said work and Improvement in the manner in � which it has been done, the said principals and sureties hereby execute,$ and deliver this bond and guarantee. And if the above bound John Siders and John Sidmon shall, for a period of five years from date, maintain such pavement, and during such time shall make all repairs which may neecessary from roijting, crumbling ardisintegration of the materials, or which are caused by any imperfections in workmanship, and shall strictly observe and abide by Obligations contained in Section 41 to 45 inclusive of the General Specifications (Form C) for street improvements, hereto attached, adopted by the Department of Public Works for the City of South Bend, and shall fulfill all conditions and stipulations therein contained, then these obligations shall be void, otherwise to remain in full force and effect. The Guarantee of John K. Hadley and Canton Hollow Block Company to extend only to furnishing material for needed repair to South Bend, Indiana. Hoffman Cement Veneer Brown Colored Brick to be _ used. Contract awarded to the Standard Electric Company for thee- electrical wiring of the No. 3 Hose House, contract price $39.00. Contract awarded to W. 11. Burke for the plumbing for the No. 3 Hose House contract price of $467.00 Contract awarded to Burner & Company for the No. 9 hose House, contract price of 8429g3.00 Contract awarded to W. TT. Burke for the plumbing on the No. S Hose House, contract price,of 609.00 Contract awarded to Sam Moran for the electrical wiring for the No. S Hose House, contract price of W.00 City Attorney and City Engineer advised the Board in the mat-Iter of the sidewalk on Cedar street along the Strickler property stating that the sidewalk is encroaching upon private property. The following petitions were referred to the Engineer for specifications, the work to be done in the Spring of 1906. Sidewalks on S. Contract signed for same.. Engineer filed Assessment Rolls and final estimates for the following improvements;- Pipe Sewer on Allen stret, Vassar and Blaine avenue from Portage avenue.to Quincy street, Cement Walk & Curb on Miner street from Eddy street to Arthur street. All under Improvement Resolutions No. 276, 255 respectively. Resolved, that notices as to the amounts of assessments be published for six consecutive days in the South Bend Daily Times and the South Bend Daily Tribune, com- mencing on the 21st day of November, 1905, stating that this Board will give a hearing on the amount ofsuch assessments at its office in the City Hall on the 5th day of December, 1905, at 7:15 P. M. Resolved further, that the entire work under the above contracts be accepted and approved and the final estimate thereon allowed. Notice of this resolution shall be published on the 21st day of November, 1905, in the South Bend Daily Times and the South Bend Daily Tribune, stating that this Board will give a hearing on the acceptance of such work at its office in the City Hall on the 5th day of December,.1905, at 7:15 P.M. Hearing on Declaratory Resolution for Kenwood avenue &.Meade street Trunk Sewer under Improvement Resolution No. 304, deferred until November 29th, 1905, at 10 A. M. Hearing given on Assessment Roll and Final estimate for the following; improvements: — Grade, Curb & Talk on. Harper Court from Vistzla avenue to River?,avenue Grade, Curb & Walk- on River avenue full length, Grade, Curb t- Walk on Eddy street from South Bend avenue to St. Vincent street, Pipe Sewer on Wayne street from St.. Uouis street to St. Peter street, Grade, Curb, Walk & Macadam on Foote street from Michigan street to Lafayette street, all under Improvement Resolutions Nos. 2F82 2992 269, 277 & 267 respectively. Also sewer and water connections on W. Tutt street from Lafayette street to the Chicago & South Bend R. R. No remonstrators appeared and no remonstrances were filed. The Board therefore find that the property assessed in said rolls filed November loth, 19052 is benefitted in t-Le amount of assessments as sn.own.on said rolls and the Board find that the assessment rolls filed November, 19, 1905, and the final estimate allowed November loth, 1905, should be and the same is hereby in all things ratified, confirmed and approved. 35 Wednesday November. 22nd, 1905. R., Brick Pavement on Alley West of No. 2 Hose House from Sample street to Tutt street, Water connections on Rea street from Leland avenue to Portage avenue, Sewer and Water connections on Ashland. avenue from Leland avenue to'Rex street, -all under Improvement Resolutions Nos. 2971 295, 2s67 293 & 295 respectively. Resolved, that notices as to the amounts of assessments be published for six consecutive days in the South Bend Daily Times commencing on the 25th day of November, 1905, stati-ig that this Board will give a hearing on the amounts of such assessments at its office in the City Hall on the 5th day of December , 1905, at 7:15 Resolved further, that the entire work under the above contracts be accepted and approved Andthe final estimate thereon allowed. Contract signed for same. Contract signed with the Standard Electric Company for wiring.of No. 3 Hose House. President. 38S The Board met in regular session at 10 A.-M. All members present.. Permission given to Mr. Smith to occupy a portion of Broadway street temporarily. Bond of E. Burner & Co filed and aoproved for the oonstruction of the No. 9 Hose House. Contract signed for the same. Remonstrance filed against the Crescent avenue pipe sewer. Hearing given on Declaratory resolution for Trunk Sewer on Kenwood avenue and Meade street from Johnson street to Linden avenue under Impro vement Resolution No. 304. In the above matter no remonstrators appeared and no remonstrances were filed. The Board therefore find in each and every case in said improvements that the benefits to the property and to the City of South Bend are equal to the estimated cost of said improvements and the same are hereby in all things ratified, confirmed and approved. Engineer filed estimated cost as follows: Kenwood avenue & Meade street Trunk Sewer...'$26,600.00 Be it resolved that notices be published in the South Bend Daily Times on the 29th day of November and on the 6th day of December, 1905, to the effect that this Board will receive bids for said improvements up to 10 a. m.'on the 20th day of December, 1905.
