Zoning and Annexation Committee
The October 11, 2004 meeting of the Council's Zoning and Annexation Committee was
called to order by its Chairperson, Council Member Ervin Kuspa, at 3:46 pm in the Council
Informal Meeting Room.
Persons in attendance included Council Members Kirsits, Pfeifer, Kelly, Puzzello,
Varner,Kuspa,Coleman,Dieter, and White,City Clerk John Voorde,Andy Laurent,Community
& Economic Development Executive Director Sharon Kendall and Kathleen Cekanski-Farrand,
Council Attorney.
Council Member Kuspa noted that the Committee consisted of Council Members
Puzzello,Kelly, Coleman and himself. .
Council Member Kuspa stated that the Petitioners for Bill No. 04-81 which is the
annexation request of Steve and Jean Cooreman, have requested that the Bill be continued until
November 8,2004(October 6,2004 letter attached).
Council Member Coleman made a motion, seconded by Council Member Kelly that Bill
No. 04-81 be continued until November 8, 2004, at the request of the petitioners. The motion
passed.
Council Member Kuspa noted that Michael J. Danch, President of Danch, Harner &
Associates sent a letter dated October 5, 2004 (copy attached) requesting that Bill No. 28-04
which is the rezoning request for the property located in the 21300 block of Cleveland Road be
continued until November 8,2004.
Council Member Puzzello made a motion, seconded by Council Member Kelly that Bill
No. 28-04 be continued until November 8, 2004, at the request of the petitioners. The motion
passed.
Council Member Kuspa noted that Michael J. Danch, President of Danch, Harper &
Associates sent a letter dated October 5, 2004 (copy attached)requesting that Substitute Bill No.
47-04 which is the rezoning request of Bruno & Rosa Cataldo & Teresa Bova for property
located in the 2600 block of Prairie Avenue be continued until the December 13, 2004 meeting.
Council Member Puzzello made a motion, seconded by Council Member Kelly
that Substitute Bill No. 47-04 be continued until December 13, 2004, at the request of the
petitioners. The motion passed.
The Council Attorney noted that she will be unable to attend the December 13th
Common Council meeting, however has talked with Assistant City Attorney Aladean DeRose,
who has agreed to be present for that meeting.
Council Member Kuspa stated that the Council has received a letter dated October 11,
2004 (copy attached) from Terance D. Lang of Lang, Feeney and Associates, Inc., which

addressed a petition for a special exception and variances for St. Mary's of the Holy Rosary
Polish National Church,requesting that Bill No. 04-112 be continued until the October 25, 2004
Council meeting.
Council Member Coleman made a motion, seconded by Council Member Kelly that Bill
No. 04-112 be continued until October 25, 2004, at the request of the petitioners. The motion
passed.
Under miscellaneous business, the Council Attorney stated that at tonight's Common
Council meeting there will be first reading on Bill No. 67-04 which would create the Chapin
Park Historic Preservation District. She noted that work began on this project under former
Council Member James Aranowski and has continued under Council Member Dieter. The new
zoning ordinance will require the Council to refer the Bill first to the Historic Preservation
Commission for review and recommendation; and then have it referred to the Area Plan
Commission for review and recommendation. She added that she has had discussions with John
Byorni, Assistant Executive Director of Area Plan last week, and that state law continues to
require that such a bill be sponsored either by the Council or initiated by 51% of the property
owners. By bringing this matter to the attention of the Zoning and Annexation Committee, we
would then be able to confirm that for purposes of complying with state law, that the Bill would
be sponsored by the Council.
Council Member Dieter then provided a copy of a letter dated August 31, 2004 (copy
attached) which was sent to all of the affected property owners in the proposed Chapin Park
Historic Preservation District. He noted that the Historic Preservation Commission will hold
their public hearing on October 18,2004.
Wayne Doolittle of the Historic Preservation staff then provided spiral-bound"Guideline
for Chapin Park Proposed Local Historic District"(copy attached).
There being no further business to come before the Committee, Council Member Kuspa
adjourned the Committee meeting at 3:53 p.m.
