Committee Report.
The October 25, 2004 meeting of the Zoning and Annexation Committee was called to
order by its Chairperson, Council Member Ervin Kuspa at 3:55 p.m. in the Council Informal
Meeting Room.
Persons in attendance included Council Members Pfeifer, Kelly, Puzzello, Kirsits,
Varner, Kuspa, White and Coleman; Mayor Stephen J. Luecke, City Clerk John Voorde, Rita
Kopala, Building Commissioner Don Fozo, Terry Lang, Bernie Feenie, and Kathleen
Cekanski-Farrand,Council Attorney.
Council Member Kuspa noted that the Zoning and Annexation Committee Members
include Council Members Puzzello,Kelly, Coleman and himself.
Council Member Kuspa called for a presentation on Bill No. 04-112 which would
approve a petition of the South Bend Board of Zoning Appeals for the property located at 1601
West Sample Street.
Bernie Feeney of Lang, Feeney & Associates, Inc., with offices at 715 South Michigan
Street in downtown South Bend made the presentation. He noted that his partner Terry Lang
was also present. Their client is St. Mary's Parish who has been located at 1601 West Sample
Street since 1914. He provided a copy of a map showing the existing building and the planned
parking lot across the 12'alley which is proposed(copy attached). If the petition is approved the
congregation will be able to park cars in the parking lot instead of along the street.
Building Commissioner Don Fozo stated that the Board of Zoning Appeals held a public
hearing on September 16, 2004 and send the petition to the Council with a favorable
recommendation.
Council Member Kuspa opened the hearing to the public. No one spoke in favor or
opposed to the bill.
Council Member Coleman made a motion, seconded by Council Member Kelly that Bill
No. 04-112 be recommended favorably to Council. The motion passed.
There being no further business to come before the Committee, Council Member Kuspa
adjourned the meeting at 3:59 p.m.
