HomeMy WebLinkAbout12-13-04 Zoning & Annexation • The Zoning and Annexation Committee of the South Bend Common Council Minutes from Meeting of December 13, 2004 The December 13, 2004 meeting of the Common Council's Zoning and Annexation Committee was called to order by its Chairperson,Council Member Ervin Kuspa,at 3:30 p.m.in the Council Informal Meeting Room. Persons in attendance included Council Members Coleman,Dieter,Kelly,Pfeifer,Puzzello, Varner and White; Community Development Planner George Adler; Registered Land Surveyor Bernard Feeney; Economic Development Planner Andy Laurent; Area Planner Andy Videkovich; Economic Development Executive Director Sharon Kendall;Mrs.Gladys Kopola;Michael J.Danch, Danch Hamer&Associates, and Aladean M. DeRose substituting for Council Attorney Kathleen Cekanski-Farrand. A full quorum of the Committee existed with all members present,namely Council Members Coleman, Kelly, Kuspa and Puzzello. A. Bill No. 04-128 - A Resolution to Adopt a Fiscal Plan for an Annexation Area in German Township The first matter on the Committee's agenda concerned a Resolution to adopt a written fiscal plan and establish a policy for services to be provided in a German Township annexation area, namely the Gregory A. Kizer annexation area. Community Development Planner George Adler made the presentation. He stated that this was a voluntary annexation of about 23 wooded acres south of Brick Road. The ultimate plan is to divide the property into 46 single-family lots which will be in the first councilmanic district. Sewer service is available at Cross Creek and existing police and firefighters can serve the area. Committee members had no questions for Mr. Adler and no persons spoke in favor or against this Bill. Committee Member Coleman made a motion, seconded by Member Kelly that Bill No. 04-128 be sent to the full Council with a favorable recommendation. The motion passed unanimously. B. Bill No. 51-04 - Ordinance to Annex Twenty Plus Vacant Acres in German Township (Gregory Kizer Annexation Area) Mr. Bernard Feeney, Registered Land Surveyor, made the presentation. He provided Committee Members with a copy of the layout plan for a 46 lot subdivision. This subdivision will connect to the Cross Creek sewer and water; a north-south road will be built within the area to connect to Brick Road. A storm water system has been provided and will adequately serve the area. Committee Member Dieter asked for the approximate cost of the lots. Mr. Feeney replied that although Gregory Kizer is the owner,the subdivision will probably be developed by Garden Homes with an estimated price range of$120,000.00 per home. A discussion then ensued as to the distance between the proposed subdivision and an existing subdivision which was estimated to be about 40 acres. Committee Member Kelly made a motion, seconded by Committee Member Coleman that Bill No. 51-04 be sent to the full Council with a favorable recommendation. The motion passed unanimously. C. Bill No.66-04-Amendment of the Zoning Ordinance for Property Located at 727 South Eddy Street Area Plan Commission Planner Andy Videkovich made the presentation to the Committee. He stated that when the zoning map for the new South Bend Zoning Ordinance was adopted, the property at 727 South Eddy Street (formerly The Newman Recreation Center) was overlooked for a zoning classification. The proposed ordinance would establish a"Mixed Use"zoning classification for this property. Such classification is proper because it accurately reflects the use of other buildings in the immediate, adjacent area. Committee Member Kelly made a motion seconded by Committee Member Puzzello that Bill No 66-04 be sent to the full Council with a favorable recommendation. The motion passed unanimously. D. Bill No. 47-04 - Ordinance to Amend Zoning for Property in the 2600 Block of Prairie Avenue. Michael J. Danch, Danch, Harper & Associates, presented Substitute Bill 47-04 to the Committee and provided them with a letter dated December 13, 2004 (copy attached). The owner seeks a postponement of public hearing on this Bill to January 10, 2005 in order to meet with adjacent property owners and discuss the owner's revised plan. With the reduced size of the project scope, the owner hopes fewer objections will be raised and the owner seeks time to discuss the matter informally with concerned citizens who opposed the Bill at the Area Plan Commission meeting. Committee Member Puzzello made the motion seconded by Committee Member Coleman to accept the second Substitute Bill and schedule it for public hearing and third reading on January 10, 2005. The motion passed unanimously. There being no further business to come before the Committee, Council Member Kuspa adjourned the meeting at 3:47 p.m.
