Public Works and Property Vacation Committee
The July 26,2004 meeting of the Public Works and Property Vacation Committee was
called to order by its Chairperson,Dr. David Varner at 5:42 p.m. in the Council Informal
Meeting Room. Persons in attendance included Council Members Dieter,Pfeifer, White, Kelly,
Puzzello, Varner,Kuspa, Coleman and Kirsits; City Clerk John Voorde,Rita Kopola, City
Engineer Carl Littrell,Public Works Director Gary Gilot,Bruce Bancroft,Doug Marsh,Terry
Bland of the South Bend Tribune and Kathleen Cekanski-Farrand, Council Attorney.
Dr. Varner noted that the Committee consists of Council Members Kirsits,Pfeifer,
Coleman and himself.
Dr. Varner called for a presentation on Bill No. 40-04 which would vacate a portion of
the south half of Angela Boulevard from Notre Dame Avenue for a distance of 930' and a width
of 40' and a portion of the west half of Eddy Street from Angela Boulevard south for a distance
of 380'. Dr. Varner noted that the Board of Public Works has reviewed the request and sends a
favorable recommendation as evidenced by its letter of July 8, 2004 with attachments(copy
attached).
Bruce R. Bancroft, an attorney with offices at 100 North Michigan Street in downtown
South Bend made the presentation along with Doug Marsh. They noted that the vacation is
necessary in order to facilitate the development of the University of Notre's campus plan. It
would also improve traffic safety by eliminating the S-curve between Notre Dame Avenue and
Eddy Street, as well as facilitate the re-alignment of Edison Road. Future developments along
Eddy Street as a potential mixed-use commercial/residential district would also be enhanced.
The University of Notre Dame will pay for the engineering and construction costs of the new
road. All of this is consistent with the Master Plan for the University..
In response to a question from Council Member Coleman, it was noted that there would
be a light at the intersection at Twyckenham. In response to a question from Council President
White regarding right-of-ways,Mr. Marsh stated that the current streets would remain open until
the new roads are constructed.
Council Member Coleman made a motion, seconded by Council Member Kirsits that Bill
No. 40-04 be recommended favorably. The motion passed.
There being no further business to come before the Committee,Dr. Varner adjourned the
Committee meeting at 5:53 pm
