North: To the north, across Adams Road, is a tilled agriculture field zoned NC Neighborhood Center. East: To the east, across the St. Joseph Valley Parkway (bypass), are industrial warehouses zoned I Industrial South: To the south are residential properties zoned R Residential in the County. West: To the west are residential properties zoned R Residential in the County. District Intent: The I District is established to provide a location for medium- to high intensity industrial uses, typically grouped along highways and major streets and separated from residential uses. Site Plan Description: The current site plan shows a new service center including approximately 98,000 SF office and garage building and 15,000 SF detached vehicle storage building. A substation will also be located on the NE corner of the site. Zoning and Land Use History and Trends: The property was initially annexed into South Bend in the early 2000s and included as part of the Portage Prairie PUD. The development was predicated on a proposed interchange at Adams Road and the the US-31 bypass with the intention of creating a mixed use development to support apartments and other mixed use growth west of the interchange. This development did not materialize leading to the property remaining agriculture in use despite being zoned mixed- use. With the new Zoning Ordinance in 2020, any property zoned PUD was paired with the district most closely related to the intended uses and development standards. Because the area west of the bypass was intended to have a mix of uses, the properties were assigned to Neighborhood Center District. The surrounding area east of the bypass has become heavily industrial with a large increase in companies in the past decade. Traffic and Transportation Considerations: Adams Road is two lanes with no on-street parking. The St. Joseph Valley Parkway (bypass) is a limited access freeway. At this time, there seems to be little interest from INDOT in constructing the Adams Road interchange. Agency Comments: There are no additional comments at this time. Staff Comments: While AEP does not need to rezone the property to operate the substation, the I Industrial District is appropriate for the adjacent service center. The property is centrally located for the AEP service area with easy access to major roads, allowing them to service the public in a more timely manner. Land Use Plan: The Future Land Use Plan identities this area for Mixed Use. Plan Implementation/Other Plans: There are no other plans specific to this area. 2.Current Conditions and Character: While the proposed development was annexed with the intent of being a mixed use area, the highway interchange needed to make that successful never materialized. The area is currently rural residential and agricultural. 3.Most Desirable Use: The most desirable use, as this time, is a use more compatible with the growing industrial and distribution growth seen east of the bypass. 4.Conservation of Property Values: The I Industrial District includes buffering requirements designed to mitigate the impact on surrounding property values. 5.Responsible Development and Growth: It is responsible development and growth to allow for the site to be used in a similar manner to properties east of the bypass. As the land is already annexed into the City Limits, using the land to its highest and best use is responsible development for the City. Variance(s) The petitioner is seeking the following variance(s): 1) from the required durable dust free surface for outdoor storage to gravel State statutes and the Zoning Ordinance require that certain standards must be met before a variance can be approved. The standards and their justifications are as follows: (1) The approval will not be injurious to the public health, safety, morals and general welfare of the community. Due to the distance of the parking lot from any accessible public right-of-way and being bounded by a limited access highway with no direct access from the site, the negative impacts of a gravel parking lot are mitigated and should not be injurious to the general welfare of the community. The parking lot will be a considerable distance and buffered from any privately owned adjacent property. This should limit any adverse affects of the gravel parking. The existence of the bypass to the east and large buffering on site should also limit any adverse affects. (3) The strict application of the terms of this Chapter would result in practical difficulties in the use of the property. (5) The variance granted does not correct a hardship caused by a former or current owner of the property. The NC District is typically pedestrian- orientated in scale and well connected to surrounding residential neighborhoods. The site will most likely never meet those characteristics, and the mixed use development originally proposed will likely never occur. As a public utility regulation by the IURC, the AEP substation is permitted by right in any district. The zoning ordinance cannot restrict the location of the proposed substation and utility lines. Allowing the site be zoned to the I Industrial District will better suit the use and provide additional protections for adjacent property owners through increased buffering. Recommendation: Based on information available prior to the public hearing, the staff recommends the Plan Commission send the rezoning petition to the Common Council with a favorable recommendation. The site is well suited for Shared Housing as it is near to the Notre Dame campus. This site is currently being used for student rentals, with the majority of the units occupying more than 2 unrelated individuals. The demolition of the current older units for new apartments used in a similar manner should not have an injurious impact on the general welfare of the community. (2) The proposed use will not injure or adversely affect the use of the adjacent area or property values therein; The proposed use will lead to a large investment in a property which is nearing the end of its forecasted life cycle. The proposed use of Shared Housing is consistent with the use currently on the site. Developed in compliance with the ordinance, the proposed development will allow reinvestment in the property, which should not adversely impact use or value of surrounding properties. (3) The proposed use will be consistent with the character of the district in which it is located and the land uses authorized therein; The proposed use of Shared Housing is consistent with the character of the surrounding area which has a large presence of existing apartments and student rentals. The redevelopment of the site will further bring the property inline with the new zoning standards in place since 2020. (4) The proposed use is compatible with the recommendations of the Comprehensive Plan. The proposed use is compatible with the Comprehensive Plan. The Comprehensive Plan recommends "Encourage residential developments to contain a mix of housing types, densities, price ranges, and amenities. (Policy H1.1) This proposed development is in line with the recommendation from the Comprehensive Plan by helping establish a mix of housing types across several different size options ranging from studios to four bedroom apartments. State statutes and the Zoning Ordinance require that certain standards must be met before a variance can be approved. The proposed variances are for portions of the site not visible from public right- of-way. All buildings will be designed to current building and fire codes. (2) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner The use and value of the adjacent properties should not be adversely affected by the variance to allow the interior buildings to exceed 120' maximum width. This is a primarily commercial, mixed-use, and multi-family residential area. The proposed development is consistent with the surrounding area. (3) The strict application of the terms of this Chapter would result in practical difficulties in the use of the property The strict application of the ordinance would make it difficult to develop the interior portion of the sign in a way that allows an adequate mix of parking and residential units. The largest building interior to the lot surrounds a parking garage and will not be visible from the public right-of-way. (4) The variance granted is the minimum necessary The variance requested is based on the interior building, which is designed around a parking garage. The buildings adjacent to the public right of way have been designed to comply with the ordinance. (5) The variance does not correct a hardship cause by a former or current owner of the property The hardship is generally created by the overall size of the parcel. The proposed variance will allow the efficient development of the site without impacting the portion of the site visible from the public street. Analysis: Allowing the proposed use of Shared Housing will further the ability to redevelop the site and add investment to the area. The site is currently used as student housing in a development nearing the end of its life cycle. The proposed use will lead to a large investment into the area without significantly changing the current land use. The redevelopment will bring this 11 acre parcel into compliance with the updated development standards established in the current Zoning Ordinance. Approving the variance for the interior portion of the site will allow for more flexibility in design and support the construction of a garage to support the increased density. By maintaining code compliant buildings on the interior of the lot, the development reflects the intent of the Ordinance to the general public. Staff Recommendation: Based on the information available prior to the public hearing, the Staff recommends the Board send the Special Exception to the Common Council with a favorable recommendation. It was enacted in 1986 and slightly amended in 1988. The purpose of this ordinance is to adjust for substantially changed conditions and circumstances since 1988, including an increase in truck traffic, the 2016 conversion of downtown streets to two-way, and the addition of roundabouts. This ordinance makes such adjustments by adding more truck routes, addressing truck marking and lighting, and regulating different weights and contents of truck loads through a permit process, among other things. This ordinance promotes the public health, safety, and economy of South Bend and is in the best interest of its citizens. Now, Therefore, Be It Ordained by the Common Council of the City of South Bend, Indiana as follows: Section I. Chapter 20, Article 8 of the South Bend Municipal Code shall be amended to read as follows: Sec. 20-106. – Definitions a) As used in this article Article, the following terms shall mean: (1)Truck, as the term is used in this section, is a vehicle having three (3) axles or a vehicle over ten thousand [pounds] (10,000) gross vehicle weight, and includes semi-trailer trucks and either the tractor pulling the same, or the trailer itself. Truck includes every self- propelled commercial vehicle designed, used or maintained for the commercial transport of goods or property. (2)City Block, as the term is used in this section, is that portion of a public street bounded by the highest and lowest numbers within any sequence of 100s, such as 200 to 299, 300 to 399, etc. 2 (3) Hazardous Material is any item or agent (biological, chemical, radiological and/or physical), which has the potential to cause harm to humans, animals or the environment, either by itself or through interaction with other factors. (4) Oversize Vehicle is any vehicle that exceeds: (i) 13 feet 6 inches in height, or (ii) 8 feet 6 inches in width, or (iii) 40 feet in length for a single vehicle, or (iv) 60 feet in length for a two-vehicle combination, or (v) 68 feet for a truck-trailer or truck-wagon combination (5) Overweight Vehicle is any vehicle that exceeds: (i) 80,000 pounds gross vehicle weight, or (ii) 12,000 pounds on the steering axle, or (iii)20,000 pounds on a single axle, or (iv)34,000 pounds on a tandem axle, or(v) 800 pounds per inch of rim width and subject to the axle weights above (6) Superload Vehicle is any vehicle that exceeds: (i) 15 feet in height, or (ii) 16 feet in width, or (iii) 110 feet in length, or (iv) 120,000 pounds gross vehicle weight b) This article also applies to any vehicles manufactured, assembled, or modified on a commercial or military basis and transported or operated on/in the streets of the City of South Bend. Such vehicles must be so operated on truck routes in accordance with this ordinance. This shall include any and all vehicles manufactured, assembled, modified, transported or operated singularly or in quantity by any business operating in or through the City of South Bend. Sec. 20-107. – Official Routes Established a) No person shall operate a truck or vehicle, as defined in section 20-106 within the corporate limits of the City of South Bend, except upon the following streets and parts of streets shown upon a map entitled “Schedule A-1 “South Bend Truck Route A-1”, incorporated herein by reference, or if the specific conditions of section Section 20-108(c) are met. At least two (2) copies of the map shall be on file in the Office of the Clerk for public inspection. They shall not travel upon any other public streets of the City, except as provided in Section 20-108(c) 20-108.1. Sec. 20-108. – Restrictions (a)No Deviations from the official truck route No person shall drive any truck or vehicle as defined in section Section 20-106 upon any public streets not designated as a truck route in “Schedule A-1 South Bend Truck Route A-1” of the City at any time; provided that such trucks or vehicles may be permitted upon such other public streets of the City, upon the direction of a City or State police officer, to follow a marked and established City detour, to obtain necessary emergency mechanical repairs, or if for safety reasons upon the prior approval of the City Engineer and the Police Department. (b) Shortest truck route. All trucks and vehicles as defined in section 20-106 shall proceed by the shortest combination of State and Federal highways and City truck routes shown upon “Schedule A-1 South Bend Truck Route A-1” and shall be prohibited from driving upon any other City streets unless said vehicle is in the process of delivering or 5 picking up goods or providing a service as further addressed in subsection (c) herein or is itself in the process of being delivered. A written bill of lading or similar document must be produced by the driver if stopped while driving on a City street which is not designated as a City truck route as shown in “Schedule A-1 South Bend Truck Route A-1” or detour route to verify such pickup or delivery. (c) All trucks as defined in section 20-106, when finished delivering or picking up goods within the City, shall return to the nearest truck route by the most direct route, unless the truck has a subsequent delivery or pick-up scheduled within the immediate vicinity for that day. In such cases the truck may proceed to a subsequent pick-up or subsequent delivery location(s) only if all of the following conditions are met: (1) The driver has in his or her possession a written bill of lading or similar document for the next subsequent delivery or will have a pick-up order upon reaching said subsequent pick-up location(s); (2) The driver has in his or her possession a written manifest or similar document which shows in clear and plain English all of the scheduled delivery or pick-up location(s) for that day; and (3) The distance from the first delivery or pick-up location off the truck route to the next subsequent delivery(s) or pick-up location(s) is not greater than a total of nine (9) city blocks from the first delivery or pick-up location. So long as the conditions of this section are met, it is the intent of this section to permit as many subsequent deliveries or pick-ups from the initial location which was off of the designated truck route so long as such subsequent deliveries or pick-ups are within the maximum nine (9) city block distance from the initial delivery or pick-up location. It is the further intent of this section to permit subsequent deliveries or pick-ups by the truck if such subsequent deliveries or pick-ups are on the most direct route back to the designated truck route. (d) Any truck driver who is stopped by a Police Officer on a street which is not designated as a truck route, and who does not have a written bill of lading and a written manifest or similar documents as required by sub-paragraph (c) herein, shall be in violation of this section and shall be issued a citation. (e) The Board of Public Works may designate, from time to time, by proper resolution, specific streets or blocks thereof, where trucks are expressly prohibited due to safety reasons or engineering standards. The City shall post signs prohibiting trucks in such designated locations. Any truck driving in such prohibited areas shall be in violation of this section and shall be issued a citation. (f) No person shall stop, stand or park a truck as defined in section 20-106 on any street, other than for the expeditious loading or unloading of freight, except in cases of emergency when such truck is broken down and unable to move, and except also in the event a moving van is loading or unloading furniture and household goods, or the furniture and equipment and goods, wares and merchandise of a business, in either of which events the operator of such truck will have a reasonable time in which to complete his loading or unloading and move his truck. (c) Subsequent deliveries 6 (1) When a truck has a subsequent delivery or pick-up scheduled within the immediate vicinity for that day, the truck may proceed to a subsequent pick-up or subsequent delivery location(s) only if all of the following conditions are met: (i) The driver has in his or her possession a written bill of lading or similar document for the next subsequent delivery or will have a pick-up order upon reaching said subsequent pick-up location(s); (ii) The driver has in his or her possession a written manifest or similar document which shows all of the scheduled delivery or pick-up location(s) for that day; and (iii)The distance from the first delivery or pick-up location off the truck route to the next subsequent delivery(s) or pick-up location(s) is not greater than a total of nine (9) City blocks the first delivery or pick-up location. So long as the conditions of this sub-Section (c) are met, it is the intent of this sub-Section (c) to permit as many subsequent deliveries or pick-ups from the initial location which was off of the designated truck route so long as such subsequent deliveries or pick-ups are within a maximum distance of one-half mile from the initial delivery or pick-up location. It is the further intent of this sub-Section (c) to permit subsequent deliveries or pick-ups by the truck if such subsequent deliveries or pick-ups are on the most direct route back to the designated truck route. (d) Residential Streets (1)All trucks as defined in section 20-106 when finished delivering or picking up goods or providing a service within the city, shall return to the nearest truck route by the most direct route, except through residential areas with roadway widths less than 28 feet, unless the destination is on such a street. (2) Any truck driver who is stopped by a City or State Police Officer on a street which is not designated as a truck route, and who does not have a written bill of lading and a written manifest, City permit, or similar documents as required by sub- paragraph (c) herein, shall be in violation of this section and shall be issued a citation. (e) Weather Oversize, overweight or hazardous loads shall not move in the City during inclement weather when such weather conditions could cause the movement to become a hazard to persons or traffic, or damage the streets, traffic signals, utility structures, or other property. Should such conditions develop during the movement, the driver shall stop movement of the hazardous, oversize or overweight load, and proceed when conditions have cleared. Frost Law (f) Stopping, Standing, Parking No person shall stop, stand or park a truck as defined in section 20-106 on any street, other than for the expeditious loading or unloading of freight, except in cases of emergency when such truck is broken down and unable to move, and except also in the event a moving van is loading or unloading furniture and household goods, or the furniture and equipment and goods, wares and merchandise of a business, in either of which events the operator of such truck will 7 have a reasonable time in which to complete his loading or unloading and move his truck. Sec. 20-109. – Regulations a) The Board of Public Works may designate, from time to time, by proper resolution, specific streets or blocks thereof, where trucks are expressly prohibited due to safety reasons or engineering standards. The City shall post signs prohibiting trucks in such designated locations. Any truck driving in such prohibited areas shall be in violation of this Section and shall be issued a citation. b) The Board of Public Works has the authority to approve truck routes via permit that deviate from the official truck routes established for the cases listed in Section 20- 108.1(a). Permits for such cases are managed and issued by the City Engineer’s office. c) Special Authority (1) The City Engineer for public safety and traffic control shall have the authority to designate the routes to be followed by trucks or truck-trailer combinations, by private, common and contract carriers or by any other person transporting hazardous material, as defined in Section 20-106, in the regular course of business and traveling through and making deliveries within the City. Such official of the City shall adopt a route map for transporting such hazardous materials, indicating such designated routes and designated portions of the City and it shall be unlawful for any of the above-described vehicles, carriers or persons to deviate from such routes. (2) The City Engineer’s office is authorized to issue permits for the use within the City of oversize, overweight, and hazardous vehicles, as defined in Section 20- 106. d) Trucks that carry hazardous, oversize and/or overweight loads must have a permit in order to travel anywhere in the City. Such vehicles shall not travel on those streets listed in South Bend Truck Route A-1 without a permit. Sec. 20-109.1 – Exceptions. The provisions of this aArticle do not apply to vehicles: (1) Licensed to operate upon trucks; (2) Licensed to carry passengers for hire; (3) Municipal government vehicles operating on official business; or (4) Public utility vehicles operating on official business. Sec. 20-109.2 – Permits and Liability (a) Permits (1) Permits are managed by the City Engineer’s office. A permit application can be obtained on the City’s website or by calling or visiting the City Engineer’s office, and must be submitted to the City Engineer’s office. (2) A permit fee of $35 dollars will be assessed for a single use permit for oversize, and overweight vehicles and hazardous loads. 8 (3) A permit fee of $50 dollars will be assessed for a single use Superload permit for oversize and overweight vehicles and hazardous loads. (4)A permit fee of $405 will be assessed for an annual permit for oversized, overweight, or hazardous loads that are not Superloads. (b) Liability for Damage (1) Any operator of an oversize, overweight or hazardous load on any City street is liable for all damage to people and property as a result of operating that load, even with a permit. (2) When the driver is not the owner of the vehicle but is operating the vehicle with the permission of the owner, the owner and driver are jointly liable for any damage. Sec. 20-109.5. – Signs The Bureau of Traffic and Lighting is hereby authorized to cause all streets and portions thereof established and designed by this article as truck routes to be clearly marked or signposted at their intersections with other truck routes or boundary lines of the City, with appropriate signs displaying in letters not less than four (4) inches in height the words “Truck Route.” Sec. 20-109.7. – Penalties (a) Any person found in violation of any provision of this Aarticle shall be fined not less than fifty dollars ($50.00) for the first offense, no less than one hundred dollars ($100.00) for the second offense, and not less than two hundred fifty dollars ($250.00) for the third or subsequent offense, with a citation being issued for each violation. (b) In addition to the citation procedure, a fine up to two thousand five hundred dollars ($2,500.00) may be imposed upon conviction adjudication. Section II. This Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor, and any publication required by law. 9 _______________________________ Karen L.
