HomeMy WebLinkAboutResolution No. 180 Transfer of Real Property to South Bend Redevelopment CommissionRESOLUTION NO. 180 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT AUTHORITY AUTHORIZING THE TRANSFER OF REAL PROPERTY TO SOUTH BEND REDEVELOPMENT COMMISSION WHEREAS, the South Bend Redevelopment Authority (the "Authority") exists and operates under the provisions of I.C. 36 -7 -14.5. as amended from time to time, and is a body corporate and politic; and WHEREAS, pursuant to I.C. 36- 1 -11 -8, the Authority, may transfer or exchange property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity: and WHEREAS, the South Bend Redevelopment Commission (the "Commission "). the governing body of the South Bend, Indiana, Department of Redevelopment (the "Department") and of the Redevelopment District of the City of South Bend, Indiana (the "Redevelopment District'), exists and operates under the provisions of I.C. 36 -7 -14. as amended from time to time (the "Act") and is a body corporate and politic; and WHEREAS, the Authority is the owner of certain real property as set forth in Exhibit "A "attached (collectively referred to as the "Property'); and WHEREAS, the Department. by and through the Commission, has presented to the Authority, a request for the transfer to the Commission of the Property; and WHEREAS, the Authority, desires to transfer the Property to the Commission for the redevelopment purposes of the Commission; and WHEREAS, the Authority desires to authorize the staff of the Department to approve and execute all documents necessary to effect the transfer of the Property; and WHEREAS, the Department, through the Commission, will adopt a resolution consistent with the requirements of I.C. 36- 1 -11 -8. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT AUTHORITY AS FOLLOWS: I. The transfer of the following described real property situated in St. Joseph County, Indiana: See Exhibit "A" by the Authority to the Commission, without consideration, shall be, and hereby is, approved and authorized. 2. The staff of the City of South Bend. Department of Redevelopment shall be, and hereby are, authorized to approve the form of and execute quit -claim deeds or any other instruments necessary to convey all of the right, title and interest in the Property to the Commission and are further directed to deliver said quit claim deeds to the Commission for recording in the Office of the St. Joseph County Recorder. 3. Any and all actions taken by the staff. as authorized herein above, are ratified and confirmed. 4. This Resolution shall be in full force and effect upon its adoption and is subject to the passage by the Commission of a Resolution substantially identical to this Resolution. ADOPTED at a meeting of the South Bend Redevelopment Authority held on December 26, 2012. at 227 West Jefferson Boulevard, South Bend, Indiana 46601.
