The Division of Engineering and Division of Utilities requests the Board of Public Works receive and
open quotations for the subject at its October 12, 2021, Regular Meeting.
Background and Purpose
The historic Flood of 2018 impacted the high-water level of the St. Joseph River and ground water
table at Leeper Park and the North Pumping Station. The resulting high ground water table resulted
in infiltration through the lower basement (pump room) walls in the North Pumping Station. Frost
Engineering & Consulting previously assisted in the initial structural investigation of the building and
provided its initial report findings under a previous agreement.
Plans and Specifications for the repairs to the North Pumping Station building include re-bedding
the 30” water distribution pipe from the exterior of the building, grout injection, masonry tuck
pointing, masonry closure work inside the building, concrete sidewalk restoration, and curb
restoration.

As directed by the City Controller, the project is funded out of Liability Insurance Account 226-
04-405-414-443001.

SCOPE OF WORK

PROJECT NAME: North Pumping Station – Flood Damage Repairs

I. PROJECT DESCRIPTION
A. The project includes the furnishing of all equipment, material, insurance, and labor for the demolition
of concrete sidewalk and curb, masonry repairs, excavation and pipe embedment, concrete
curb, and concrete sidewalk restoration within the City of South Bend, IN. The North Pumping
Station is located at 830 North Michigan Street, South Bend, Indiana 46601
II. PREVAILING SPECIFICATIONS AND CONSTRUCTION STANDARDS AND SPECIFICATIONS
A. The City of South Bend's PREVAILING SPECIFICATIONS, most recent version, and
CONSTRUCTION STANDARDS AND SPECIFICATIONS, most recent version, are to be used on this
project.
B. Each Quote provider is specifically instructed to become completely familiar with the most recent
version of the PREVAILING SPECIFICATIONS and the CONSTRUCTION STANDARDS AND
SPECIFICATIONS prior to submitting a quote.
C. Wherever the PREVAILING SPECIFICATIONS refer to “State Specifications,” it shall mean the 2020
INDOT Standard Specifications for the letting effective after September 1, 2019.
D. These SPECIAL PROVISIONS will list only "Additions" or "Deletions" to the PREVAILING
SPECIFICATIONS and are to be used only in conjunction with the PREVAILING SPECIFICATIONS.
E. In the event of conflict between the SPECIAL PROVISIONS and the PREVAILING SPECIFICATIONS,
the SPECIAL PROVISIONS will govern.
III. QUOTATION REQUIREMENTS
A. Prevailing Specifications: 2020, INDOT Standard Specifications 102
B. Additions:
1. Each Quotation provider shall completely execute and submit the following documents with the
Quotation.
a. City of South Bend Contractor’s Quote for Public Work Form
b. Bid/Quotation Bond stating 5% of the total Bid/Quote or Certified Check of 5% of the Bid/Quote.
c. Contractor’s Non Collusion and Non-Debarment Affidavit, Certification Regarding Investment
with Iran, Employment Eligibility Verification, Non-Discrimination Commitment and Certification
of use of United States Steel Products or Foundry Products.
d. Refer to XX. M/WBE Goals section of these specifications for Minority Business Enterprise and
Women Business Enterprise goals for this project. Complete all forms associated with these
requirements and submit with Bid/Quote.
e. Contractor shall submit bids electronically via e-mail to bpwbids@southbendin.gov. Bids must
be received at the Board of Public Works by 9:00 A.M. on October 12, 2021 to be considered
for the work.
IV. TERM “OR EQUAL”
A. Prevailing Specifications: None
B. Additions
1. Where the term "or equal" is used in these specifications, the Quote provider deviating from
specified item shall file with his/her/its Quote a letter fully explaining and justifying his/her/its
proposed article or equal. The City of South Bend shall be the sole judge in determining if the “or
equal” offered meets the specification.

V. TAX EXEMPT
A. Prevailing Specifications: None
B. Additions
1. Materials and properties purchased under contract with the Owner that becomes a permanent part
of the structure or facilities constructed are not subject to the Indiana Gross Retail Tax (Sales Tax).
The exemption number will be furnished to the Contractor upon award.
VI. INDEMNIFICATION
A. Prevailing Specifications: None
B. Additions
1. Contractor agrees to indemnify, defend and hold harmless the City of South Bend, its agents,
officers and employees, from all costs, losses, claims and suits, including court costs, attorney fees,
and other expenses, arising from or out of the negligent performance of this Contract by Contractor,
or because of arising out of any defect in the goods, materials or equipment supplied by the Quote
provider.
VII. INSURANCE
A. Prevailing Specifications: 2020, INDOT Standard Specifications Section 103
B. Additions:
1. All Contractors and subcontractors doing business with the City of South Bend shall present a
Certificate of Insurance showing coverage in the following minimum amount:
a. General Liability: Premises-Completed Operations or Products, Bodily Injury and Property
Damage Combined Single Limit - $5,000,000.
b. There shall be no exclusion for explosion, collapse or underground hazard.
c. Workmen’s Compensation: Statutory State of Indiana Employer's Liability - $100,000.
d. Auto Liability: Bodily Injury and Property Damage Combined Single limit - $1,000,000.
e. The City of South Bend shall be named as additional insured on the Certificate of Insurance.
VIII. CONTROL OF WORK
A. Prevailing Specifications: 2020, INDOT Standard Specifications Section 105
B. Additions:
1. The complete responsibility for this project lies with the Director of Public Works of the City of South
Bend, Indiana acting through his authorized representatives.
2. Construction Engineering - The Contractor shall provide all the necessary, qualified personnel,
equipment and supplies to perform all work required under this item. There will be no direct payment
for this item.
3. The contractor is responsible to maintain the site which includes but is not limited to; dust control,
site security, erosion control, and protecting adjacent properties.
4. Work hours for the Project shall be from 7:00 a.m. through 6:00 p.m., Monday through Friday. No
work shall be permitted on weekends, Holidays, or after hours unless approved by the City of South
Bend Department of Public Works.
IX. LEGAL RELATIONS
A. Prevailing Specifications: 2020, INDOT Standard Specifications Section 107
B. Additions:
1. The Owner, where mentioned in these documents, is the City of South Bend. The Engineer, where
mentioned in these documents, is Frost Engineering & Consulting.

2. The Contractor shall apply for and obtain any and all required permits for the work from local, state,
and federal agencies and shall comply with permit requirements, including the St. Joseph County
/ City of South Bend Building Department.
3. If the Contractor awarded this contract is not a resident of Indiana, within thirty days, the Contractor
shall provide the Owner with proof that the Contractor is duly licensed, qualified and registered with
the Secretary of State of Indiana to engage in business within the State of Indiana.
4. The Contractor shall comply with all provisions of Indiana Code 5-16-13, as amended. The Owner
reserves the right to immediately terminate the public work project awarded should the Contractor
be found to be in violation of any provision of Indiana Code 5-16-13 and such violation shall result
in the forfeiture of Contractor’s performance bond to the Owner.
X. PROSECUTION AND PROGRESS
A. Prevailing Specifications: 2020, INDOT Standard Specifications Sec. 108
B. Additions:
1. The project will have a completion date of November 24, 2021 for exterior work and December
19, 2021 for all interior work. The contract time will start when the Notice to Proceed is delivered
and signed.
2. The City, Engineer, and Contractor will hold a pre-construction meeting following award of the
contract. The date of the Notice to Proceed will be agreed at that meeting.
3. Contractor shall provide a schedule to the Owner prior to beginning any work on the site.
XI. CHANGE OF CONTRACT TIME
A. Prevailing Specifications: 2020, INDOT Standard Specifications Section 108
B. Additions
1. The Contract Time may only be changed by Change Order. Any Claim for an extension in the
Contract Time shall be based on written notice delivered to the Department of Public Works within
seven (7) calendar days of the occurrence of the event giving rise to the claim. Notice of the extent
of the claim with supporting data shall be delivered within fourteen (14) calendar days after such
occurrence unless an official of the Public Works Department allows an additional period of time to
ascertain more accurate data. The Contract Time will be extended in an amount equal to time lost
to delays beyond the control of the Contractor if a claim is made in accordance with this provision.
Such delays shall include acts of neglect by the Public Works employees, or to fires, flood, labor
disputes, epidemics, abnormal weather conditions, governmental procedures, or acts of God.
2. Unless otherwise provided, the Contract time is based upon normal weather conditions. An
extension is granted for weather conditions significantly more severe than normal if the Contractor
demonstrates to the satisfaction of the City that the delay in the progress of the work was due to
such weather. The basis to define normal weather with be the data compiled by the United States
Department of Commerce, National Oceanic and Atmospheric Administration (NOAA).
3. No extension of time will be granted if the Contractor, by his/her/its own action or inaction, including
fault or negligence of Contractor’s subcontractors, caused the delay, or for which any remedies are
provided under any other provision of this agreement.
4. The grant of an extension of time under this Section in no way constitutes a waiver by the City of
any rights or remedies existing under this contract at law or in equity.
XII. DEFAULT AND TERMINATION
A. Prevailing Specifications: 2020, INDOT Standard Specifications Section 108
B. Additions:
1. Events of Default shall include Contractor’s failure to perform any of its obligations under this
contract including failure to commence work at the time specified, failure to perform the work in
accordance with these specifications, unauthorized discontinuation of the work, failure to carry out
the work in a manner acceptable to the City, failure to observe Federal, State, or local laws or
regulations, and failure to comply with any other term of this contract.

2. If an Event of Default occurs, the City shall provide Contractor written notice and may permit
Contractor ten (10) calendar days after the date of the notice to cure the default. If the default is
not cured within the ten (10) day cure period, the City may at any time thereafter terminate this
contract in which case the termination shall be final and effective.
3. Upon an Event of Default, the City may invoke the following remedies in addition to those remedies
provided under separate provisions of this contract, the right of set-off against any payments due
or to become due to the Contractor against the retainage, the right to take over and complete the
Work. If the City notifies Contractor that City is invoking its right to complete the Work, all rights that
the Contractor has in order under Contractor’s subcontracts are assigned to the City, subject to the
City’s right to take assignment of all or only selected subcontracts at the City’s discretion. The sole
obligation accepted by the City under such subcontracts is to pay for Work satisfactorily performed
after the date of the assignment. In the event a conditional assignment has not been executed, the
Contractor shall execute or cause to be executed any assignment, agreement, or other document
that may be necessary in the sole opinion of legal counsel to the City’s Board of Public Works to
evidence compliance with this provision. The Contractor shall promptly deliver such documents
upon the City’s request. In the case of such assignment, unless otherwise agreed in writing, The
Contractor remains liability to subcontractors for any payment already involved, and for any claim,
suit or cause of action based upon or resulting from any error, omission, negligence or other breach
of contract by the Contractor, its officers, employees, or agents arising prior to the date of
assignment to the City.
XIII. LIQUIDATED DAMAGES
A. Prevailing Specifications: 2020, INDOT Standard Specifications Section 108
B. Additions:
1. The contractor shall proceed with the work at such rate of progress to insure full completion within
the Contract Time. It is expressly understood and agreed, by and between the Contractor and the
Owner, that the Contract Time for completion of the work described herein is a reasonable time,
taking into consideration the average climatic and economic conditions and other factors prevailing
in the locality of the work, and excludes the time for unavoidable delays which were beyond the
control and without the fault of the Contractor.
2. If the Contractor shall fail to complete the work within the Contract Time, or extension of time
granted by the Owner, then the Contractor will pay to the Owner the amount for liquidated damages
a sum of five hundred dollars ($500.00) for each calendar day that the Contractor shall remain in
default after the time of completion stipulated in the Contract Documents.
3. The Contractor shall not be charged with liquidated damages or any excess cost when the delay
in completion of the work is due to the following and the Contractor has promptly given written
notice of such delay to the Owner and Engineer/Architect.
a. To any preference, priority, or allocation order duly issued by the Owner.
b. To unforeseeable causes beyond the control and without the fault or negligence of the
Contractor, including but not restricted to acts of God, acts of public enemy, acts of the Owner,
acts of another Contractor in the performance of a Contract with the Owner, fires, floods,
epidemics, quarantine restrictions, strikes, freight embargoes, and abnormal and
unforeseeable weather.
XIV. RETAINAGE AND FINAL PAYMENT
A. Prevailing Specifications: 2020, INDOT Standard Specifications Section 109
B. Additions:
1. Payments will be made every thirty (30) calendar days
2. Consistent with provisions of IC 36-1-12-14, the Board of Public Works shall retain a percentage of
payments throughout the duration of the project.
3. Before final payment and retainage are released the Contractor must satisfy the following:
a. All parts and labor meet requirements stated in the specifications.
b. Provide copies of test reports or cut sheets on all materials supplied.

c. Provide As-Built drawings in accordance with the City of South Bend Prevailing Specifications
for Public Works.
d. One (1) copy of the City of South Bend Completion Affidavit and one (1) copy of a Final Waiver
of Lien.
XV. WARRANTY
A. Prevailing Specifications: None
B. Additions
1. All Parts shall include the following:
a. Performance specifications

c. Warranties on all parts
d. Installation and safety requirements
XVI. OTHER UTILITIES
A. Prevailing Specifications: None
B. Additions:
1. The Contractor shall verify the locations of all utilities by contacting Indiana811 by calling 811 (in
Indiana) or 1-800-382-5544 (outside of Indiana), or via www.indiana811.org, at least two (2)
working days, not counting Saturdays, Sundays or federal and state holidays before proceeding
with construction. It shall also be the Contractor’s responsibility to contact any other utility that is
not contacted by Indiana811 and verify the utility locations.
2. The Contractor shall be responsible for working with the other utilities, i.e., gas electric, telephone,
etc. in order to assure that all utilities that need to be replaced or relocated can be done with a
minimum disturbance to service. The Contractor shall also be responsible for coordinating
schedules with the various utilities such that they can proceed with their relocation work as
efficiently as possible.
3. If the odor of natural gas is detected in a work area at any time during the course of work, the
Contractor shall immediately notify NIPSCO at 1-800-634-3524. The Contractor shall also
immediately notify the residents of adjacent properties. The Contractor shall advise the residents
to evacuate their homes immediately if the odor is present within the dwelling.
4. Restoration of sprinkler systems damaged by the Contractor's operations shall be repaired by the
Contractor at no additional cost to the City or the Owner of the system.
XVII. MAINTENANCE OF TRAFFIC
A. Prevailing Specifications: 2020, INDOT Standard Specifications Sections 105 & 801
B. Additions:
1. Maintenance of traffic during construction shall conform to the “Indiana Manual on Uniform Traffic
Control Devices” and the City of South Bend Design and Construction Standards.
2. The attached “Traffic Closure Request” form is to be used for any lane restrictions or closures and
required to be filled out and sent to the Department of Public Works
3. The Contractor shall arrange and prosecute the work specified for this contract in such a manner
that traffic on existing streets is unrestricted throughout the Project. The Engineer shall approve
the method of traffic control. No construction equipment, vehicles, materials, supplies or temporary
facilities shall be left unattended in the right-of-way of any street or left parked overnight without
proper marking and lighting.
4. After the award of the contract and before beginning the work, the Contractor shall submit his/her/its
proposed schedule of operations for the review of the Engineer. The schedule of operations as
reviewed by the Engineer shall be maintained at all times.
5. There will be no direct payment for this work.
6. Construction activities along the north access drive at the North Pumping Station shall be
coordinated with the Division of Utilities Project Representative(s). Chemical delivery trucks and

larger utility vehicles utilize the north access drive for chemical and product deliveries. Access to
the north access drive shall not be impeded during scheduled deliveries. Care shall be taken to
restrict and protect excavations where delivery access is necessary for operational needs.
XVIII. DESCRIPTION OF WORK
A. Prevailing Specifications: None
B. Additions
1. Work to be performed shall include furnishing all labor, services, materials, insurance and
equipment to demolish concrete sidewalk and curb, masonry repairs, excavation and pipe
embedment, concrete curb, and concrete sidewalk restoration within the City of South Bend.
The North Pumping Station project site is located at 830 North Michigan Street, South Bend,
Indiana 46601.
2. The Contractor shall preserve and protect all surrounding property, structures, tenants, visitors and
their property from damage caused by the Contractor’s operations.
XIX. PLANS
A. Prevailing Specifications: City of South Bend Design and Construction Standards
B. Additions:
1. The plans consist of 2 Sheets.
2. The work shall conform to the plans.
3. The drawings are schematic in nature.
4. The CONTRACTOR is responsible for estimating dimensions and quantities of materials.
5. In the event that the Special Provisions and the Plans conflict, the Special Provisions shall govern.
XX. M/WBE GOALS

XXI. SPECIAL NOTES & REQUIREMENTS
A. Ongoing Operations Within Project Limits
The Contractor shall not impede, interrupt or hinder the operation of existing water
treatment/distribution operations at the project site without prior written consent from the Owner. The
Contractor shall be responsible to provide sufficient dust/debris control measures, shoring assemblies,
and safety barricades to ensure repair efforts do not impede the continual operation of the facility.
B. INDOT Standard Drawings and Specifications
The following specifications are for this particular project. If any one, or several, of these conflict with
the current INDOT Standard Specifications and current INDOT Standard Drawings, the Project

Specification are valid and the current INDOT Standard Specifications and current INDOT Standard
Drawings which conflict are voided and the remainder of the current INDOT Standard Specifications
and current INDOT Standard Drawing shall be valid. Any not covered specifically by the Project
Specifications shall be referred to the Standard Specifications and Standard Drawings, and these will
be the governing factors for the project. The current INDOT Standard Specifications and current INDOT
Standard Drawings are available on-site at the INDOT website: http://www.in.gov/indot/. The Engineer
is available prior to the submission of bids/quotes regarding any bidder questions on accessing the
current INDOT Standard Specifications and/or current INDOT Standard Drawings.
C. Utility Locations
For protection of underground utilities, Contractor shall call Indiana’s Utility Location Service at 1 (800)
382-5544 a minimum o three (3) working days prior to excavating in the vicinity of utility lines. All 811
alert system participating members will thus be routinely notified. The Contractor shall be responsible
for notifying any and all utility owners who may not be part of the 811 alert system. The Contractor
shall be responsible for successfully coordinating with all affected existing utilities in the vicinity of the
project whether all utilities are indicated in the Contract Documents or not. The Contractor shall be
solely responsible for any and all coordination, payment, and full resolution of any damages to utilities
resulting from actions and/or omissions of the Contractor.
D. Pre-Bid/Quote Meeting
A Pre-Bid/Quote Meeting shall be held on-site at the North Pumping Station at 830 N. Michigan Street,
South Bend, Indiana 46601 from 9:00 A.M. to 10:00 A.M. on Friday, October 1, 2021. If a bidder is
unable to attend, bidders may contact Jacob M. Klosinski, P.E., Assistant City Engineer at (574) 235-
9496 or jklosins@southbendin.gov to schedule a site visit prior to submission of a quotation for the
subject project.
E. Pre-Construction Meeting
Approximately one (1) week prior to the start of construction, the Contractor shall request a pre-
construction meeting with the Owner and the Project Engineer to discuss the Contractor’s project
schedule and operations.
F. Underground Conditions
The Contractor shall perform any sub-surface investigations necessary to become familiar with local
conditions prior to bidding. There shall be no compensation for investigation work.
G. Projects Occurring in the Vicinity of the Work
Project No. 119-011 North Station Filter Rehabilitation work is scheduled to begin in December 2021
or January 2022. This work should not impact the work occurring under Project No. 118-302R North
Pumping Station Flood Damage Repairs. It is important that all exterior work be completed on-schedule
since staging areas for Project No. 119-011 North Station Filter Rehabilitation will utilize areas restored
during Project No. 118-302R North Pumping Station Flood Damage Repairs.
H. Bidder Questions
All Bidder questions during the bidding process shall be directed to Jacob Yoder, of Frost Engineering

I. The deadline for the submittal of Bidder questions to be considered for possible addendum is
close of business on Wednesday, October 6, 2021.

XXII. PROJECT SPECIFICATIONS – BASE BID ITEMS
1. MASONRY TUCK POINTING
A. General Description
Work for this item includes the furnishing of all equipment, material, and labor for cleaning, temporary
dust/debris control assemblies and tuck pointing of existing masonry as described herein.
B. Quality Assurance
Masonry restoration contractor shall have not less than five years documented experience doing work
specified herein. All Workmen shall be experienced in use of equipment on this project.
Contractor shall use full-time foreman who has minimum of three years of experience in all phases of
masonry restoration used in this project.
C. Regulatory Requirements
Contractor shall comply with the requirements of EPA regulations, OSHA regulations and the those
prescribed by the City of South Bend. Work shall be in accordance with 2012 International Building
Code.
D. Materials
a. Mortar: ASTM C270, Type N, match existing in color:
b. Water shall be potable, clean and free from acids, alkalies, or organic materials.
c. Sand shall conform to ASTM C144, and shall be hard, sharp, clean, well graded, and free of
organic material.
d. Lime shall conform to ASTM C207, type S, Hydrated lime for Masonry Purposes. Air entrained
lime shall not be used.
e. Cement shall conform to ASTM C150, type II Portland Cement. It shall not contain more than 0.6
percent alkali to avoid efflorescence. Air entrained mortar shall not be used.
f. The use of admixtures will not be permitted without the prior written approval of Owner/Engineer.
Expansion joint sealant material shall be a one component exterior type urethane nonsag (gun) grade
with elasticity to provide +25% movement capability. Color of sealant shall match existing mortar color.
Comply with Federal Specification TT-S-00230C, Type II, Class A. Backer rod shall be round
polyethylene closed-cell foam of such diameter to assure compression when placed and be compatible
with the sealant selected. Acceptable manufacturers:
· Tremco, DyMonic
· SIKA Corporation, Sikaflex-1a
· Sonneborn Building Products, Sonolastic NP-1
Acceptable cleaning agent manufacturers:
· ProSoCo
· Hydrozo
· Diedrich
E. Temporary Dust/Debris Control
Contractor shall be responsible to provide temporary dust/debris control measures to ensure repair
efforts do not impede the ongoing plant operations. Contractor shall provide sediment control measures
to ensure dust/debris does not enter/impact the existing floor drainage systems. Dust/Debris control
measures shall be in conformance with OSHA standard 29 CFR 1926.1153 and shall remain in place

F. Preparation
Contractor shall protect adjacent windows, utility piping & equipment, masonry and other elements
surrounding the work of this section from damage or disfiguration due to repair operations.
Where materials are attached to the masonry temporarily remove same to sufficiently allow access to
the masonry for required work. Re-attach or re-install at end of project. Provide new attachment
hardware where missing, finished to match existing. Contractor shall repair to existing condition any
damage to such materials caused by repair efforts or replace with like kind.
G. Repointing
Remove the damaged or fractured existing mortar joints to a minimum depth of 1", or as much as may
be necessary to reach sound material. Take care to avoid damaging existing masonry units or enlarging
width of joints.
Repair or replace existing masonry units damaged by cutting, spalling and chipping caused by routing
operations. Thoroughly remove loose material from joints using low-pressure compressed air. Final
preparation of the joint shall be done by hand.
Mortar should be mixed carefully to obtain uniformity of visual and physical characteristics and comply
with ASTM-C270. Material proportions by volume to produce type N minimum strength. Mortar should
be used within 30 minutes of final mixing. Re-tempering is not permitted.
After carefully routing and cleaning joints, wet joints thoroughly and then apply fresh re-pointing mortar.
Allow water to soak into joints, but joints shall not be visibly wet with standing water during tuck pointing.
Fill mortar joints in layers not over 1/4" thick with each layer applied with pressure as soon as previous
layer has partially dried. Do not tool each layer smooth; leave surface rough to help bond of subsequent
layers. Compress the final packing as much as possible to completely fill joint. Compact joints solidly
before final tooling.
Tool joints concave to match existing. Take care to not spread mortar over edges of brick onto exposed
surfaces. Do not featheredge mortar. Cure mortar by maintaining in a damp condition for 5 days. Allow
mortar to fully harden for 10 days after completion of work.
Thoroughly clean exposed masonry surfaces of excess mortar and foreign matter using stiff nylon or
bristle brushes and cleaning agent.
H. General Cleaning
Promptly as work proceeds and upon completion, remove excess mortar, smears, efflorescence and
droppings. Before cleaning verify that all mortar joints in area to be cleaned have been repointed and
are sufficiently hard for cleaning.
Test areas to be cleaned to determine the most effective cleaning method starting with the gentlest
means possible utilizing brush and water wash at low pressure. If alkaline or acidic cleaning methods
are necessary, mask off areas below to protect finishes that may be damaged by chemical cleaners.
Start cleaning at the lowest designated wall area and proceed to the top of the wall always keeping
surfaces wet below the area being cleaned and rinse frequently to reduce the potential for streaking.
After the designated area has been cleaned, wash down the wall areas below. The use of abrasive
cleaning, beyond stiff bristled brush, will not be permitted. Clean adjacent and adjoining surface of marks
arising out of execution of work of this section.
At end of each day’s work, sweep up and remove sand, mortar droppings, dust, dirt, debris, and rubbish.
At completion of this work, remove all construction aids and ensure that all sand, mortar droppings,
debris, and rubbish have been removed.

A. General Description
Work for this item includes, but is not limited to, the furnishing of all material, equipment, labor,
compaction, subgrade preparation, aggregate, concrete, reinforcing steel, formwork, lines and grades,
site restoration, lawful removal and disposal of materials and all other necessary items required to
provide the reinforced concrete sidewalk as shown in the plans and as specified herein.
B. Preliminary Work
The Contractor shall verify the locations of all utilities by contacting Indiana 811 at 1-800-382-5544 at
least three (3) working days, not counting Saturdays, Sundays or federal and state holidays before
proceeding with construction. It shall also be the Contractors responsibility to contact any private or
other utility that is not contacted by Indiana 811 and verify the utility locations.
C. Demolition Procedures
The Contractor shall preserve and protect all surrounding property, structures, tenants, visitors,
pedestrians, motorists and their property from damage caused by the Contractor’s operations. All
demolition activities shall be undertaken in such a way as to avoid any impact to adjacent properties
and public right-of-way that are to remain and/or be protected. The Contractor shall repair any damages
to the public right of way or private property not included in this demolition as a result of the Contractor’s
operations at his/her own expense.
Any falling construction debris and temporary accumulation of trash resulting from demolition activities
shall be contained within the subject property lines until promptly removed in a lawful manner. Any
debris that falls within adjacent property lines and right-of-way shall be removed immediately. Site
restoration shall be completed in such a way as to avoid impact to adjacent properties and right-of-way,
including storm water drainage. Any unauthorized damage to adjacent property and/or right of way
shall be restored immediately at the Contractor’s expense, and to the Owner’s satisfaction.
Removal of existing sidewalk shall be completed in accordance with Section 202.05 of the INDOT
Standard Specifications for Removal of PCCP, Sidewalks, Curbs, RCBA, and Reinforced Concrete
Moment Slabs.
D. Concrete
All concrete shall meet the requirements of INDOT Standard Specification section 702 for Class ‘A’
concrete with a minimum 6% entrained air. The Contractor shall provide job mix formula information,
including all concrete components and admixtures to the Engineer, sufficiently in advance of the work
to allow for review and approval or rejection. The approved job mix formula information shall be written
on the first concrete load ticket provided at the site prior to the start of each day's pour for verification.
Reinforced concrete sidewalk shall be constructed in accordance with City of South Bend Standard
Drawing 2-28.
E. Placement & Curing
The Contractor shall be responsible for taking all necessary precautions, such as pouring early in the
day, providing a watchman after hours, etc., to avoid vandalism or other damage to the concrete during
the curing period of the concrete.
The Contractor shall perform all work in accordance with all applicable INDOT Standard Specifications,
including but not limited to the specifications for subgrade and subbase compaction and grading,
forming, pouring, screeding, tining, curing, etc..

Metal reinforcing shall be accurately placed and secured in position. It shall be supported by concrete
or plastic chairs or spacers, or by metal hangers. Reinforcement shall be covered by at a minimum two
inches of concrete, unless specified or shown otherwise.
The Contractor shall provide curing operations in accordance with City of South Bend standard drawing
2-28 following the provisions of INDOT Standard Specification section 501.20.
The Contractor shall be responsible for any repairs or removal and replacement of all or portions of the
work due to vandalism, other damage, or any detrimental random cracking prior to the acceptance of
the project as deemed necessary by the Owner at the Contractor’s expense.
F. Concrete Joints
Concrete joints shall be constructed in accordance with City of South Bend standard drawing 2-12.
G. Washout Basin
Contractor shall provide a concrete washout basin in accordance with City of South Bend standard
drawing 7-6. Contractor shall coordinate location of washout basin with the Owner prior to installation.
H. Concrete Testing
Contractor’s concrete mix design submittal shall include the following test information:
· Compression tests in accordance with ASTM C39
· Slump tests in accordance with ASTM C143
· Air Content in accordance with ASTM C233
I. Welded Wire Mesh
Welded wire mesh shall be plain welded steel wire meeting the requirements of ASTM A185 and ASTM
A82. Wire mesh shall be installed in field or pre-cut sheets, rolled wire mesh shall not be accepted.
Contractor shall be responsible to provide adequate support such that proper alignment and cover are
provided.
All reinforcement shall be free from scale or excessive rust when placed in the work. A thin coating of
red rust resulting from short exposure will not be considered objectionable when reinforcement is placed
in the work, but any reinforcement having rust or scale or a thick coating shall be removed from the job
unless thoroughly cleaned and accepted by the Engineer. All reinforcement shall be stored off and
above the ground, out of danger of becoming coated with mud, oil or grease, and protected from the
weather. Reinforcement shall be placed in the positions shown on the plans or in accordance with the
instruction of the Engineer.
J. Measurement and Payment
The Contractor shall be paid for on a per square foot basis for concrete sidewalk installed and accepted
by the Owner/Engineer. Note that cost of all earthwork operations (excavation, backfill, compaction,

material storage, pedestrian barricades, traffic control devices, lawful removal and disposal of materials
and all other necessary items required to re-bed existing piping in accordance with City of South Bend
Standard Drawing 5-7 and as shown in the plans and specified herein.
B. Preliminary Work

existing bottom of pipe elevation.
D. Backfill, Compaction & Pipe Bedding
The intent of re-bedding efforts is to re-use in-situ soils where possible. The Engineer shall decide on
any question of soil suitability. No soils shall be removed from the site without specific approval from
the Engineer, until the project is accepted. Where voids or unsuitable soils require additional backfill
material, INDOT type II or III structural backfill shall be used in accordance with City of South Bend
Standard Drawing 5-7. Type II or III structural backfill shall be in accordance with INDOT section 211.
Backfill shall be placed in maximum 8” loose lifts and compacted to 100% standard proctor density.
All utility trenches to within 60” of a paved surface shall be backfilled using removable flowable fill to a
depth of 12” above the top of existing pipe crown. Removable flowable backfill shall be in accordance
with INDOT section 213.
The Contractor shall submit Removable Flowable Fill mix design and structural backfilll gradation
information to the Engineer for review/approval prior to backfill.
E. Temporary Shoring
Contractor shall provide temporary shoring as required to support existing building foundations and
exterior wall sections. Temporary shoring shall be sufficiently sized to ensure no detrimental cracking,
settling, or deterioration of foundation elements, masonry walls, window assemblies or façade. Shoring
assemblies shall be in accordance with OSHA subpart P – Excavations.
The Contractor shall submit to the Engineer a Temporary Shoring plan detailing the proposed shoring
efforts to be used on the project. The shoring plan shall be signed and sealed by a registered
Professional Engineer licensed in the State of Indiana. The submittal shall include the following
information:

incorporate any prior comments/revisions

F. Barricades & Traffic Control Devices
The Contractor shall be responsible to provide all permits, barricades, signage, lighting, fencing, and
any other devices required to erect and maintain the safety measures necessary for compliance with
all applicable OSHA and City of South Bend standards. Contractor shall be responsible to coordinate
and temporary drive closures with the Engineer/Owner a minimum of 2 weeks in advance of proposed
work.
G. Measurement and Payment
The Contractor shall be paid for on a Lump Sum basis for each pipe bedding operation completed and
accepted by the Engineer/Owner. Note that this cost shall include the cost of all excavation, temporary
material storage, pipe bedding, shoring and backfill/compaction of in-situ materials.
The Contractor shall be paid on a per cubic yard basis for backfill materials not originating from the

4. INTERIOR PIPE PENETRATION REPAIR
A. General Description
Work for this item includes, but is not limited to, the furnishing of all material, equipment and labor to
clean, grout and waterproof voids which surround existing pipe penetrations in the locations identified
in the plans and as specified herein.
B. Clay Masonry Units
Clay masonry units shall meet the requirements of the 2012 International Building Code section 2103.
New masonry units shall be “toothed-in” to existing wall construction. Color shall match that of adjacent
construction or as approved by the Owner.
C. Grouting
Minor voids at pipe penetrations shall be filled with a non-shrinking grout composed of 1 part portland
cement, 2 parts No. 23 fine aggregate, and an approved non-shrinking additive or a non-shrink, non-
metallic cementation grout in accordance with ASTM C 1107. Grout shall be colored to match adjacent
construction or as approved by the Owner/Engineer.
D. Materials
Other material specifications shall be in accordance with Section 1 – Masonry Tuck Pointing.
E. Interior Penetration Repair
Repair efforts generally include the removal of loose sediment and the grouting of any voids remaining
between the outside diameter of existing piping and masonry wall. After grouting, exterior-grade
waterproof caulk colored to match the existing mortar, shall be installed around the circumference of
the pipe.
F. Masonry Wall Reconstruction
Where the fire-suppression line penetrates the exterior masonry wall, north-west corner of the lower
level, requires approximately 16 square feet of masonry infill around the existing pipe. The proposed
masonry shall be “toothed-in” to the adjacent masonry and cut to fit the existing pipe. The remaining
void shall be grouted and caulked in accordance with the previous section.
G. Measurement and Payment
The Contractor shall be paid for on a per each basis for each pipe penetration repair completed and
accepted by the Owner/Engineer. The Contractor will be paid on a per square foot basis for masonry
wall construction completed and accepted by the Owner/Engineer.

5. INJECTION GROUTING
A. General Description
Work for this item includes, but is not limited to, the furnishing of all material, equipment, labor, boring
& drilling, pumping of cementitious grout slurry, masonry repair, cleanup, temporary dust/debris control
measures, cleanup and all other appurtenances required for filling the voids identified in the plans as
specified herein.
Contractor shall be responsible to inspect the premises prior to preparing his/her bid to ensure any
time, effort and materials related to accessibility constraints are appropriately addressed in the unit cost
provided.
Contractor shall note that exterior excavations required for pipe bedding operations will be utilized to
inspect/verify the adequate dispersion of injection grouting procedures. The Contractor shall be
responsible for appropriately scheduling construction activities to ensure grout installation/inspection
occurs prior to backfill. There will be no additional compensation for additional excavation,
backfill/compaction if exterior excavations are closed prematurely.
B. Cementitious Slurry
The slurry mixture shall be composed of lime, sand, ground clay, Portland Cement (Type 1A conforming
to A.S.T.M. C150), and fly ash in the following proportions by volume:

Mix shall be accomplished by use of continuous mixer. All aggregate shall be metered for precise mix
design to assure consistent quality control. Slurry material shall be mixed with enough potable water to
a workable consistency (3 to 6 inch slump). Material once mixed shall be utilized within two hours and
may not be retempered.
The Contactor shall submit proposed mix design to the Engineer for review/approval prior to grouting
operations.
C. Grouting Operations
The Contractor shall coordinate injection grouting operations with the Engineer/Owner a minimum of
one week in advance of commencing work. The Engineer/Owner shall be present at the time of
installation to approve adequate pipe bearing has been achieved prior to concluding work. Grout
installed without proper inspection from the Owner/Engineer will not be accepted.
The Contractor shall drill holes by means approved by the Owner/Engineer prior to commencing work.
The Contractor shall note that injection grouting operations, or dust/debris resulting therefrom, shall not
impede the ongoing facility operations. See temporary dust/debris control measures defined elsewhere
in these specifications. The quantity and location of holes shall be as necessary to ensure adequate
dispersion of slurry into existing voids.
Masonry shall be thoroughly scraped, brushed and cleaned after completion.
D. Masonry Repair
Holes resulting from grouting operations shall be cleaned by removing excess slurry and wire brushing
exposed sidewalls. The surface around the holes shall be dampened and holes shall be filled with a
non-shrinking grout composed of 1 part portland cement, 2 parts No. 23 fine aggregate, and an

approved non-shrinking additive or a non-shrink, non-metallic cementation grout in accordance with
ASTM C 1107. Grout shall be colored to match adjacent construction or as approved by the

removed/replaced in accordance with Section 4 – Interior Pipe Penetration Repair.

6. CONCRETE CURB & GUTTER
A. General Description

assembly as shown in the plans and as specified herein.
The general intent of these specifications is to replace in kind the existing curb and gutter assembly
which exhibits detrimental settlement as a result of sediment erosion (undermining). The extent of
removal & replacement is intended to remove any deficient section and return the curb & gutter back
to their intended line & grade. Any discrepancies between the information presented in these plans and
specifications with existing curb and gutter construction shall be brought to the Engineer/Owner for
Clarification, to include overall limits of removal/replacement if not aligned with the general intent.
B. Concrete
All concrete used for curb and gutter assemblies shall be INDOT class ‘A’. Curb and gutter assemblies

Contractor shall note that this is an undistributed quantity of pavement removal and replacement which
may or may not be included in the overall scope of work. The Owner reserves the right to distribute
some, all or none of the estimate quantity as future project needs require.
B. Limits of Removal/Replacement
The overall limits of removal shall be as-defined by the Owner/Engineer as future project needs require.
The Contractor shall not remove or damage any existing P.C.C.P. without prior authorization from the
Owner/Engineer. Removal/damage of existing pavement beyond the defined scope of work shall be
replaced as specified herein at the Contractor’s sole expense.
C. P.C.C.P. Patch
Existing concrete pavement shall be removed to an existing joint, or a full-depth neat-line sawcut
provided by the Contractor. P.C.C.P patch shall be in accordance with City of South Bend standard
specification section 2-6.1 (a). Concrete shall meet the following minimum requirements:

B. System Requirements
Dewatering system shall be of sufficient size and capacity necessary to lower and maintain ground
water table to an elevation below lowest bottom of pipe trench and to allow material to be excavated in
a reasonably dry condition. Materials to be removed shall be sufficiently dry to permit excavation to
grades shown and to stabilize excavation slopes where shoring is not provided. Dewatering system
shall meet the following minimum requirements:

C. Water Disposal
Water removed from the excavations shall be disposed in such a manner as it will not endanger portions
of work under construction or completed. Water disposal shall cause no inconvenience to Owner or to
others working near site and shall comply with any applicable City of South Bend standards.
D. Corrective Measures
If dewatering requirements are not satisfied due to inadequacy or failure of the dewatering system
(loosening of the foundation strata, or instability of slopes, or damage to foundations or structures),
perform work necessary for reinstatement of foundation soil and damaged structure or damages to
work in place resulting from such inadequacy or failure by Contractor, at no additional cost to the Owner.
E. Measurement and Payment

(1) and the provisions of paragraphs (1) through (7) in every subcontract or purchase

provisions will be binding upon each subcontractor or vendor. The contractor will take such
action with respect to any subcontract or purchase order as the administering agency may

The applicant further agrees that it will be bound by the above equal opportunity clause with

The City of South Bend, Indiana has shown its commitment to addressing Minority and Women’s Business
Enterprise (“MWBE”) participation in public contracting through the adoption of the City of South Bend Ordinance
No. 10761-21. Persons, partnerships, corporations, associations, or joint ventures awarded a contract by the City
of South Bend through its agencies, boards, or commissions shall not discriminate against any employee or
applicant for employment in the performance of a City contract with respect to hire, tenure, terms, conditions, or
privileges of employment, or any matter directly or indirectly related to employment because of race, sex, religion,
color, national origin, ancestry, age or disability that does not affect that person’s ability to perform work.
Minority and Women’s Business Enterprises are described in the Ordinance. A list of MBEs and WBEs (both
certified and non-certified) can be found on the Indiana Department of Administration website:

contracted, the dollar amount of the work that will be performed by the MBEs and WBEs on the project and the

The City, its agencies, boards, or commissions requires the Contractor’s good faith efforts to obtain participation by
those Contractors classified as MBEs and WBEs.
Failure to either meet the MBE and WBE goals or to provide evidence of good faith efforts for the bid will
be grounds for rejecting a bid as non-responsive.
Bidders shall demonstrate good faith efforts to have active participation from MWBEs on this Project and supply
written documentation evidencing such efforts by using Forms MBE-2.0, Evidence of Good Faith Efforts and WBE-
2.0, Evidence of Good Faith Efforts and Forms MBE-2.1, MBE Contacted and WBE-2.1, WBE Contacted. Such
documentation shall include, but is not limited to, the following items:

goods requested; and (5) the result of the contact.

responses from M/WBEs or other documentation of efforts to encourage and secure competitive responses
from M/WBE and local businesses to be included in the benefits of building this Project.
c. Written documentation of letters of introduction, invitations to forging majority/minority strategic alliances
for capacity building, including but not limited to, mentoring, extensions of assistance on payroll, insurance,
bonding, line of credit, technical skills or business skills.
All bidders are actively encouraged to reach out to the M/WBEs in St. Joseph County, Indiana, other Indiana

alien. Contractor agrees that he/she/it shall enroll in and verify the work eligibility status of all of
Contractor’s newly hired employees through the E-Verify Program as defined by I.C. 22-5-1.7-3.
Contractor’s documentation of enrollment and participation in the E-Verify Program is included

5. Contractor shall require his/her/its subcontractors performing work under this public
contract to certify that the subcontractors do not knowingly employ or contract with an

In awarding contracts for the purchase of work, labor, services, supplies, equipment, materials, or
any combination of the foregoing including, but not limited to, public works contracts awarded
under public bidding laws or other contracts in which public bids are not required by law, the City,
its agencies, boards, or commissions will consider the Contractor’s good faith efforts to obtain
participation by those subcontractors certified by the State of Indiana as a Minority Business
(“MBE”) or as a Women’s Business Enterprise (“WBE”) as a factor in determining the lowest,

Contractors seeking the award of a City contract cannot be required to award a subcontract to an

in the awarded contract.
I affirm that I reviewed the City of South Bend’s Minority and Women Business Enterprise
Inclusion Program Plan and the Indiana Department of Administration’s certified list of
Indiana Minority and Women Business Enterprises, found on their website
(http://www.in.gov/idoa).
I affirm that I have made good faith efforts to select portions of the contract work to be
performed by WBEs, including, where appropriate, breaking out contract work items into
economically feasible units to facilitate MWBE participation.
I affirm that I have made good faith efforts to solicit through all reasonable and available
means the interest of all WBEs in the scopes of work of the contract.
I affirm that I attended all pre-bid meetings scheduled by the City of South Bend to inform
WBEs of contracting and subcontracting opportunities.
I affirm that I advertised in general circulation and/or trade association publications
concerning subcontract opportunities and allowed WBEs reasonable time to respond to
such advertisements.
I affirm that I performed any and all necessary steps to provide written notices in a manner
reasonably calculated to inform WBEs of subcontracting opportunities and allowed
sufficient time for WBEs to participate effectively.
I affirm that I followed up on initial solicitations with interested WBEs.
I affirm that I negotiated with interested WBEs in good faith, including providing such WBEs
with adequate information about the plans, specifications and other requirements of the
subcontract.
I affirm that I have made good faith efforts to assist interested WBEs in obtaining bonding,
lines of credit, or insurance as required by the City or the bidder, where appropriate.

appropriate.
I affirm that I did not reject any WBEs as unqualified without sound business reasons
based on a thorough investigation of their capabilities.
CONTRACT RECORDS: The bidder has maintained the following records for each WBE that has bid on
the subcontracting opportunity:
1. Name, address, and telephone number;
2. A description of information provided by the bidder or subcontractor; and
3. A statement of whether an agreement was reached, and if not, why not, including any reasons for
concluding that the WBE was unqualified to perform the job.

omissions shall be considered grounds for rejection of the bid by the Board of Public Works. The City of
